Crossing of Picket Lines During Strike. An Employee covered by this Agreement shall have the right to refuse to cross a picket line or to handle struck work arising out of Labour disputes. Failure to cross such a picket line or handle struck goods by a member of this Union shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action. An Employee who is absent by reason of refusal to cross a picket line shall be paid at the discretion of the Employer.

Crossing of Picket Lines During Strike. 1. All employees covered by this Agreement shall have the right to refuse to cross a picket line which has not been declared illegal by a court or the Labour Relations Board, which arises out of a dispute as defined in the Labour Code. Any employee failing to report for duty or refusing to cross a picket line shall not be subject to discipline but shall be considered absent without pay. 2. The Board shall not request, require, nor direct teachers covered under this Agreement to do work or carry out duties normally performed by employees engaged in a strike, or locked out.

Crossing of Picket Lines During Strike. (a) The College shall not request, require or direct employees within this bargaining unit to perform work during legal strikes that would normally have been carried out by those on strike. Nor shall the employee be required to cross any picket line legally established under the Statutes of British Columbia. (b) Both parties agree to attempt to obtain a permit from the striking Union for permission to provide emergency service where and when required.

Prisoner Guards at the R.C.M.P. Detachment shall be considered as providing an emergency service and shall in these instances only perform normal guarding duties.

A legal strike or lockout shall be as defined under the Labour Relations Act.

The Union agrees that it will not cause, authorize or sanction a strike as defined by the Labour Relations Code, which includes slowdowns, work stoppage or the curtailment of work or services, and the Employer agrees that it will not cause, authorize or sanction a lock-out as defined by the Labour Relations Code, during the term of the Collective Agreement.
