Personal Necessity Leave of Absence. Full-time faculty may use not more than six (6) days of accumulated sick leave in any academic year in the following cases of personal emergency: A. Death of a member of his/her immediate family. Immediate family includes spouse, mother, father, grandfather, grandmother, son, daughter, son-in-law, daughter-in-law, grandson, granddaughter, brother, sister, or a person who has resided in the household of the employee for two or more years. This is in addition to Article 35, Bereavement Leave. B. Accident involving his/her person or property or the person or property of his/her immediate family. C. Appearance of a full-time faculty member in court as a litigant; other than a defendant in a job-related case. D. Serious or critical illness of a member of the immediate family. E. Other personal emergencies as reported to the Area Administrator. Notification for personal necessity leave shall be made to the Area Administrator in advance when appropriate. (Appendix J-2)

Personal Necessity Leave of Absence. Employees are permitted to use up to seven (7) days of sick leave during any school year for the following specified personal necessities: 11.4.1 Serious accident involving his/her person or property, or the person or property of a family member living in his/her household, if the immediate presence of the employee is required during his/her work day. 11.4.2 Appearance in court as a litigant, or a witness under official order (advance permission is required). 11.4.3 Serious or critical illness of a member of the immediate family, as defined in Part 11.3, of such an emergency nature that the immediate presence of the employee is required during his/her work day. 11.4.4 To attend the funeral of a niece, nephew, aunt, uncle or cousin. 11.4.5 One day of paternity leave for fathers is permitted under this section. Day to be taken within one week of the child’s birth (advance permission is required). 11.4.6 Other serious personal emergencies which cannot be resolved on a non-working day, if approved by the Superintendent or his designee (advance permission is required). 11.4.7 Response to an official order from another governmental jurisdiction with power to subpoena for reasons not brought about through the connivance or misconduct of the employee of such emergency nature that the presence of the employee is required during his/her regular working hours and no alternative meeting time during non-duty hours can be arranged (advance permission is required). 11.4.8 To be used to extend bereavement leave granted under Article 11.3.
Personal Necessity Leave of Absence. Unit members may use up to ten (10) days accumulated sick leave without stating a reason for personal necessity, provided the number of personal necessity days does not exceed the number of days of unused sick leave. Permissible personal necessity use: 8.11.1 Personal necessity may be used without prior approval for the reasons listed below. However, the unit member shall make every reasonable effort to comply with District procedures designed to secure substitutes and s/he shall notify the immediate supervisor prior to the absence. 8.11.1.1 Accident or serious illness involving his/her personal property, or person or property of his/ her immediate family. 8.11.1.2 Court appearance as a litigant or as a witness under order.
Personal Necessity Leave of Absence. 12.9.1 Personal necessity leave of absence is best defined as a day or days of personal leave, which the unit member can elect to have charged against his/her accrued sick leave (maximum, 10 days per school year). All leaves of absence must be approved by the Board, or as designated, the superintendent. In addition to the 10 days cited above, a unit member may use additional accrued sick leave for personal necessity reasons in extraordinary circumstances with the prior approval of the Board, or as designated, the superintendent. 12.9.2 Advance permission is not necessarily pursuant to the following guidelines: When advance permission is not required (Ed. Code 44981): a. Death or serious illness of a member of the unit member’s immediate family. b. Accident, involving the unit member’s person or property, or the person or property of a member of his immediate family. c. For purposes of this subdivision only, members of the immediate family means the mother, father, child, spouse, any relative living in the immediate household of the unit member, domestic partner, xxxxxx children, or anyone for whom the unit member holds guardianship. No advanced permission needed under the above stated conditions. d. The employee must contact his/her supervisor in advance of leave to notify supervisor to arrange for his/her replacement (as in all leaves of absence). e. The superintendent will handle proof of personal necessity under this clause administratively. The signing of the district’s leave of absence statement describing reasons for the absence will be required. f. The superintendent may require additional statements of proof of personal necessity at his/her discretion. g. The District will credit days of allowable bereavement leave (Policy 4161.2, Ed. Code 44985) prior to charging days to personal necessity leave when bereavement is applicable. h. Personal necessity leave may be used if the employee gives advance notice for the following purpose: appearance in any court or before any administrative tribunal as a litigant, party, or witness under subpoena or any order made with jurisdiction. 12.9.3 The superintendent or designee will approve / disapprove personal necessity requests, and such decisions will not be arbitrary or unreasonable. 12.9.4 Five (5) days of personal necessity will be allowed at the declaration of the employee for any reason.   • Personal Necessity Leave Leave which is credited under sick leave in this Agreement may be used, at the unit member’s election for purpose of personal necessity, provided that use of such personal necessity leave does not exceed eight (8) days in any school year. Other significant circumstances which are not school or school district related, that the employee feels need immediate attention. 14.17.2 Before the utilization of personal necessity leave, a unit member must provide prior notice to the appropriate supervisor, except in cases of A, B, and D. Should the circumstances outlined in A, B, D arise, the employee shall make every effort to comply with the District procedures to enable the District to obtain a substitute. 14.17.3 P.N. under “E” shall not be used on Friday or Monday unless previously approved by their immediate supervisor. 14.17.4 Leave shall not be available for the following: Withholding services to the District Shopping Seeking other employment Recreation Extending vacation or holidays Donating Service Attendance at non-professional meetings

