Voluntary Layoffs. Leave of Absence or Reduction in Hours
Voluntary Layoffs. Prior to implementing any involuntary reduction in force, the deans shall contact all regular faculty members, urging those faculty members to notify the deans within a specified time if they are willing to retire early or to accept leave without pay of a specific duration. The deans will also contact all faculty members who have adjunct or post-retirement contracts, urging those faculty members to notify the deans within a specified time if they are willing to terminate any portions of contracts which extend beyond the current quarter.
Voluntary Layoffs. When the Employer elects to reduce the work force through a layoff, employees within the affected classifications and layoff unit may request, in writing, preferential layoff out of line seniority. The Employer shall approve such request(s) for voluntary layoffs (by seniority) and shall not contest the employee's eligibility for unemployment compensation. Nothing in this Section shall be construed to constitute a waiver of such employee's recall rights. The fifteen (15) calendar day notice requirement in Section A. above shall be waived for employees requesting preferential layoff. Such employees shall not accrue seniority while on layoff.
Voluntary Layoffs. When the Employer elects to reduce the work force, unit employees within the affected classifications and layoff unit may request, in writing, preferential and layoff out of line seniority. Such voluntary layoff shall be for at least ninety (90) days. After this period, the laid-off unit employee's name shall be placed on recall lists in accordance with the provisions of this Article.
Voluntary Layoffs. The parties agree to allow voluntary layoffs in those situations where a teacher is willing to accept a layoff rather than exercising his/her seniority rights to a position. All voluntary layoffs shall be in accordance with the following:
1. The voluntary layoff shall be treated as if it was an involuntary layoff and the teacher shall be subject to recall pursuant to the provisions of this Article.
2. The voluntary layoff must be agreeable to the Board and the individual teacher.
3. The Board will make no claim that these voluntary layoffs are leaves of absence or that the teacher is not eligible for unemployment benefits as a result of accepting.
Voluntary Layoffs. The parties agree to allow voluntary layoffs in those situations where an ancillary staff member is willing to accept a layoff rather than exercising his/her seniority rights to a position. All voluntary layoffs shall be in accordance with the following:
1. The voluntary layoff shall be treated as if it was an involuntary layoff and the ancillary staff member shall be subject to recall pursuant to the provisions of this Article.
2. The voluntary layoff must be agreeable to the Board and the individual ancillary staff member.
3. The Board will make no claim that these voluntary layoffs are leaves of absence or that the ancillary staff member is not eligible for unemployment benefits as a result of accepting voluntary layoff.
Voluntary Layoffs. To accommodate those senior employees who may wish to take a layoff (layoff out of the line of seniority) when a layoff situation becomes evident, the following will occur.
i. Any member interested in taking a voluntary layoff will advise the Manager/Supervisor and the Local Union at that time. A voluntary layoff may be granted with the mutual agreement of the Company, the member and the Local Union.
ii. Any member wishing to take a voluntary layoff will be granted the opportunity as reductions occur subject to the remaining members being qualified to perform the normal requirements of the currently available work - the most senior members receiving first consideration.
iii. Recalls will be conducted per Article 24.7, seniority being the governing factor and the most senior member being recalled first.
iv. A voluntary layoff will not exceed 12 weeks. At the end of the 12 week period, members on voluntary layoff will return to work, even if staff reductions are still necessary.
Voluntary Layoffs. The Company and the Union agree that, any provision in the parties’ Collective Bargaining Agreements to the contrary notwithstanding, an employee may request that he or she be voluntarily laid off. If the request is approved by management, the employee will be coded as a layoff and will be regarded for all Company purposes as a laid-off employee. The Union will be advised of all employees approved for voluntary layoff.
Voluntary Layoffs. In the event of a mandatory layoff authorized by the Board of Supervisors and announced by the Human Resources Director, a more senior, permanent employee with more seniority may elect layoff to the extent of displacing a more junior employee with less seniority. Such senior employee must be in permanent status and employed in the department that is conducting the layoff. Upon announcement, the HR Director will provide to DSA, a seniority list and approximate number of employees in each classification that will be affected by the layoff. Employee requests must be made by fully filling out and signing the County layoff form and by submitting this form to the department head or the department head designee. The department head and the HR Director have final approval authority on a case by case basis, without regard to seniority or outcome for persons in the same classification. Upon the request being accepted the employee may not withdraw the request and must proceed to be laid off. The employee who volunteers shall not have bumping or seniority rights in regard to the voluntary layoff being conducted. Upon layoff the employee is subject to all rights and procedures as are applied to employees who are laid off from County service. Seniority will remain intact in regard to all purposes including restoration. When an Official announcement regarding layoff is made by the HR Director all employees in the department conducting the layoff shall be notified in writing and allowed one (1) week to submit the County layoff form.
Voluntary Layoffs. An employee may request a voluntary layoff.
