AGENCY SHOP AND DUES CHECK OFF. 4.1. The Employer will not discriminate against any employee because the Employee voluntarily chooses to be a member of the union or to otherwise pay fees to the Union for bargaining and defending the Collective Bargaining Agreement; nor will the Employer discriminate against any Employee who chooses not to be a member of, or not to pay dues/fees to the Union.
4.2. Upon completion of thirty (30) days of employment, membership in the Union or compliance with payment of the representation fees shall be voluntary. If an employee voluntarily submits a dues/fees deduction form, the Employer agrees to deduct Union dues/fees to become effective the first payday of the month following the Employee's successful completion of thirty (30) days of employment.
4.3. The Employer agrees to deduct from the salary of each individual employee in the bargaining unit who voluntarily becomes a member or who voluntarily authorizes the payment of representations fees, subject to all of the following conditions:
A. The Union shall obtain from each employee who voluntarily agrees to become members or pay a representation fee a completed Check-Off Authorization Form which shall conform to the respective State and Federal law(s) concerning that subject.
B. All Check-Off Authorization Forms shall be filed with the Employer, who may return an incomplete or incorrectly completed form to the Union's Treasurer and no check-off shall be made until such deficiency is corrected.
C. The Employer shall check-off obligations which come due at the time of check-off, and will make check-off deduction only if the Employee has enough pay due to cover such obligation. If an employee withdraws his/her check-off authorization form, in writing to the Employer and the Union, no deduction shall be made commencing with the first full pay-period after the authorization was withdrawn. The Employer is not responsible for refund to the employee if he/she has duplicated a check-off deduction by direct payment to the Union.
D. The Employer's remittance shall be deemed correct if the Union does not give written notice to the Employer within two (2) calendar weeks after a remittance is transmitted, of its belief, with reason(s) stated therefore, that the remittance is incorrect.
E. The Union shall provide at least thirty (30) days' written notice to the Employer of the amount of Union dues and/or representation fee to be deducted from the wages of employees in accordance with this Article. Any changes in the amo...
AGENCY SHOP AND DUES CHECK OFF. Section A. It shall be a continuing condition of employment with the County that employees covered by this Agreement: 1) shall become and remain members of the FOP in good standing to the extent of paying the FOP membership dues, or 2) in the alternative an employee shall be required to pay a service fee in the amount of twelve dollars ($12.00) biweekly for a total of three hundred twelve dollars ($312.00) per year for the duration of this contract. Such biweekly payments shall be deducted by the County. In the event of an FOP dues increase, the service fee may be increased on July 1 of any year of this Agreement upon sixty (60) days advance notice to the County. The increase shall not exceed the new dues amount. The FOP is responsible for certifying in writing all dues increases and the correct amount to be deducted for each bargaining unit member.
Section B. The FOP shall, upon the County’s request, not more than once each year of this Agreement, provide to the County an opinion of its counsel certifying to the FOP’s compliance with the substantive and procedural requirements of applicable public law with respect to fees charged nonmembers.
Section C. The FOP shall indemnify and hold the County harmless against any and all claims arising from actions taken by the FOP with regard to the collection of agency service fees and voluntary political contributions or the resolution of disputes concerning agency service fees and voluntary political contributions, including the cost for attorneys, expert witness, or other litigation expenses, provided that the FOP may satisfy its obligations with respect to legal fees by offering to have the attorney representing the FOP in any proceeding hereunder represent the County. In the event the County is the sole defendant, or the County determines that there is a conflict between the interests of the FOP and the County Attorney’s Office does not represent the County, then the FOP’s legal fee obligation shall be limited to providing an attorney, acceptable to the County, whose fees are comparable to those customarily charged the FOP.