  • Parental Leave of Absence A. Female unit members may use any or all accumulated leave during pre and post-natal care for that period of time she is temporarily disabled, as determined by the unit member and her physician. B. Unit members desiring to use any or all accumulated leave during a period of pregnancy or post-natal care should state this in writing to the Office of Human Resources and Employee Relations using the FMLA paperwork. C. Unit members who use any or all accumulated leave as a temporary disability during pre- and post- natal care must return to active service as soon as her physical health permits according to her physician; unless she requests a leave of absence without pay or she resigns. D. Any non-probationary female unit member who does not wish to use any or all accumulated [sick] leave during pre- and/or post-natal care shall be granted a leave of absence without pay provided that a reasonable notice in writing to the Office of Human Resources and Employee Relations is made in advance. E. Unit members using a leave of absence without pay for pre-natal care, adoption, post-natal care and/or child rearing (not to exceed a period of one (1) year in duration and taken within the first year after birth or adoption) shall have the opportunity to continue benefit programs provided to unit members. Unit members with at least one (1) year of experience with the Xxxxxxx County Board of Education will be required after the first twelve (12) weeks to assume the Board’s share of the premium in addition to any premiums he/she theretofore paid for dependent coverage. Provided that a written, advanced request is made to the Office of Human Resources and Employee Relations the employee on such leave will be offered employment upon expiration of the leave in the first available position in their classification for which they are qualified. The request should be made at least thirty (30) days prior to the return and should include the anticipated date of return. If the return is within ninety (90) duty days and such return is stipulated at the beginning of the leave, the same position shall be offered. F. Adoptive parents may use up to twelve (12) weeks in compliance with Family Medical Leave Act (FMLA) of any or all accumulated leave for the purpose of adoption and/or bonding. G. If using combined sick leave and leave without pay teachers who have at least one (1) year experience with the Xxxxxxx County Board of Education will have premiums paid for a total of twelve (12) weeks per year in accordance with the terms of the FMLA, and have their position held prior to such leave.

  • Union Leave of Absence An employee on an unpaid Union leave of absence shall have her wages, benefits and seniority continued by the Employer, and the Union agrees to reimburse the Employer for the costs of such wages and benefits. Employees requesting leave under this article will provide the Employer with as much advance notice as possible of the dates of the leave. Where there are less than fifteen (15) regular employees at a workstation at the time the leave request is submitted, and subject to operational requirements, unpaid Union leave of absence will be granted to one employee for the purpose of conducting Union business. D) selected by the Union or its members as a delegate to attend the Provincial Bargaining Conference. E) selected by the Union or its members as a delegate to attend regional Bargaining Conference.

