INDUSTRY ADVANCEMENT FUND. The Union agrees to Management's participation in industry advancement funds and will participate as a partner in proposed industry dialogues.
INDUSTRY ADVANCEMENT FUND. The employer does hereby agree to contribute five cents ($0.05) per hour worked by all employees employed under the scope of this agreement monthly to the Paducah Area Construction Advancement Foundation. The aforesaid employer contributions shall be made to the appropriate depository as designated by the Union, with the depository remitting funds monthly to the Foundation. The purpose of the Fund shall be to promote the construction industry as to, but not limited to, public relations and advertising, contract specification improvement programs, the promotion of stable labor-management relations, monetary support for the training and upgrading of employees and such other purposes as are consistent with this program. No expenditure from said fund shall be made for any activity harmful or injurious to the Union. No part of the funds allocated for the Paducah Area Construction Advancement Foundation shall be spent directly or indirectly for any of the following purposes:
1. Promotion of legislation opposed by the Union or opposition of legislation favored by the Union;
2. Subsidies, indemnities, or payment of any kind to contractors during, for or in connection with a period of strike, lock-out or work stoppage;
3. Litigation before any court or administrative body against the Union, or the payment of any expenses directly or indirectly involved in any such litigation;
4. Publicity or public relations campaigns in support of management’s position respecting bargaining negotiations with the Union
INDUSTRY ADVANCEMENT FUND. Each Employer covered by this Agreement shall pay to the Industry Advancement Fund at the rate specified in ARTICLE V for each hour paid by the Employer to the employees within the bargaining unit. Payment shall be made with such instructions and on such forms as are furnished by the Association. Delinquent contributions shall be subject to such penalties or assessments as the Directors may prescribe from time to time. If payments are not made as stated herein, it shall constitute a status of delinquency and a violation of this Agreement.
INDUSTRY ADVANCEMENT FUND. 1. The EMPLOYER agrees to pay the Associated General Contractors of Illinois Industry Advancement Fund (IAF) the sum of three cents ($0.03) per hour worked for all hours paid at straight time or overtime to each employee working under this agreement.
2. The contributions to the IAF shall be deposited each month, or at such other regular intervals as may be determined by the Association, to the depository designated by the Association. Such contributions shall be reported and sent to the depository designated by the Association on a form that contains other contributions. Failure of an EMPLOYER to comply with this Article shall be deemed a direct violation of the Agreement.
3. The activities of the IAF shall be determined by the Association and shall be financed from the payments herein provided for.
4. Upon request, the EMPLOYER hereby agrees to provide the designated representative of the Association its payroll records to determine compliance with this article.
5. The EMPLOYER and the Union agree that any action, including the filing of a law suit, by the Association to enforce this Article is not subject to any of the grievance/arbitration provisions of this agreement. If the Association files a lawsuit against an EMPLOYER to collect delinquent contributions under this Article, the EMPLOYER agrees that the Association shall be entitled to recover interest of five percent (5%) per annum on the unpaid or late-paid contributions and to recover attorneys’ fees and cost.
INDUSTRY ADVANCEMENT FUND. Section 1. Each Employer is to contribute to the Indiana Constructors Industry Advancement Fund ("ICIAF"), or to a successor fund approved by the ICIAF Committee, THIRTEEN CENTS ($0.13) per hour, or whatever amount the ICIAF Committee
Section 2. The contribution to ICIAF shall be deposited each month, or at such other regular intervals as may be determined by the ICIAF Committee to the depository designated by the ICIAF Committee and such contributions shall be reported on such forms as may be designated by the ICIAF Committee.
Section 3. The activities of ICIAF shall be determined by the ICIAF Committee and shall be financed from the payments herein provided for. The Employer expressly ratifies and adopts the ICIAF Policy Statement. The Employer expressly hereby acknowledges the substantial benefits that are rendered to it as a result of ICIAF. By execution of this Agreement, the Employer ratifies all actions taken or to be taken by the ICIAF Committee within the scope of its authority.
Section 4. The Employer hereby agrees that the designated representative of the ICI- LRD or the ICIAF Committee, shall be permitted, upon request, to audit the payroll records of the Employer to determine compliance with this Article. In the event of an audit, or if a lawsuit is commenced to collect any apparent delinquencies, the Employer agrees to be responsible for, and to pay, all expenses and costs of the audit and/or collection, including reasonable attorney's fees, incurred by the ICI-LRD and/or ICIAF. It is further understood that such Employer shall be obligated to pay any delinquent contributions to ICIAF with interest charged at the rate then applicable to Internal Revenue Service collection of delinquent and/or unpaid taxes.
Section 5. It is expressly agreed and understood that no Employee, Employer or Union has any vested or proprietary interest in, or right to, any sum constituting a part of ICIAF.
INDUSTRY ADVANCEMENT FUND. INDUSTRY ADVANCEMENT FUND. Section 1. During the period June 1, 2021 to May 31, 2024 each Employer shall contribute to the Finishing Contractors Association of Chicago Industry Advancement and Promotional Fund Formerly known as the “Chicago Painting and Decorating Contractors Industry Advancement and Promotional Fund” (the “Industry Advancement Fund”) twenty seven cents (27¢) per hour. Such contributions shall be made at the same time and in the same manner as contributions are made to the other funds maintained under this Agreement. The Industry Advancement Fund contribution rate may be increased based upon a reasonable demand made by the Association and approval of the increase by the Union. In the event such an increase is approved by the Union for the Industry Advancement Fund, a like increase will be made to the Cooperation Trust.
Section 2. It is expressly understood and agreed that the Agreement and Declaration of Trust creating the Industry Advancement Fund, together with any amendments and by-laws pertaining thereto are made a part of this Agreement and each Employer party to this Collective Bargaining Agreement agrees to become and remain bound by, and to be considered a party to said Agreement and Declaration of Trust, as if that Employer had signed the original copy of the trust instruments and all amendments thereto.
Section 3. Inasmuch as the existence and utilization of the Industry Advancement Fund should result in greater job opportunities, the Union agrees to cooperate in assuring that the contributions required by this Article are in fact made by Employers bound by this Agreement.
Section 4. The collection of amounts due under this Article shall not be subject to the procedures set forth in Article 16 of this Agreement.
Section 5. The Employers shall defend, indemnify and save the Union harmless against any and all claims, demands, suits or other forms of liability that may arise out of or by reason of action taken for the purpose of complying with this Article.
Section 6. If an Employer elects not to contribute to the Industry Advancement Fund, then the Employer shall contribute a like amount to the Painters Scholarship Fund together with any costs of collection including legal and accounting fees.
