Personal and Educational Leave. A leave of absence may be granted upon written request for a period of up to six (6) months for personal reasons. Such reasons include, but are not limited to, non- disability maternity, paternity and child-rearing leave, adoption leave, and such other purposes as may be approved at the sole discretion of the Employer. Such leaves may be extended upon written request for a period of up to six (6) months. A leave of absence may be granted upon written request by an employee for the purpose of entering an educational program leading to a degree or certification. The leave may be granted for a period of up to two (2) years and may be extended upon request for an additional period of up to two (2) years. Such leaves of absence shall not be unreasonably requested by employees, nor shall they be unreasonably denied by the Agency.

Personal and Educational Leave. (i) Upon receipt of reasonable notice, leave of absence may be granted for good and sufficient reason, without pay, but with maintenance and accumulation of seniority and superannuation rights (and credits). (ii) The leave shall be granted for periods not to exceed the total accumulated seniority of the Employee, up to a maximum of one (1) year. (iii) In cases of leaves in excess of four (4) months, the Company will notify the Union as an information item. (iv) In no case will an Employee be granted a leave of absence for educational purposes if such Employee does not have at least one (1) year continuous service with the Company. (v) Employees on such leaves of absence shall not be restricted from bidding on vacant positions, however, upon appointment to the new position their leave of absence will be terminated. The Employee may apply for a new leave of absence from their new position. (vi) The position of an Employee granted a leave of absence in excess of four (4) months may be bulletined on a permanent basis and may not be available when the Employee returns. An Employee returning from such leave of absence must secure another position through the job bidding procedure, or may be considered for temporary employment within the Employee’s capability. An Employee who advises the Company, in writing, (including their current address and location where they would be willing to accept employment), that they are available for work but does not secure employment at the expiration of the leave of absence will be terminated but will maintain seniority, for the purposes of bidding only, until: (a) the Employee secures another position through the job bidding procedure; or, (b) for permanent full-time Employees, a vacant permanent full-time UNIFOR position is posted in the location specified by the Employee for which the Employee is qualified and there is no appointment from amongst the applicants, the Company offers the position to the Employee and the Employee declines; or, (c) for permanent part-time Employees, a vacant permanent part-time UNIFOR position is posted in the location specified by the Employee for which the Employee is qualified and there is no appointment from amongst the applicants, the Company offers the position to the Employee and the Employee declines; or, (d) a period of time, equal to the length of their seniority to a maximum of two (2) years, has elapsed. (e) The Employee is excluded from the provisions of Article 9.

(c) Where an employee is required by the Employer to attend a course or workshop, the Employer agrees to pay any applicable fee and the employee shall not suffer any loss of regular earnings from regularly scheduled hours as a result of attending the course.

  • Personal/Carer’s Leave 18.1 Entitlement to paid personal/carer’s leave a) Paid personal leave will be available to an Employee (other than casual Employees) when they are absent due to: (i) personal illness or injury (sick leave); or (ii) for the purposes of caring for an immediate family or household member who is sick and requires the Employee's care and support (carer's leave). b) The amount of personal leave to which an Employee is entitled is as follows: (i) Upon commencement of employment Employees will automatically be credited with 5 days Personal and/or Xxxxx’s leave. Such evidence may be a medical practitioner’s certificate, or a statutory declaration. An Employee will not be required to provide such evidence for single days of absence but only where two or more consecutive days of absence are taken. f) If an Employee’s employment is terminated by the Company and is re-engaged within a period of six months, then the Employee's unclaimed balance of sick leave shall continue from the date of re-engagement. In such case the Employee's next year of service will commence after a total of twelve months has been served with that Company excluding the period of interruption in service from the date of commencement of the previous period of employment or the anniversary of the commencement of the previous period of employment, as the case may be. g) Unpaid carer’s leave will be in accordance with the NES. 18.2 Immediate family or household a) The entitlement to use personal leave for the purpose of carer's or compassionate leave is subject to the person being either: (i) a member of the Employee's immediate family; or (ii) a member of the Employees' household. b) The term immediate family includes: (i) a spouse, de facto partner, child, parent, grandparent, grandchild or sibling of the Employee; or (ii) a child, parent, grandparent, grandchild or sibling of a spouse or de facto partner of the Employee.

  • Unpaid Personal Leave Where an employee has exhausted all paid personal leave entitlements, they are entitled to take unpaid personal leave to care for members of their immediate family or household who are sick and require care and support or who require care due to an unexpected emergency.
