Committee Duties. The Committee shall administer the Plan and shall have all discretion and powers necessary for that purpose, including, but not by way of limitation, full discretion and power to interpret the Plan, to determine the eligibility, status, and rights of all persons under the Plan and, in general, to decide any dispute and all questions arising in connection with the Plan. The Committee shall direct the Company, the Trustee, or both, as the case may be, concerning distributions in accordance with the provisions of the Plan. The Committee shall maintain all Plan records except records of any Trust. The Committee shall publish, file, or disclose — or cause to be published, filed, or disclosed — all reports and disclosures required by federal or state laws. The Committee may authorize one or more of its members or agents to sign instructions, notices, and determinations on its behalf.
Committee Duties. In addition to duties under government laws and regulations as set out in the Occupational Health and Safety Act, the committee shall: (a) Conduct monthly workplace inspections in order to identify hazards in the workplace. The workplace inspection team shall be comprised of no less than one (1) union representative. Employer representatives, if any, shall not outnumber the union representatives at any time. The inspection team shall report their findings to the Employer immediately following the workplace inspection. The committee shall meet as soon as possible after the inspection to discuss the inspection findings and make recommendations to address any hazards identified. (b) The union co-chairpersons, or their designate, shall have the responsibility and right to accompany a government inspector on every inspection or visit to the workplace. (c) Investigate all accidents, dangerous occurrences or near misses and known or suspected occupation illnesses or disease and ensure that recommendations are made to prevent their recurrence. All investigations shall be conducted by the co-chairpersons of the committee or their designate, and shall also include a worker who is knowledgeable in the type of work involved. (d) Based on findings recommended to management appropriate workplace modifications to address the following ergonomic risks: the physical demands of work activity, aspects of the layout of the workplace or workstation, the characteristics of objects handled, environmental conditions and the organization of work. (e) Review any plans for new technology, equipment, personal protective equipment, supplies, processes, materials, systems or procedures before they are implemented in the workplace to ensure that no hazards are introduced in the workplace. (f) Recommend implementation of hazard prevention procedures for every hazard identified in the workplace using the following hierarchy: elimination of the hazard, substitution of a less hazardous element, reduction of exposure to the hazard and finally control measures including the use of personal protective equipment. (g) Develop and delivery training programs to the workforce.

(C) The Finance Committee shall review and make recommendations regarding all finances, general resources of the Union, income and disburse- ments to the Board of Directors. The Finance Committee shall also review the annual budget for recommendation to the Board of Directors. (D) The Alternative Contracts Committee shall (1) develop and review issues pertaining to all negotiated collective bargaining agreements other than the main state employee collective bargaining agreement and (2) have input into developing educational and informational formats dedicated to the affected membership. (E) The Judicial and Internal Affairs Committee (JIAC) shall oversee the resolution of matters, except those related to staff, pertaining to disputes or irregularities at any level of the union, including but not limited to, Chapter, District Councils, and Assemblies. JIAC shall have the authority to investigate and review the continued viability of Chapters, District Councils or Assemblies due to changes in membership, size, agency mergers, work place reloca- tions, etc., and make the appropriate recommendations to the Board. Committee Duties. The District and Union shall each appoint five (5) members to serve on the Change Development and Training Oversight Committee (“CDTOC”). The Committee shall meet at least once a month, or more frequently if the Committee deems it necessary. Union members shall be released from regularly scheduled duty with pay to attend such meetings. The Committee shall operate by majority vote of those attending. The Committee shall: 1. Assess District-related training and succession needs for SEIU- represented job classifications, including but not limited to those related to change precipitated by new technology; 2. Develop workforce succession plans for the training of District employees to fill anticipated vacancies in classifications that are difficult to fill with job-ready (i.e. with normal orientation) candidates through normal recruitment procedures. 3. Establish the eligibility criteria, including standards and testing for aptitude, performance standards and attendance requirements, for participation in District sponsored training programs. 4. Determine the prioritization and timing of the expenditure for money in the CDTOC training fund described in subsection B below. Such funds shall be spent exclusively on training of employees as part of succession planning or re-training necessitated by displacement due to reorganization related to BAP I and II. 5. Investigate and develop outside sources of funding for District training efforts. 6. Investigate and attempt to establish coordination of District training and training planning efforts with those of other non-District entities for the purpose of leveraging maximum value for the District of District training expenditures.
