Jury Duty / Court Service. If an employee is required to appear in court or pursuant to a subpoena or other order of a court or body or to perform jury services in such appearance or service results in his/her absence from work, he/she shall be granted court service leave for the period of time necessary to fulfill such requirement. Any employee who makes an appearance and whose services are not required shall return to work as soon as practicable after release. An employee on court service leave for a full day shall receive the difference between the payment received for such court services excluding any travel allowance and his/her regular pay. Any employee returning to work from court service leave shall be paid by the State for his/her actual hours worked or a minimum of the difference between the payment received from the court excluding any travel allowance and his/her regular pay whichever is greater. Any employee assigned to the third shift who serves on jury duty for a period of over four (4) hours in any one (1) day will not be required to report to work on their next regularly scheduled shift within a twenty-four (24) hour period. An employee who is called to appear as a witness in his/her official capacity by a court, including administrative court, on a scheduled day off, a scheduled vacation day or other approved day off shall be paid for the hours so spent, including actual, necessary travel time, at his/her appropriate rate of pay. The provisions of this Article shall not apply to any employee summoned to or appearing before a court or body as a party to any private legal action which is not job related.

Jury Duty / Court Service. A Leave of Absence is granted for jury duty. Employees will receive pay based on a regular workday for this time. A similar absence is granted for an employee’s subpoenaed testimony in court if called as a witness. Employees will receive pay based on a regular workday unless required to appear in court as a result of employment outside of the Company. All compensation received for court services may be retained by employees. A paid absence will not be granted if the employee is a plaintiff or a defendant in any case, unless he is a defendant within the scope of his Company employment. However, an unpaid leave for documented court service will be excused unless the nature and frequency of such absences and / or the employee’s overall unsatisfactory attendance record warrant that it not be excused. To be excused from work, with pay, for jury duty or court testimony, an employee must submit a summons or subpoena to his supervisor. The employee’s time will be recorded under the Jury code for the absence. Such absences are in addition to other paid time off and will not be charged against an employee for purposes of imposing disciplinary action. When excused by the court during working hours, an employee must contact his supervision and report for work, if requested. Employees who would otherwise be working in the 4:00 p.m. to 8:00 a.m. period shall be considered as scheduled on the day shift on days required to report for jury or witness duty.

  • JURY DUTY PAY All employees required to serve on jury duty shall be paid by the School District the difference between their regular pay and jury duty pay. In implementing this section, the School District shall continue to pay the employee the regular rate of pay and the employee shall be obligated upon receipt of the jury duty pay from the governmental agency to immediately remit any witness fees received to the School District less any mileage expenses. Absences under this section shall not be deducted from accumulated leave.

  • Jury Duty/Subpoena A. An employee shall be allowed such time off without loss of compensation as is required in connection with mandatory jury duty. If payment is made for such time off, the employee is required to remit to the State jury fees received. When night jury service is required of an employee, the employee shall be allowed time off without loss of compensation for such portion of the required time that coincides with the employee's normal work schedule. This includes any necessary travel time.

  • Paid Jury or Court Witness Duty Leave The Employer shall grant leave of absence without loss of seniority to an Employee who serves as a juror or witness in any court. The Employer shall pay such an Employee the difference between normal earnings and the payment received for jury service or court witness, excluding payment for traveling, meals or other expenses. The Employee will present proof of service and the amount of pay received. Time spent by an Employee required to serve as a court witness in any matter arising out of her employment, shall be considered as time worked at the appropriate rate of pay.

  • Jury Duty and Court Appearances (1) An employee who is summoned as a member of a jury panel or subpoenaed as a witness in a matter not involving the employee's personal interests, shall be granted leave with pay and any jury or witness fees shall be retained by the employee; leave granted hereunder shall not affect an employee's annual or sick leave balance.
