Special Duty Pay. (A) High Work Differential. When an employee is required to perform work more than twenty (20) feet directly above the ground or water and use of safety ropes, scaffolds, boatswain chairs or other similar safety devices are required for support, the employee shall receive a high work differential. Rate: One dollar and fifty cents ($1.50) per hour. (B) Application: C6222, C6224 (Staff Nurse, Registered Nurse 1). Staff Nurses and Registered Nurses who are assigned and are performing charge duties will receive an additional five percent (5%) per hour worked in the performance of such assigned charge duties. When this special duty pay condition occurs on a holiday worked or in an overtime period worked, this additional special duty premium pay shall be paid at the rate of time and one-half (1-1/2). (C) Application: C6135 (Licensed Practical Nurse). Eligibility: Charge differential shall be defined as a temporary hourly differential for a Licensed Practical Nurse who has been assigned charge duties by the Employer.

Special Duty Pay. A. Incumbents in Unit 12 classifications currently eligible to receive Diving Pay shall continue to receive such a differential at the rate of ten dollars ($10.00) per diving hour.

An employee in Pay Range 831 or in Pay Range 836 shall receive an amount equal to one (1) percent of his/her base salary in lieu of any other compensation for time spent underfilling authorized positions at the direction of the employee's commanding officer. This additional amount shall be termed "Special Duty Pay." 2. Special Duty payments made under the provisions of this Article shall be construed as part of the employee's base pay solely for the purpose of computing pension benefits or payments. Special Duty Pay shall not be included in the determination of any other benefits or compensation provided by the City.

Special Duty Pay. Special Duty shall be defined as any time off-duty personnel are being compensated to cover public events (i.e. football games, festivals, public gatherings, public relation engagements) as required by a government agency or at the request of the event organizer, for additional fire and/or EMS coverage or appearances that cannot be handled by the on-duty personnel at the time of the event. This time worked shall be compensated in accordance with the overtime section of this Article.
Special Duty Pay. Special duties shall mean and include Police duties authorized by the Chief of Police and performed for any party or organization other than the Police Service. All such special duties shall be paid for at the rate of one and one-half times (1.5x) the regular salary. Regulations as to the assignment of such duties shall be in writing to be agreed upon between the Chief of Police and the Association as to the distribution of such assignments.

Whenever the Fair Labor Standards Act (FLSA) requires the City to compensate Special Duty Pay work performed by an employee at a rate of time and one-half (1½x) his/her base salary rate, the City shall comply with this requirement and compensate such work at a rate of time and one-half (1½x) computed on the basis of the employee's hourly rate of pay for the average work week in effect as established under the HOURS OF WORK Article of this Agreement. Resolution of disputes involving application, interpretation or enforcement of Fair Labor Standards Act provisions applicable to employees covered by this Agreement shall be solely and exclusively reserved to the U.S. Department of Labor and the courts designated by the FLSA for review thereof. Employees in the Paramedic Field Lieutenant, Fire Paramedic Field Lieutenant, Paramedic Lieutenant, Fire Lieutenant and Fire Captain job classifications shall be treated identically as employees in the Firefighter job classification for purposes of determining their eligibility to receive Special Duty Pay compensation at a rate of time and one-half (1½X) whenever the FLSA requires that rate for employees in the Firefighter classification. The City agrees to abide by FLSA overtime premium compensation requirements for employees in these supervisory classifications on a voluntary basis, notwithstanding the fact that such employees may otherwise be exempt from such requirements. 3. Except as provided in subsection 4, below, Special Duty Pay assignments shall be made by the Fire Chief, or his designee(s), on a voluntary basis. 4. Whenever the Fire Chief determines that the safety and welfare of the City is in jeopardy because of insufficient numbers of volunteers for Special Duty Pay work, employees shall be required to work Special Duty Pay assignments when so ordered by the Chief in a manner prescribed by the Chief. 5. Any payment made under the provisions of this Article shall not have any sum deducted for pension benefits nor shall such payments be included in the determination of pension benefits or other fringe benefits. 6.
