Employee Benefits While on Leave. Leave under this policy is unpaid. While on leave, employees will continue to be covered by the City's group health insurance to the same extent that coverage is provided while the employee is on the job. Employees may make the appropriate contributions for continued coverage under the preceding benefit plan by payroll deductions or direct payments made to these plans. Employee contribution rates are subject to any change in rates that occurs while the employee is on leave. If an employee fails to return to work after his/her leave entitlement has been exhausted or expires, the City shall have the right to recover its share of health plan premiums for the entire leave period unless the employee does not return because of the continuation, recurrence, or onset of a serious health condition which would entitle the employee to leave, or because of circumstances beyond the employee's control. The City shall have the right to recover premiums through deduction from any sums due the City (e.g., unpaid wages, vacation pay, etc.).

While on leave, an employee will continue to be covered by the District’s group health insurances which will include medical, dental, and income protection insurances in the same extent that coverage is provided while the employee is on the job. However, an employee will not continue to be covered under the District’s non-health benefit plans which include TSA, life insurance, and other non-health benefit plans unless an employee makes the appropriate contributions for continued coverage. An employee may make the appropriate contributions for continued coverage under the preceding non-health benefit plans by payroll deductions or direct payments made to these plans. Employee contribution rates are subject to any change in rates that occurs while the employee is on leave.
B. If an employee fails to return to work after their leave entitlement has been exhausted or expires, the District shall have the right to recover its share of health plan premiums for the entire leave period, unless the employee does not return because of the continuation, recurrence, or onset of serious health condition which would entitle the employee to leave, or because of circumstances beyond the employee’s control. The District shall have the right to recover premiums through deduction from any sums due to the employee from the District (such as unpaid wages, vacation pay, etc.).

An employee granted an unpaid leave of absence may elect to participate in the State Universities Retirement System during the period of the leave; the employee shall make all contributions. An employee may elect to participate in the College benefit program during the period of an unpaid leave; the employee shall make 100% contribution to all applicable benefits.
b. During an unpaid family and medical leave, the College will maintain the employee's regularly provided health benefits and will continue the College's required contributions toward the cost of the health insurance premiums at the level and under the conditions coverage would be provided if the employee maintained continuous employment. If the employee does not return to work upon completion of the leave period, the College may recover those contributions made by the College to maintain the employee's health insurance benefits.
c. An employee taking an unpaid leave of absence shall not suffer the loss of any employment benefit accrued prior to the date on which the leave commenced. During the unpaid leave period, an employee shall continue to accrue seniority.

Employee Benefits While on Leave. Unit I members on sabbatical leave will continue to receive the full benefit of hospital-medical insurance and term life insurance for which they would have been eligible as full-time employees of the Board.

Regular employees shall retain the status of employee while on Leave. However, a Leave used in conjunction with any other FMLA leave of absences, which exceeds 24 weeks, shall result in an adjustment to the employee’s Comprehensive Annual Leave and salary review date.

For the duration of the approved leave, for a period not to exceed 12 weeks, the Menlo Park Fire District shall continue to provide group health insurance, vision insurance, dental insurance, and life insurance benefits under the same conditions as coverage would have been provided had they been continuously employed during the leave period. Employees may make the appropriate contributions for continued coverage under these benefit plans by payroll deductions or direct payments made to these plans. Depending on the particular plan, the Menlo Park Fire District will inform employees whether the employee’s portion of the premium should be paid to the carrier or to the District. An employee’s coverage on a particular plan may be dropped if the employee is more than 30 days late in making any premium payment. Employees will be provided at least 15 days notice before coverage is to cease due to a late payment. Employee contribution rates are subject to any change in rates that occurs while the employee is on leave. If an employee fails to return to work after his or her leave entitlement has been exhausted or expires, the Menlo Park Fire District shall have the right to recover its share of health plan premiums for the entire leave period, unless the employee does not return because of the continuation, recurrence, or onset of a serious health condition of the employee or his or her family member which would entitle the employee to leave, or because of circumstances beyond the employee’s control. The Menlo Park Fire District shall have the right to recover premiums paid through deduction from any sums due to the employee (e.g. unpaid wages, annual leave cash-out, etc.) Annual leave does not accrue while an employee is on an unpaid leave under this Policy.
