AND RECALLS. In the case of layoffs and recalls the Company agrees to give preference according to seniority to employees provided they have the necessary qualifications to satisfactorily perform the work available. However, in the event an occurs, one shift or less, affecting- ment, Line or Group of employees they may be accomplished without regard to seniority. This clause will not be used for the purpose of filling-in jobs without regard to seniority. In case a planned layoff occurs for one day or more, the Company agrees to give preference to seniority provided they have the necessary qualifications to satisfactorily perform the work available. The Company will give the Union three (3) working days notice of a proposed indefinite layoff and discuss such layoff with the Chief Xxxxxxx. In the event of a dispute concerning the layoff, the Company may proceed with the layoff in the manner planned; and the employees affected shall have recourse to grievance procedure, the Company will also give the employees affected three (3) working days notice of an indefinite layoff. The Company will calculate weekly, the number of employees required for the and 3rd shifts. After allowing for absentees, exact number of employees required will be assigned according to Seniority provided they have the necessary qualifications to satisfactorily perform the work available. All employees below the required number will be termed as Laid-off. Employees for Sanitation Clean-up will be assigned starting with the lowest Seniority person not included in the layoff. Employees who do not have the necessary qualifications to satisfactorily perform the work available by virtue of having signed “off” heavy labour, sanitation clean-up or both, shall be laid off and the highest qualified employee from the layoff shall be reassigned to fill the vacancy. Employees who accept sanitation clean-up to avoid the layoff do not have the right to work on their bid jobs. Any employee coming off the layoff or sanitation clean-up to accept heavy labour will occupy their own bid job provided it is a heavy labour job. In the case of layoffs or recalls in the Plant Unit, Plant Unit employees will displace pro- bationary employees in the Laboratory Unit providing they have the necessary qualifications to perform the work available. AND RECALLS. In cases of layoff due to lack of work or recall following layoff, the nurse with the greatest amount of seniority in the affected classification will be retained or recalled, whichever is applicable, provided that the Employer can maintain a fully qualified work force to perform the available work. Part-time nurses shall be off before any full-time nurses. The President of the Union will be advised working days in advance of any planned lay-off anticipated to exceed five working days.
AND RECALLS a. Employees will be laid off in reverse order of seniority whenever there is a reduction of employees in the bargaining unit. The only exception to this provision is when the client requests in writing that a specific security guard be retained at their site. The Company shall employees whose position is to be eliminated due to the loss of work at a specific site or the loss of the entire site at least five (5) working days prior to the effective date of termination of the position. Such employee will be entitled to bump junior employees at other sites in order to maintain employment. The company will meet with the affected employee and their Union representative as quickly as possible after notification in order to allow the employee to review options and make an informed decision where they wish to bump into. The parties will attempt to place the security guard into an alternate site where said guard will not lose any days of pay, but in no event, will the placement, or bumping take more than five (5) working days (no more than five (5) unpaid days). If an employee is not slotted into their new position within said five (5) working days, the company will provide payment in lieu of work. During the up to five (5) days waiting period, the employee will be entitled to be on top of the spare board list if they so desire. The Company shall generally give notice of recall by registered mail to the last recorded address of the employee. The employee shall keep the Company informed of the employee's present address of location where he may be reached. The employee who fails to do so shall forfeit his right of recall. If, within one (1) calendar day from the receipt of such notice, the employee accepts the recall, the job will be held open for one (1) calendar day from the day of the employee's acceptance. In the event that such recalled employee is employed elsewhere at the time of recall, the Company will hold the position vacant for two (2) weeks if the Company has received appropriate advance notice from its client.
AND RECALLS. In the event of lay-off due to lack of work, the Company agrees to give seven (7) days notice wherever possible, unless otherwise required in accordance with the provisions of the Employment Standards Act as amended. In all cases of lay-off and/or recall (except lay-offs of not more than five (5) working days duration), seniority shall govern providedthat the Company may give effect in what it considers proper cases to the requirements and efficiency of operations, and the relative abilities, knowledge, training, and skills of individuals affected. The lay-off of not more than five (5) working days duration referred to above shall not apply for more than five (5) such days in any calendar month, nor for more than a total of fifteen
AND RECALLS. A In case of layoff, the employee subject to layoff may exercise his rights throughout the plant provided that in each case he bumps an employee with less seniority and can the normal requirements of the occupation without further training. B Laid off employees will be recalled to the plant in the order of their plant seniority, provided that those called back have the skill and qualifications to perform the functions necessary to the efficient and safe operation of the plant.
AND RECALLS. The Employer will give notice of lay-off to employees in accordance with the Act. Should a layoff occur, employees may exercise their seniority to bump a more junior employee in the same or lower classification provided that the employee who is retained can perform the available work without training subject to Section above. Recalls will be handled in reverse order of layoff subject to Section above.
AND RECALLS. When it is necessary to reduce the working force in a department, the employees affected will be given three (3) working days' notice whenever possible. The Union President will be notified as much in advance as possible. In a reduction in the working force in a department, the procedure outlined below will be followed:
AND RECALLS. Wherever possible the Board will notify permanent employees who are to be laid off thirty (30) days prior to the effective date of lay-off. This article will not apply to natural break periods during the school year or in the event of a labour dispute with another bargaining unit within the Board.
AND RECALLS. Layoff shall be defined as a period of at least one (1) week in which an employee receives less than three-quarters’ of the wages she would earn at her regular rate in a regular non-overtime work week. The shall give at least one week notice of layoff. The Employer agrees to meet with representatives of the Union prior to the implementation of any layoffs or reduction of hours in order to give the parties an opportunity to discuss alternative solutions.
AND RECALLS. The Employer shall give each Employee in the bargaining unit who has acquired seniority and who is laid off, notice in writing of his lay-off in accordance with Employment Standards Act.
