PICKET LINE PROTECTION. 1. All teachers covered under this agreement shall have the right to refuse to cross or work behind a picket line unless the same is declared illegal by the Labour Relations Board or the Courts. Failure to cross such picket line shall not be considered a violation of this agreement nor shall it be grounds for disciplinary action by the Board. Any teacher refusing to cross or work behind such a picket line shall be considered to be absent from work without pay.
2. The Board shall not request, require, nor direct teachers covered under this agreement to do work or carry out duties normally performed by employees engaged in a strike, or locked out, nor shall teachers request, require, or direct pupils to carry out such duties.
PICKET LINE PROTECTION. An employee covered by this agreement shall have the right to refuse to cross a legal picket line or refuse to do the work of striking or locked out employees. Failure to cross such a picket line or to perform the work of striking or locked out employees where a legal strike or lockout is in effect by a member of this Union shall not be considered a violation of this agreement, nor shall it be grounds for disciplinary action, other than loss of wages for the period involved.
PICKET LINE PROTECTION. 1. Teachers covered by this Agreement may refuse to cross picket lines.
2. Where, for any reason, a teacher fails to report for duty when a picket line is at their place of employment, the teacher shall be considered absent, without pay, and the Board shall not discipline such teacher by reason of their failure to report for duty.
3. The Board shall not request nor direct teachers in its employ to do work or to carry out duties normally performed by employees engaged in a legal strike or locked-out, nor will District teachers request or require students to carry out such duties.

2. Failure to cross a legal picket line encountered in carrying out School Board business shall not be considered a violation of this agreement, nor shall it be grounds for disciplinary action by the Board.
3. The Board shall not request, require, nor direct teachers covered under this agreement, to do work or carry out duties normally performed by employees engaged in a strike, or locked out; nor shall the Board direct teachers to request, require or direct students to carry out such duties.
PICKET LINE PROTECTION. 1. All employees covered under this Agreement have the right to refuse to cross or work behind a picket line established as a result of a dispute as defined by the Labour Relations Act.
2. Failure to cross such a picket line shall not be considered a violation of this Agreement nor shall it be cause for disciplinary action by the Board.
3. Any employee failing to report to work under this article shall be considered to be absent without pay.
4. Teachers shall not be required to perform duties or work normally performed by employees in a legal strike or lockout except for emergent matters which would threaten the health and safety of students.
PICKET LINE PROTECTION. No employee covered by this Agreement shall be required to cross any picket line established at any location as a result of any legal strike. It is further agreed that where an emergency situation exists, an employee may deal with such emergency situation where the City and the Union agree that such emergency does in fact exist.

3. The Board shall not require employees to do work normally performed by employees engaged in a strike or lock out.
PICKET LINE PROTECTION. 1. All teachers shall have the right to refuse to cross a picket line. Any teachers failing to report to duty at their normal place of work shall be considered to be absent without pay.
2. Failure to cross a picket line encountered in carrying out normal School Board business shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action by the Board.
3. The Board shall not request, require, nor direct teachers to do work or carry out duties normally performed by employees engaged in a job action.
4. Teachers shall not be required to work with persons who are paid to perform any of the duties which would normally be performed by employees, while they are on strike or who are locked out.
PICKET LINE PROTECTION. 1. For the purpose of this Article, a duly constituted picket line shall be defined as one which meets both of the following criteria:
a. It has been established by the Association, the West Vancouver Municipal Employees' Association, or any other certified trade union.
b. It has not been declared illegal by either the courts or the Labour Relations Board.
2. An employee covered under this Agreement shall have the right to refuse to cross or work behind a duly constituted picket line. Any employees failing to report for duty for this reason shall be considered to be absent without pay, and no disciplinary action other than a commensurate salary adjustment shall be taken by the Board.
3. No employee covered by this Agreement shall be directed by the Board to do work or carry out duties normally performed by Board employees locked out or engaged in a legal strike.
4. All sick leave for Association members working in any particular work site is deemed to be cancelled during days when a duly constituted picket line appears in front of that site.
5. Notwithstanding Article A.25.4, an Association member who is in the midst of a long term illness shall be entitled to sick leave. A long term illness shall be defined as one commencing at least two days prior to the appearance of the picket line, and lasting for at least 2 weeks. Application in writing, supported by a medical certificate from a medical practitioner, shall be made to the Board by the member claiming such sick leave.

2. Failure to cross such a picket line shall not be considered a violation of this Agreement nor shall it be cause for disciplinary action by the Board.
3. Any employee failing to report to work under this Article shall be considered to be absent without pay.
4. The Board agrees that it shall not require teachers to perform duties or work normally performed by employees engaged in a legal strike or lockout or require teachers to direct pupils to carry out such duties.
5. During a lockout or strike, teachers shall not be required to work with persons not covered by this Collective Agreement, other than management, who attempt to perform any of the duties which would normally be performed by employees on strike or locked out.
