Staff Reduction Procedure. The Employer for any reason may determine that it is necessary to reduce the number of employees. In the event it becomes necessary to lay off employees within a particular job classification, the reduction shall be based upon the needs of the school system as determined by the Employer and the relative skill, ability, and competence of the employees for which employment cannot be provided. Whenever lay off occurs, if the skill, ability, and competence of the employees within the affected job classifications are considered equal, the employees for which employment cannot be provided shall be laid off in the inverse order of their seniority. No new employees shall be hired until all employees on lay off who are qualified and desire to return to work have been recalled. The affected employees and the Union shall be notified at least fourteen (14) days prior to the effective day of such lay off. An employee scheduled for lay off shall have the right to replace an employee with less seniority and lesser qualifications in his/her department. When a specific opening or openings occur within one year of the lay off and more than one employee applies for the position, the recall shall be based upon the needs of the school system as determined by the Employer and the skill, ability, and competence of the employees. If the skill, ability, and competence of the employees are equal, then the employee with the greatest previous seniority within the department shall be recalled, provided that he/she meets the qualifications necessary for that opening. An employee, who fails to return to work at the job classification laid off from within five working days after being notified by certified mail to the employee’s last known address on file in the office of the Coordinator of Child Care Services, shall lose his/her status as an employee.

In order to promote an orderly reduction of personnel when the education program, curriculum, or staff is curtailed, the following procedures shall be followed. 10.1.1 The Board will communicate to the recognized negotiating body president its intention to implement the staff reduction procedure. After the above factors have been considered, if the employees are apparently equal in the judgment of the board then the employee having continuing contract status will be given preference. 10.1.3 In making staff reductions involving professional staff members on continuing contract status, the board will follow the procedure outlined in state statutes. 10.1.4 Any certified staff whose employment with the district has been affected by a reduction shall be classified as on lay- off status from active employment by the district and can be recalled to active employment for 15 months. The 15 month time frame shall begin the date the certified staff member receives the formal notice by the Board of the staff reduction resulting in the employee not being offered a teaching contract for the following year. Certified staff shall be recalled to available positions for which they are certified and qualified. Staff Reduction Procedure. If, after considering other alternatives the Employer implements a reduction in force, reductions will occur in the following order: (a) Agency employees (b) Volunteers among an affected classification; (c) Temporary (non-agency) employees; (d) Regular part-time employees; (e) Regular full-time employees. Reductions will be conducted by job classification within the affected department. Departments are listed in Article 8, Seniority and Job Vacancies. Within each job classification, reductions will occur by seniority as defined in Article 8, Seniority and Job Vacancies, provided that the employees that remain must possess the required qualification(s) and skill(s) to perform the work. STAFF REDUCTION When, in the sole, exclusive and final judgment of the Board, upon recommendation by the administration, a reduction in staff is required, the administration shall attempt to accomplish same by attrition if said attrition occurs before April 30.
