Accident BenefitsYour policy reimburses actual costs for covered expenses related to the diagnosis and treatment of injuries resulting from an accident, up to the annual limit noted on your declarations page. Eligible accident expenses are:
Accident Benefits. Whenever a professional employee is absent from school as a result of personal injury compensable under the Massachusetts Workers' Compensation Laws, caused by an accident arising out of, and in the course of his/her employment, he/she may elect to charge all or part of such absence during the period of temporary disability due to the accident to sick leave, in which event he/she shall receive the sick leave pay to which he/she is entitled for the period so charged, less the amount of any Workers' Compensation award made for temporary disability due to said injury for any period for which sick leave pay is paid. In the absence of such election, such professional employee shall not receive his/her sick leave payments during the period of his/her absence for temporary disability due to the accident, and his/her sick leave credit shall not be reduced by any reason of any Workers' Compensation payments he/she may receive for temporary disability due to injury. An employee may elect to draw upon such wages as have been earned by said employee prior to his/her injury and withheld for payment as so called "summer monies", during that period of time between the occurrence of the injury and the determination by the City Solicitor as to coverage by Workers' Compensation. An employee who makes such an election must take his/her remaining "summer monies" as a lump sum payment.
Accident BenefitsThe Insurer agrees to pay to or with respect to each insured person as defined in this section who sustains bodily injury or death directly and independently of all other causes by an accident arising out of the use or operation of an automobile. SUBSECTION 1 MEDICAL PAYMENTS (1) In respect of (a) injuries to which the Diagnostic and Treatment Protocols Regulation applies and that are diagnosed and treated in accordance with the protocols under that Regulation, the expenses payable for any service, diagnostic imaging, laboratory testing, specialized testing, supply, treatment, visit, therapy, assessment or making a report, or any other activity or function authorized under that Regulation, and payment must be made in the manner and subject to the provisions of that Regulation, notwithstanding anything to the contrary in Section B, and (b) injuries (i) to which the Diagnostic and Treatment Protocols Regulation applies but that are not diagnosed and treated in accordance with the protocols under that Regulation, (ii) to which the Diagnostic and Treatment Protocols Regulation ceases to apply but for which the insured person wishes to make a claim under provision (3) of “Special Provisions, Definitions, and Exclusions of Section B”, and (iii) to which Section B applies, other than those injuries referred to in subclauses (i) and (ii), all reasonable expenses incurred within 2 years from the date of the accident as a result of those injuries for necessary medical, surgical, chiropractic, dental, hospital, psychological, physical therapy, occupational therapy, massage therapy, acupuncture, professional nursing and ambulance services and, in addition, for other services and supplies, including any medically necessary equipment, home modifications or vehicle modifications, that are, in the opinion of the insured person’s attending physician and in the opinion of the Insurer’s medical advisor, essential for the treatment or rehabilitation of the injured person, to the limit of $50 000 per person. (2) Notwithstanding provision (1), (a) expenses payable in respect of chiropractic services provided under provision (1)(b) are limited to $1000 per person; (b) expenses payable in respect of massage therapy services provided under provision (1)(b) are limited to $350; (c) expenses payable in respect of acupuncture services provided under provision (1)(b) are limited to $350. Accident BenefitsThe Insurer agrees to pay the benefits outlined in this Section B to or with respect to each insured person as defined in this section who sustains bodily injury or death directly and independently of all other causes by an accident arising out of the use or operation of the automobile as a transportation network automobile. For the purposes of this section, use or operation of the automobile as a transportation network automobile means: (a) anytime a transportation network driver operating a transportation network automobile is logged onto a transportation network for the purposes of accepting requests for transportation services for compensation from prospective passenger(s); or (b) anytime from the moment a transportation network driver operating a transportation network automobile has accepted a ride request through a transportation network, continuing while such transportation network driver is enroute to pick up prospective passenger(s) to provide transportation services for compensation, and ending when the first passenger enters the transportation network automobile or a trip is cancelled whichever is later; or (c) anytime from the moment a transportation network driver operating a transportation network automobile has passenger(s) in a transportation network automobile, continuing while such passenger(s) are being transported for compensation, and ending when the last passenger departs from the transportation network automobile.

Eligible accident expenses are: 1) Alternative therapy. 2) End of life expenses. 3) Intravenous (IV) fluids and medications. 4) Medical supplies (such as but not limited to bandages, casts and splints). 5) MRI or CT scans and X-rays. 6) Poison control consultation fees. 7) Prescription food to treat a covered condition; not for general health maintenance, or prevention, even if prescribed or dispensed by a veterinarian. 8) Prescription medications prescribed by a veterinarian and approved by the Food and Drug Administration (FDA).

Accident BenefitsThe Corporation shall pay accident benefits to or on behalf of an insured on the same terms and conditions as set out in Part 7 of the Regulation. For the purposes of the payment of claims under this section of this policy:
Accident Benefits. If proof be furnished satisfactory to the Insurer that a member insured under this policy has suffered any loss or expense as a direct result of bodily injury or injuries caused solely through accidental, violent or external causes and that such loss resulted within the time limit as specified herein, then, except as provided in the General Conditions, Limitations and Exclusions, the Insurer upon approval of said proof, will pay the benefits for such loss or expense as provided in the following tables. Accident Benefits. If an eligible employee is totally disabled due to a non-occupational accident, payment as outlined below will be made to such employee while under the care of a physician for a period not exceeding weeks. Benefits for disability caused through accidental injury as described above will be paid commencing with the first working day the employee is unable to report due to his disability. Sickness Benefits If an eligible employee is totally disabled due to a non-occupational sickness, payment as outlined below will be made to such employee while under the care of a physician for a period not exceeding weeks. Benefits for disability caused through non-occupational sickness described above will be paid commencing with the day the employee is unable to report for work due to sickness. (This period shall include 5 plant working days). Benefits for disability caused through surgery will be paid commencing with the first day of hospital confinement or the day of outpatient surgery excluding cosmetic surgery. Benefits for disability caused through sickness, which necessitates confinement in a hospital for a period of at least one full day commencing during the waiting period, will be paid commencing with the first day of disability for which the employee is eligible for a Daily Hospital Expense Benefit as a result of hospital confinement. The date upon which disability terminates shall be the last day prior to the day upon which the employee’s attending physician states the employee is able to resume work.
