Selection of Shifts. (a) It is the intent of the parties that employees are allowed to remain on preferential shifts based on the employee's seniority, subject to employees’ qualifications and the needs of the Company. A regular employee shall have the qualified right under Section 8.1 (a) to select shifts under the following conditions: 1. When relative seniority in job titles is affected; 2. When the Company adds, deletes or changes a shift (work hours/days). i. Shift schedules shall be posted 10 calendar days prior to the date for which said schedule is to be in effect. 3. All other employees shall select shifts when they become vacant or by request by an employee in the affected work group, but not more than once in a twelve (12) week period. 4. Holidays that fall within the shift schedules will be posted for bid under the guidelines of Article 12.5. In the event shifts are not filled by selection, the junior qualified employee shall be assigned to the vacant shift, to the extent consistent with the needs of the business.

Where qualifications are substantially the same, seniority will be the determining factor, except in situations covered by Article 8.

Selection of Shifts. Permanent shifts will be filled on the basis of requests accordingto classification seniority as defined in Article 16 and such shifts will be maintained until the next annual shift selection unless mutually agreed to by affected members and the City. A shift signup sheet shall be posted no later than November 1 by the Chief of Police. Each employee shall have four (4) days to post their selection. Employees who do not post their selection within the four (4) days will be placed at the bottom of the seniority list for this selection only. Nothing contained herein shall be construed as preventing the Chief from restructuring or changing the work schedules of an employee for good cause. If an employee objects to a change, he/she may appeal the decision to the Director of Public Safety (or designee). The City shall always havethe right to change work schedules in emergency situations. Employees may trade their work or shift hours only upon written approval of the Chief or designee. The Chief of Police, for training purposes, shall have the authority to assign newly hired officers to a shift for a maximum of one year.

Employees not eligible to participate in the sign - up under this provision will be placed on the Relief Board. When such employee is medically cleared to return to work to the pre - disability position, the employee will be assigned Relief Board duties until the next major sign - up. 6.02.05 Prior to their scheduled signing time, Operators can indicate their choice of shift in writing to the supervising Union official, using the prescribed form. The Union official shall make the Operator’s selection, as indicated on the form. 6.02.06 Operators who are not present at their signing time and who have not completed a choice form, shall have their selection made for them by the Union official. Such Operator shall be bound by the decision of the Union official for the duration of the shift schedule period.

Selection of Shifts. There shall be at least three (3) sign ups per year for shifts and days off. The sign ups shall go into effect January, May, and September. All bids shall be posted for ten (10) consecutive days prior to the effective date of the implementation date. No sign up shall be less than sixty (60) consecutive days in duration. The method of bidding shifts and days off is to be established by mutual agreement of the parties. The Union Representative shall have the opportunity to review and negotiate these schedules with the department head or designee seven (7) days prior to posting. Maintenance employees shall select their work schedules and shifts in accordance with their ATU Maintenance Seniority. If an employee doesn’t bid, or refuses to bid, the shop xxxxxxx shall bid for such employee an assignment as close as possible to that presently being held. After the bid sheets are agreed to, they shall not be changed without mutual consent between the Union and SunLine. Shop xxxxxxx shall work the day shift with Saturday and Sunday off. Bid sheets will be sent to the Union following completion of each bid. New mechanics will be placed within any shift during the first 90 days. If a bid occurs prior to the new hire completing the 90 days probation, he/she will continue to be assigned a shift. XxxXxxx agrees not to change the number of slots per shift due to the new hire. New Maintenance Supervisors will be placed on rotating shifts during the first six (6) months. If a bid occurs prior to the new hire completing the six (6) month probation, he/she will continue to be assigned rotating shifts. XxxXxxx agrees not to change the number of slots per shift due to the new hire. In the event an employee returns to work in the same bid period during which he/she left, he/she will be placed on the same shift with the same days off as held at the time he/she left. In the event an employee returns to work after a subsequent bid period has been held, such employee will be allowed to bid into the same location with the shift and days off equal to that which the employee’s ATU seniority would have permitted had the employee been present to bid at such subsequent bid period. There shall be no adjustments in shift start times due to Daylight Savings Time.
Selection of Shifts a) The University accepts the principle of seniority in the selection of patrol shifts including focus areas and projected day off patterns by employees covered by this Collective Agreement. Complying with Article III, Section 4 hereof, so long as operations under this principle are satisfactory, the University will continue to permit the selection of patrol shifts including focus areas and projected day off patterns on the basis of seniority. The University retains the right to set and alter projected day off patterns as needed operationally. Police personnel covered by this Agreement may be assigned to any shift at any time during their probationary period of employment. b) Employee initiated requests for change of shift may only be made after completing six (6) months on an assigned shift. c) After assignment to a patrol shift (referred to above) employees will normally not be moved from one shift or area to another as a disciplinary measure unless in the University's judgment it is necessary to do so. An explanation will be given to the Union if requested. d) The Chief of Police shall have the authority in his/her discretion to move from shift to shift, the three (3) least senior Officers on any shift if a change of manpower is required in order to provide for the orderly functioning of the division. e) The University agrees that shift sign-ups, including focus areas and projected day off patterns, are to be completed so that at least thirty (30) calendar days’ notice can be given to officers relative to the establishment of any new shift assignments. f) Employees shall be allowed to trade duty shifts by completing a duty shift trade notification form which shall be submitted to the respective shift supervisor prior to the start of the affected employee's shift, as long as the following conditions are met: 1. The duty shift trade occurs within same pay period; 2. Prior supervisory approval from any and all affected shifts must be obtained; 3. The duty shift trades cannot result in overtime to the University; and 4. Payroll and time records have to accurately report who has worked and when.

Seniority shall also include the length of continuous employment in a higher class within the Probation Department.
