Living Away From Home Distant Work. Where Employees are required to live away from home the Company will provide accommodation mutually agreed by the parties. Where there is any dispute in respect of the quality of the accommodation the issue will be resolved in accordance with the dispute resolution procedure of this Agreement.
Living Away From Home Distant Work. For the purpose of this agreement “Distant Work” is where the location of work is such that it requires the employee to sleep at some place other than his/her usual place of residence. When an employee is engaged in distant work, the employer may elect to: · Provide the employee with reasonable board and lodging, including three meals per day, or · Pay the employee an allowance of $80.00 per day, but such an allowance will not be wages. This allowance may be increased if the employee satisfies the employer that he/she incurred a greater outlay than that provided.
Living Away From Home Distant Work. For the purposes of this clause "distant work" is where the location of the on site work" (as defined) is such that because of its distance or because of the travelling facilities available to and from the location, it is reasonably necessary for an employee to live and sleep at some place other than his/her usual place of residence.
Living Away From Home Distant Work. Where work takes place on a job or construction work at such a distance from the employee’s usual place of residence that it is unreasonable for the employee to return to that place each night, the Company and affected employees will reach agreement on the arrangements for travel, board and accommodation.
Living Away From Home Distant Work. 25.1. Where an employee is employed on work such a distance from the employee’s usual place of residence that the employee cannot reasonably return to that place each night, the employee will be required to live away from home.
25.2. The Employer and the employee will agree on what is reasonable having regard to:
a. The distance and time to be travelled; and
b. The employee’s personal circumstances; and
c. The hours of work for each day.
25.3. No employee will be financially disadvantaged due to working on a project requiring them to live away from home.
25.4. Where productive work as defined in Clause 51 of this Agreement has occurred, employees engaged on Distant Work will receive the “LAH Distant Work Allowance per day” of $21.00 as shown in Appendix A.
25.5. Employees will be paid at ordinary rates (up to a maximum of eight (8) hours per day) for the time taken travelling from their usual place of residence to the distant site at the commencement and completion of the project.
25.6. Compensation for travel by the employee to their principal place of residence during the duration of the project is not obligatory. It shall be by agreement of the Employer and affected employees.
25.7. Consideration shall be given by the Employer to scheduling the planned rotation of employees engaged on distant work.
25.8. The following shall be considered when determining “special circumstances’, for paid travel compensation during the duration of the project and rotation of employees:
a. Impact on the employee’s quality of life.
b. Safety and welfare of the employee.
c. The personal circumstances of the employee.
d. Impact on project efficiency and profitability.
25.9. The Employer will offer distant location work to employees. Whilst the Employer may intend to use employees on distant projects, the contractual obligations relevant to the use of local labour and the Employer's competitiveness will be the determining factors. It is also acknowledged that it is not the intention of the Employer to be employing local labour on a distant location while making employees redundant.
25.10. Employees who qualify for the Living Away from Home (LAFH) allowance, when responsible for arranging their own board, lodging and food, shall be entitled to the “Living Away from Home (LAFH) allowance per week” of $625.00 as shown in Appendix
A. This weekly rate will apply to a five (5) or six (6) day working week.

Living Away From Home Distant Work. (a) Where an Employee is required by the Employer to work away from their normal residence overnight then the Employee will be provided the following Living Away From Home Allowance (LAFHA), as detailed in Schedule C, to cover reasonable accommodation, meals and disturbance caused.
(i) LAFHA provides compensation for all costs associated with meals, incidentals and the disturbance of being away from home. The Employer is to provide reasonable accommodation. Employer pays for accommodation & provides $110 per night to cover meals etc.
(b) Meal Allowance ("OTMA") is payable whilst in receipt of LAFHA.
(c) Additional non-business costs occurred with the accommodation provider, i.e. mini-bar, movies, are not covered by the Employer and will be recovered from the Employee in the next pay cycle.
(d) The Employer, in consultation with the Employees, will develop a list of preferred accommodation suppliers, as well as accommodation to be avoided, to be used for the purposes of booking accommodation for employees.
(e) Whilst operating a heavy vehicle and accommodation provided is outside of the town perimeter or not within walking distance of basic food/entertainment outlets, cab charges will be supplied.

An employee shall be entitled to the provisions of this clause when employed on a job or construction work at such a distance from the employees’ usual place of residence that the employee cannot reasonably return to that place each night. When a given Project is considered a remote work site and in the best interests of both the employees and employer, the Hazell Bros. Group will offer and provide the following options where appropriate:
a) Arrange and pay for accommodation costs and employees will receive an allowance of $60 per person for each night stayed away. (Where approved and the cost is above $60 for incidentals the employee will be reimbursed the extra amount incurred).
b) Pay employees that choose to arrange their own accommodation and incidentals $100 per person for each night stayed away. Entitlement to the allowance will be recorded on the daily time sheets.

When a given project or job is considered a remote work site and in the best interests of both the employee and employer, Hazell Bros. Group will offer and provide the following options where appropriate, given the employee is required to stay away from home:
a) When an employee is engaged in distant work, the employer shall provide reasonable board and lodging, including 3 meals per day.
b) Arrange and pay for accommodation costs and the employee will receive an allowance of $60 for each night stayed away for meals and incidentals. (Where approved and the cost is above $60 for incidentals the employee will be reimbursed the extra amount incurred).
c) Pay an employee that chooses to arrange his/her own accommodation, meals and incidentals, with approval of management, $100 for each night stayed away. In the case of some current and new specific long term contracts the amount per night will be negotiated, agreed and set in advance with the employee for the term of the contract specific occasions that overnight stays are required. The amount will be from $60 to $100 per night as dictated by the commercial terms and business requirements of the contracts / or specific project (s). Entitlement to the allowance will be recorded on the daily time sheets.
Living Away From Home Distant Work. This subclause 31.5 does not apply to Apprentices in circumstances where subclause 17.6(h) applies.
