Whenever circumstances require, and with the approval of the City Manager, sick leave may be taken in advance of accrual up to a maximum determined by the City Manager, provided that any employee separated from the service who has been granted sick leave that is un-accrued at the time of such separation shall reimburse the City of all salary paid in connection with such un-accrued leave.

b) employees with more than ten (10) years and less than twenty (20) years continuous service - up to forty-five (45) working days;

Advance of Sick Leave. A. Upon written request to the Superintendent, the Superintendent shall advance sick leave credit, not to exceed five (5) days, to employees who have not yet earned such leave or who have exhausted their accumulated sick leave.
B. If utilization of sick leave requires the employee to use the full amount of credit before the advanced sick leave credit has been earned, such employee may not be lawfully advanced additional sick leave credit. The five-day advance is to be deducted from the future accumulation of sick leave credit the employee earns on the basis of completed months of service under provisions of Ohio Revised Code 3319.141.
C. Should such employee terminate employment, the amount of advancement not yet earned shall be deducted from the final pay settlement.
D. Nothing herein shall be considered to create an expectation that unpaid leave will be granted to any bargaining unit member who has exhausted all such leave nor is the Board in any way limited from taking appropriate disciplinary action for any unauthorized absence without approved leave.
Advance of Sick Leave. A bargaining unit member shall be advanced five (5) days of sick leave each year, as provided for in ORC Sections 3319.08, 3319.141 and/or related statutory provisions, if accumulated leave is exhausted. A bargaining unit member shall be granted added advancement only after indebtedness of the previous advancement has been repaid. Any advance shall be deducted from future accumulations and/or deducted from the employee’s final check if the employee is no longer employed with the Board and has not accumulated enough for repayment of said advancement(s). Nothing herein shall be considered to create an expectation that unpaid leave will be granted to any bargaining unit member who has exhausted all sick leave and advancements nor is the Board in any way limited from docking any such employee’s pay and/or in taking appropriate disciplinary action for any unauthorized absence without approved leave.
Advance of Sick Leave. A maximum of five (5) days of sick leave which has not yet actually been earned shall be advanced to all new regular employees and all old employees who have exhausted all the sick leave they have earned. Advance of Sick Leave. Upon written request, a maximum of five (5) days of sick leave shall be advanced per contract year by the Superintendent if an employee has no sick leave available for use consistent with the terms of this article. An additional five (5) days of sick leave may be advanced per contract year by the Superintendent for sick leave needed due to a catastrophic illness or injury as referenced in Section H of this Article. Advancements of sick leave outstanding at the time the member leaves Board employment will be repaid from the member's final pay.
Advance of Sick Leave. A maximum of fifteen (15) days of sick leave may be advanced to an employee at any given time in the discretion of the Department Head. In the event of separation of service, an adjustment shall be made in favor of the City of New Haven for the advanced sick leave granted. Sick leave may be donated to fellow employees if authorized by the Union President and the Director of Labor Relations. Advance of Sick Leave. 19.1.9.1 Any non-probationary employee may be advanced sick leave in an amount not to exceed 160 hours to supplement existing sick leave credit. Advance sick leave will be granted only in cases of serious disability or ailments, and when required by the exigencies of the situation or a return from OFLA/FMLA leave.
19.1.9.2 Such grants will not be made automatically but will be considered by the administration when the employee makes a written application. A certificate of a physician or practitioner or other appropriate written evidence as outlined in Section 19.1.5 above must be obtained for all periods of advanced sick leave and should be submitted with the application. Sick leave will not be advanced when a separation date has been established by resignation or other reasons that would preclude an employee from earning leave to cover the advance.
19.1.9.3 If an employee who has used advance sick leave resigns or is dismissed from service prior to the time that they have earned enough sick leave to cover the advance, they will be required to reimburse the District for the unearned amount. This amount may be deducted from the employee’s final paycheck. In the case of a resignation when there is no final paycheck due to the employee, the employee will be required to reimburse the District before the resignation is approved by the Board. If the separation from service is the result of permanent illness or injury, no reimbursement to the District will be required of the employee.