  • LEAVE OF ABSENCE 12.01 Employees requesting leave of absence shall make written application to their Location Manager giving at least seven (7) working days· notice. The Company may, at its discretion, grant such leave of absence for a period of up to three (3) months provided the services of the employees are not immediately required and there is an employee available who has the qualifications to perform the work. Such leave of absence shall be granted in writing, with a copy to the Local Chairperson. Leaves of absence will not be granted during the month of September. In the case of an employee being granted an extended approved unpaid leave 6f absence, the employee may not be permitted to sign for a regular school run and/or the run vacated by the employee may be posted. 12.04 Absolute proof of illness preventing return upon expiration of leave of absence shall excuse an employee's failure to return at that time. 12.05 Leave of absence shall not be granted to enable an employee to work outside the Company's service. Leave of absences or illness longer than five (5) working days will be posted as a temporary position. 12.06 An employee elected as a full-time representative of the Union shall be granted leave of absence without pay while so engaged. 12.07 Upon written request of the National Representative, Local President and/or Local Chairperson, employees delegated and attending general business of the Union shall be granted leave of absence without pay for that purpose. As much advance notice as possible will be given by the National Representative and/or Local Chairperson prior to the effective date of the requested leave of absence. The Company will pay lost time for regular scheduled work for all union leaves under this article to employees at their regular rate of pay and such rate of pay will be reimbursed by Unifor Local 195. 12.08 The name of an employee who is on authorized leave of absence shall be retained on the seniority list and shall continue to accumulate seniority. School bus drivers on an approved leave shall be returned to their scheduled work on the scheduled return date. 12.09 An employee wishing to return from leave of absence prior to the expiration of his approved period of leave must advise his Supervisor at least seven (7) days in advance of the date upon which he wishes to return to work. The Supervisor will, if such leave is due to illness, make every effort to change the work schedule to accommodate the returning employee, but if this is not possible, the employee shall return at the earliest possible date following the receipt of such notification by the Supervisor. If the leave were for other reasons, the employee will resume his duties at a time specified by the Company.

  • ARTICLE LEAVE OF ABSENCE The Employer, may, in its discretion, grant a leave of absence with or without pay to any employee for education personal reasons. Request for leave of absence shall be in writing and submitted to his supervisor who will forward the same to the designated Human Resources representative for approval. An employeeshall not be required to use his accumulated vacation before requesting a leave of absence for non-vacation purposes. The Employer shall grant leaves of absence without pay to up to four (4) employees to attend Union conventions or seminars, provided that: such leave does not unduly interfere with the operation requirements of the Employer; the total leave of absence granted hereunder shall not exceed twenty-five working days per year of the agreement; not more than one (1) employee from any program unit may receive leave hereunder at any one time and; the Union gives fourteen (14) clear notice of such leave to the Employer. Leave of absence due to pregnancy and/or parental leave shall be granted in accordance with the requirements of the Standards Act of Ontario If an employee who has completed his probationary period is required to serve as a juror, he shall not lose his regular pay because of such attendance provided he notifies his supervisor immediately upon notification that he will be required to serve as a juror, presents proof of service and promptly pays to the Employer any amounts paid to him for such service. Employees absent from work for any continuous period of fifteen (15) calendar days or more other than a period of vacation leave or paid sick leave shall not earn vacation or sick leave credits during the period of any such absence and anniversary dates shall be adjusted accordingly except as specified in Article In addition, the Employer shall not be required to contribute to the payment of health and welfare benefits during any such absence. Employees who desire to maintain health and welfare benefits through the Employer must arrange payments of premiums for all such benefits and pay all such premiums through the Employer before commencing any absence. Notwithstanding the preceding paragraph, it is agreed that the Employer shall maintain health and welfare benefits for employees who are off work on Long Term Disability or Workplace Safety and Insurance Board Benefits for a period of up to one (1) year from the date such employee ceased working for the Employer provided the employee pays his portion of the health and welfare benefits premium. An employee shall be entitled to paternity leave which shall consist of one (1)day with pay and two (2) days without pay.
