RIGHTS OF THE TEACHER. A. The Board recognizes its responsibility to continue to give reasonable support and assistance to all teachers with respect to the maintenance of control and discipline in the classroom.
B. The Board shall provide special education programs as mandated by Department of Education guidelines.
C. Any assault by a child upon a teacher shall be promptly reported to his immediate supervisor. In the event of such an assault, or if a teacher is complained against or threatened with civil action by reason of disciplinary action taken against a student, which is not inconsistent with the provisions of section D below, the teacher involved may, through the Association, request assistance from the Board in such matter, and the Board shall provide such legal counsel. If it is ultimately determined that the teacher is found innocent, or has acted appropriately, or a mutual settlement has been agreed upon; the Board shall pay the legal fees for the teacher which are not otherwise covered.
D. The Association agrees that all teachers shall observe rules respecting punishment of students as established by the Board or required by state law.

B. The Board will provide protection under a liability policy to teachers when they are authorized in writing to drive their own autos to transport students. The policy will supplement the present insurance of the teacher for property damage up to Twenty-five Thousand Dollars ($25,000) per accident and for bodily injury liability up to Three Hundred Thousand ($300,000) per accident, subject to normal exclusions.
C. Each teacher is free to join and participate in the activities of the teacher's organization of his choice.
D. Teachers shall not be required to sell tickets or take tickets at any school- sponsored event.
E. Sponsorship of clubs, organizations, and all other activities shall be voluntary.
F. No teacher shall be disciplined or reprimanded without just cause. Any such discipline or reprimand shall be subject to the professional grievance procedure as stated in Article III of this Agreement. Adverse evaluation of teacher performance asserted by the Board or representative thereof shall also be subject to professional grievance procedure as stated in Article III of this Agreement. In the case of "failure to re-employ", probationary teachers may only grieve as to whether or not the evaluation procedure set forth in this Agreement was followed, notwithstanding any other provision of this Contract.
G. No teacher shall be disciplined or reprimanded in the presence of students or other teachers.
H. A teacher shall have the right to review the contents of his/her personnel file. The teacher may have a representative of the Association accompany him/her at such review. Nothing contained in a teacher's file may be used in an adverse manner against such teacher without the teacher's knowledge. Copies of reprimands placed in the teacher's file shall be given to the teacher.
I. The assignment of mentoring non-tenured teachers shall be voluntary.
RIGHTS OF THE TEACHER. A. Pay Procedures
1. Teachers shall have their contractual salaries divided by twenty-six (26) to determine the gross biweekly amount to be paid each pay period. Regular salary payments will be issued biweekly via direct deposit in accordance with the payroll schedule and the direct deposit guidelines of the employee’s selected financial institution receiving such deposit. A pay stub reflecting the deposit will be issued to the employee via E-voucher (online pay stub) concurrently with the transfer of the direct deposit payment.
2. The Board will make all deductions required by law and upon receipt of proper authorization, other deductions for Association dues or representative fees, credit union, United Fund, additional health and life insurance premiums, tax deferred annuities, and Detroit City Income Tax. Deductions for healthcare and other voluntary options will be taken over a minimum of twenty-two (22) pays.
B. Teacher Personnel File
1. Official teacher personnel files shall be maintained in the administrative offices of the District. The personnel file of each teacher shall contain copies of all evaluation reports and recommendations.
2. A teacher shall have the right, upon request, to review the contents of his/her personnel file, with the exception of pre-employment evaluations, confidential placement records and references, and reports from other than the South Redford Schools. A representative of the Association may, at said teacher's request, accompany the teacher in the review of said file.
C. Board Support of Teachers in the Performance of Duties
1. The Board recognizes its responsibility to continue to give reasonable support and assistance to all teachers with respect to the maintenance of control and discipline in the classroom.
2. Any case of assault upon a teacher shall be promptly reported to the Board. The Board will provide legal counsel, if necessary, to advise the teacher of his rights and obligations with respect to such assault. The Board shall promptly render all reasonable assistance to the teacher in connection with the handling of the incident by law enforcement and judicial authorities, providing the teacher signs a complaint against the person involved.
D. No teacher will be required to administer any first aid or medication prescribed for a student.
E. No teacher shall be required to transport any child for any reason.

RIGHTS OF THE TEACHER. A. Any teacher shall have the right to present grievances and have them adjusted, without the intervention of the Association, as long as the adjustment is not inconsistent with the terms of this Agreement. An Association representative shall have the opportunity to be present at all formal levels of the procedure.
B. Subject to the provisions contained herein, the Board will cooperate with the Association in its investigation of any grievance by complying with the Association's reasonable request for information relative to the grievance.
C. Any teacher may withdraw a grievance at any point by submitting in writing statement to that effect, or by permitting the time requirements at any step to lapse without further appeal.

G. A teacher shall have the right to review the contents of his/her personnel file. The teacher may have a representative of the Association accompany him/her at such review. Nothing contained in a teacher's file may be used in an adverse manner against such teacher without the teacher's knowledge. Copies of reprimands placed in the teacher's file shall be given to the teacher. All copies shall be signed by the teacher and the administrator before being placed into said file. A teacher’s signature indicates knowledge of reprimand and does not constitute agreement of said reprimand.

B. Any case of assault upon a teacher shall be promptly reported to the Board through the teacher's immediate supervisor. In the event of unprovoked assault, or if the teacher is complained against or threatened with court action by reason of disciplinary action taken against a student or any other school related behavior, the Board will provide legal counsel to advise the teacher of his/her rights and obligations with respect to such assault or court action and shall promptly render all reasonable assistance to the teacher in connection with the handling of the incident by law enforcement and judicial authorities to the limits of the school District's liability insurance; provided that:
1. the teacher acted within the scope of Board policy, and
2. that the actions were reasonable and prudent as determined by the Board. The Board's determination shall include a full investigation of the assault and all conditions surrounding it.
C. The Association agrees that all teachers shall observe rules respecting punishment of students as established by the Board or required by law.
D. Teachers shall be required to exercise reasonable care with respect to the safety of pupils and their property.
E. Any complaint directed toward a teacher shall be called to the teacher's attention and prior to any disciplinary action being taken by the Administration. If a complaint is raised against a teacher or teachers at a Board meeting, that complaint will be received and taken under advisement. The teacher or teachers involved will be notified of such complaint before any action is taken.
F. A pre-determined certified person will assume administrative duties of each building during absence of the building principal and the teachers shall be notified of who shall assume those duties.
