Meals and Breaks. Whenever possible Dispatchers will be relieved for a lunch break, not to exceed one-half hour, at or near the halfway point through the shift when feasible. If during the break, a situation arises that it is necessary for the dispatcher to return to dispatching duties, they will do so without delay and they shall be paid an additional amount of wages equal to the straight time wage rate for the period of the lunch break lost, up to one half hour. The Employer will make every reasonable effort to provide each Dispatcher with two (2) ten minute breaks during each eight (8) hour shift in addition to the lunch break.

For purposes of this paragraph a nurse is deemed to have been requested to remain at his/her duty station if he/she is the only nurse assigned to an organized nursing unit for a shift, unless:
a. The nurse actually leaves his/her duty station during such meal period, or
b. The Medical Center provides in writing for alternate coverage of the unit during the meal period.
2. Patient care units may substitute other pre-arranged rest period schedules with the approval of the unit’s manager. If a nurse cannot be relieved for all or part of a scheduled or pre-arranged rest period and is not given alternative rest period time during the shift, the nurse should report this immediately to the nurse’s charge nurse, supervisor or manager.

3. If a meal break is not given by the end of five (5) hours worked, each employee shall be paid at one & one half times (x1.5) the prevailing rate and shall receive an additional ten dollars ($10.00) for each four hour period past the initial 4 hour call, or portion thereof, until a meal break is given.

One uninterrupted 26 meal period of one-half (1/2) hour on the nurse's own time, subject to 27 the provisions below: The Medical Center will make good faith efforts 28 to allow the nurses to take the meal period near the middle of the 29 nurses’ shift, subject to operational and patient care needs. If a nurse 30 is specifically requested by the Medical Center to remain at or return 31 to return to his/her duty station during a meal period, such period shall 32 be paid time.
1 4.2.3 The parties acknowledge the legal requirements and importance of 2 breaks and meal periods for nurses. The parties further acknowledge 3 that the scheduling of regular rest periods requires appropriate staffing 4 and scheduling, teamwork, professional accountability and charge 5 nurse’s involvement The parties therefore agree to the following:
6 4.2.3.1 Scheduling of breaks is best resolved by unit-based decisions 7 where the affected nurses are involved in creative and flexible 8 approaches to the scheduling of rest and meal periods.
10 4.2.3.2 Each unit will determine what reasonably available information 11 will help inform reviews of meal and break use. The units will 12 then use that information to develop a process for scheduling 13 nurses for the total amount of rest and meal periods set forth in 14 this section, to be included in their staffing plan.
16 4.2.3.3 The process must be approved by the unit manager; 19 minute rest periods and one (1) 30-minute meal period within 20 an 8-hour shift or three (3) 15-minute rest period and one (1) 21 30-minute meal period in a 12-hour shift; however a break and 22 meal period may be combined during the middle four (4) hours 23 of the nurse’s shift, when practical;

16 4.2.3 The Medical Center acknowledges the importance of breaks and 17 meal periods to the nurses. The parties further acknowledge that the provision of 18 regular rest periods requires appropriate staffing and scheduling, teamwork, 19 professional accountability and charge nurse’s involvement and may not be 20 possible due to the nature and circumstances of work in an acute care facility 21 (including emergent patient care needs, the safety and health of patients, 22 availability of other qualified nurses to provide relief, and intermittent and 23 unpredictable patient census and needs). It is understood that a missed break or 24 meal period due to any of the above referenced situations is not a basis for 25 disciplinary action. The parties therefore agree to the following:

4 4.2.3.2.2 The preferred approach is to relieve nurses for 5 two 15-minute rest periods and one 30-minute meal period within 6 an 8-hour shift. Shift-based variances from the preferred approach 7 may be made with the approval of the charge nurse on duty or the 8 supervisor, if the charge nurse is not available.