AGENCY SHOP AND DUES CHECK OFF. Employees covered by this Agreement shall pay, as a condition of continued employment, to the POAM those fees that POAM determines to be that employee's proportionate share of the cost of negotiating and administering this collective bargaining agreement. This fee shall be determined in accordance with the standard procedures established by the POAM for this purpose. If during the term of this Agreement it shall be determined by a court of competent jurisdiction that the percentage developed by the POAM is unlawful or does not fairly represent the proportionate share of the cost of negotiating and administering the Agreement, the amount shall be modified to such amount as shall be lawful and proportionate.
AGENCY SHOP AND DUES CHECK OFF. A. As the sole and exclusive bargaining agent for employees as recognized above, the Union will receive dues payment from all represented employees. The employer agrees that it will, on the first payroll in each month, deduct the Union dues from the pay of each employee who is a member of the union and any permanent employee in the bargaining unit who does not join the Union within thirty (30) days thereafter, shall as a condition of employment, pay a Representation fee to the Union by automatic payroll deduction. The Representation Fee shall be in an amount equal to eighty-five percent (85%) of the regular Union membership dues, fees, and assessments as certified to the Town by the Union. The Union may revise its certification of the amount of the Representation Fee at any time to reflect changes in the regular union membership dues, fees, and assessments. The Union’s entitlement to the Representation Fee shall continue beyond the termination date of this Agreement so long as the Union remains the majority representative of the employees in the unit, provided that no modification is made in this provision by a successor agreement between the Union and the Town. These dues will be transmitted with a list of such employees to the Secretary-Treasurer of Local Union 866 within ten (10) days after dues are deducted.
B. After a Union employee has been employed for thirty-one (31) days, the Employer agrees to deduct the initiation fee in four (4) consecutive weekly payments and to transmit the same as set forth above. No initiation fee is required for Non-Union employees.
C. The Union agrees to furnish written authorization, in accordance with law, from each employee authorizing these deductions.
D. The Union will furnish the Employer a written statement, of the dues and initiation fees to be deducted.
E. The Union shall indemnify and save the Township harmless against all claims, demands, suits and other forms of liability, which may arise by reason of any action then in making deductions, remitting the same to the Union pursuant to this Article.

AGENCY SHOP AND DUES CHECK OFF. A. During the life of this agreement, an employee retains the freedom of choice whether or not to become or remain a member of the Union.
B. Union dues shall be deducted by the Board of Education from the paycheck of each employee who signs and remits to the Board an authorization form. Such deduction shall be discontinued upon written request of an employee thirty (30) days in advance. Such deduction shall start after the employee has completed thirty (30) days of employment.
C. Any employee who within thirty (30) days of employment fails to become a member of the Union, or any employee whose Union membership is terminated for any reason, or any employee who resigns from Union membership shall be required to pay an agency service fee under Section D.
D. The amount of dues or agency fee deducted under this Article together with a list of employees shall be remitted promptly to UPSEU, 0000 Xxxxxxxx Xxxxxxx, Xxxxx X, Xxxxxxxxxx, Xxx Xxxx 00000, together with a list of employees and their addresses for whom any such deduction is made.
E. The organization agrees to indemnify and to hold the Board harmless against any and all claims, demands, suits, or other forms of liability that shall, or may arise out of, or by reason of, action taken by the Union for the purpose of complying with the provisions of this Article.
AGENCY SHOP AND DUES CHECK OFF. A. Agency Shop Effective July 1, 1996, any member of the bargaining unit who commenced his/her employment with the College on or after December 4, 1995, and who is not a member of the Union in good standing or who does not make application for membership within thirty (30) days from the date he/she commences employment shall, as a condition of employment, pay as a service fee to the Union an amount equal to the professional dues uniformly required of members of the Union. In the event that a bargaining unit member shall .not pay such professional dues or the service fee directly to the Union, or authorized payment through payroll deductions as provided in paragraph B. below, the College may cause the termination of employment of such bargaining unit member. The parties expressly recognize that the failure of any bargaining unit member to comply with the provisions of this Article is just and reasonable cause for discharge from employment, and that said service fee is herewith deemed to be the sums required to insure that non-members pay their fair share of the financial support of the Union and of the costs of obtaining and administering the benefits to be received hereunder.
