Crossing of Picket Lines During Strike. An Employee covered by this Agreement shall have the right to refuse to cross a picket line or to handle struck work arising out of Labour disputes. Failure to cross such a picket line or handle struck goods by a member of this Union shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action. An Employee who is absent by reason of refusal to cross a picket line shall be paid at the discretion of the Employer.

(a) The College shall not request, require or direct employees within this bargaining unit to perform work during legal strikes that would normally have been carried out by those on strike. Nor shall the employee be required to cross any picket line legally established under the Statutes of British Columbia.

In the event that any employee of the Employer, other than those covered by this Agreement, engage in a strike or where employees in a labour dispute engage in a strike and maintain picket lines, the employees covered by this Agreement shall have the right to refuse to cross such picket lines. Failure to cross such a picket line by the members of this Union shall not be considered a violation of this Agreement, nor shall it be grounds for disciplinary action.
Crossing of Picket Lines During Strike. No employee covered by this Agreement, except in emergency conditions, will be required to enter any building, property or business where a picket line is in evidence, when such picket line is established under the Statutes of the Province of British Columbia or the Statutes of Canada.
Crossing of Picket Lines During Strike. 1. All employees covered by this Agreement shall have the right to refuse to cross a picket line which has not been declared illegal by a court or the Labour Relations Board, which arises out of a dispute as defined in the Labour Code. Any employee failing to report for duty or refusing to cross a picket line shall not be subject to discipline but shall be considered absent without pay.
Crossing of Picket Lines During Strike. No employee shall be required to cross a picket line arising out of a labour dispute except to provide emergency service or carry out emergency inspections. Prisoner Guards at the Police Detachment shall be considered as providing an emergency service and shall in these instances only perform normal guarding duties.

Unless an emergency involving public health would exist, an employee covered by this Agreement shall have the right to refuse to cross a picket line where a legal strike or lockout is in effect. Failure to cross such a picket line where a legal strike or lockout is in effect shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action. A legal strike or lockout shall be as defined under the Labour Relations Act.
