AND RECALLSIn the case of layoffs and recalls the Company agrees to give preference according to seniority to employees provided they have the necessary qualifications to satisfactorily perform the work available. However, in the event an occurs, one shift or less, affecting- ment, Line or Group of employees they may be accomplished without regard to seniority. This clause will not be used for the purpose of filling-in jobs without regard to seniority. In case a planned layoff occurs for one day or more, the Company agrees to give preference to seniority provided they have the necessary qualifications to satisfactorily perform the work available. The Company will give the Union three (3) working days notice of a proposed indefinite layoff and discuss such layoff with the Chief Xxxxxxx. AND RECALLSIn all cases of layoff due to lack of work or recall following layoff, the nurse with the greatest amount of seniority in the affected classification will be retained or recalled, whichever is applicable, provided that the Employer can maintain a fully qualified work force to perform the available work. Part-time nurses shall be laid off before any full-time nurses. The Divisional Vice President of the Union will be advised five (5) working days in advance of any planned lay-off anticipated to exceed five (5) days.
AND RECALLSEmployees will be laid off in reverse order of seniority whenever there is a reduction of employees in the bargaining unit. The only exception to this provision is when the client requests in writing that a specific security guard be retained at their site. The Company shall employees whose position is to be eliminated due to the loss of work at a specific site or the loss of the entire site at least five (5) working days prior to the effective date of termination of the position. Such employee will be entitled to bump junior employees at other sites in order to maintain employment. During the up to five (5) days waiting period, the employee will be entitled to be on top of the spare board list if they so desire. The Company shall generally give notice of recall by registered mail to the last recorded address of the employee. The employee shall keep the Company informed of the employee's present address of location where he may be reached. The employee who fails to do so shall forfeit his right of recall. If, within one (1) calendar day from the receipt of such notice, the employee accepts the recall, the job will be held open for one (1) calendar day from the day of the employee's acceptance. In the event that such recalled employee is employed elsewhere at the time of recall, the Company will hold the position vacant for two (2) weeks if the Company has received appropriate advance notice from its client.
AND RECALLSIn the event of lay-off due to lack of work, the Company agrees to give seven (7) days notice wherever possible, unless otherwise required in accordance with the provisions of the Employment Standards Act as amended. In all cases of lay-off and/or recall (except lay- offs of not more than five (5). working days duration), seniority shall govern provided that the Company may give effect in what it consid- ers proper cases to the requirements and effi- ciency of operations, and the relative abilities, knowledge, training and skills of individuals affected. When recalling a laid off employee who retains his or her seniority, the Company will notify such laid off employee by registered mail stat- ing the job available and the time of starting, which shall not be less than seven (7) days from the date of such mailing. The above notice will be sent to the last address of such laid off employee on record with the Company. Failure to notify the Company in writing within seven (7) days fol- lowing the mailing of such notice by the Company, that such laid off employee will report for work at the time specified, or having so notified the Company, failure to report at the time stated in the notice, shall constitute a break in service and his or her seniority shall consequently be lost. When an employee has been laid off, the Company shall notify the Union to that effect as soon as possible, stating the reason for the lay-off. The Company shall notify the Union when an employee is to be recalled.

If the Employee fails to the Employer, in writing, of intention to return to work within one (1) week of receiving the recall notice, shall forfeit seniority rights.
