Employees Covered By Agreement. The Employer recognizes the Union as the sole and exclusive bargaining agent for all Bargaining Unit Employees, including LPNs/LPN charge nurses, excluding supervisors, managers, department supervisors, and confidential employees, even if that person is currently the only person in the department, the Staffing Coordinator, the Bookkeeper, RNs. Additions to the Bargaining Unit of new employee groups and/or Employer facilities will be governed by the Neutrality and Voluntary Recognition Process, Appendix D, agreed to by the Parties as well as applicable laws and regulations.

Excluded positions include but are not limited to Dietary Manger, Business Office Manager, Social Services Director, Medical Records Director, Activities Director, Maintenance Supervisor, Housekeeping/Laundry Supervisor, Director of Nursing, Resident Care Mangers, Licensed Practical Nurses, and Registered Nurses.

Unit Employees covered by this Agreement shall be all full-time, regular part-time and per diem/ on-call employees, employed as: certified nursing assistants, graduate nursing assistants, certified medication aides, restorative aides, social service assistants, recreation assistants, central supply clerks, drivers and health information assistants, cooks, cook assistants, dietary aides, housekeepers, laundry assistants, and maintenance assistants, employed by the Employer; excluding all employees jointly employed by the Employer and other Employers and/or staffing agencies, confidential employees, managers, licensed practical nurses, registered nurses, resident care managers, charge nurses, staffing coordinator, therapists, licensed physical therapy assistants, physical therapy aides, office manager, business office manager, business office assistants, rehabilitation department manager, food service director, executive chef, maintenance director, environmental services director, housekeeping supervisor, health information director, social services director, recreation director, and all other professional employees, guards and supervisors as defined in the Act.

Section 2. The Borough agrees to deduct the monthly dues from the pay of those employees who individually authorize in writing that such deductions be made. The amounts to be deducted shall be certified to the Borough by the Association and the deductions of the employees shall be remitted together with an itemized statement to the Association on an agreed upon day of each month after such deductions are made.
Section 3. If a full-time regular employee does not become a member of the Association, said employee will be required to pay a representation fee to the Association. The purpose of this fee will be to offset the employees per capita cost of services, but shall not include costs associated with partisan political activities, or causes only incidentally related to terms and conditions of employment, and all benefits available only to members of the Association. In no event shall such fee exceed 85% of the regular membership dues, fees and assessments. The Association shall establish and maintain a demand and return system in accordance with the law.
Section 4. Payment of the representation fee in lieu of dues shall be made to the Association for any non-member within the bargaining unit during all periods when the collective bargaining agreement is in effect and during all times between agreements, should an agreement expire before another is fully agreed to. However, in no case shall payment for an employee be made sooner than the 30th day following the first day of employment in a position included in the bargaining unit.
Section 5. For purposes of application of Sections 2, 3 and 4 herein, the Date of Certification, September 6, 1985, shall be considered the effective date.
Section 6. The Association agrees to save the Borough harmless for all deductions made in accordance with this Agreement.
Employees Covered By Agreement. 2.1 The Company recognizes the Union as the sole Collective Bargaining Agency for all employees on the payroll of the Welland Plant of the Company, save and except Supervisor, and those above the rank of Supervisor; all employees of the Security, Fire and Safety Divisions; transformer station operators; draftsmen; chemists; laboratory technicians; professional and technical employees; office staff; and all plant clerical employees and janitors assigned to jobs classified as salaried plant jobs at the effective date of this Agreement, with respect to rates of pay, hours of work, working conditions, and other terms and conditions of employment.
2.2 Employees excluded from the Bargaining Unit as defined in paragraph 2.1 above shall not perform work normally performed by employees in the Bargaining Unit except in an emergency; for training or experimental purposes; for personal relief; or when the regular employee is standing by.
2.3 The Company will furnish to the Union, on the third Monday of each month, a list of the additions to, recalls to, or deletions from the Bargaining Unit during the preceding four (4) week period; and in the case of deletions, will specify whether such were due to retirement, resignation, promotion, layoff or discharge.* The Company will supply to the Union the names, addresses, phone numbers and job classifications of all Bargaining Unit employees once yearly with monthly updates unless the employee requests otherwise. *At the end of the probationary period, the Union will be advised of the employee's work location.
2.4 The Company will provide the Union with sufficient copies of this Agreement for distribution to all employees. Each new employee will be given a copy of this Agreement at the time he/she is hired by the Company and he/she will be requested to co-operate with the Company and the Union in carrying out it's provisions. 2.5 The Company will deduct from the wages of each employee for each pay period, an amount equal to the dues as is uniformally levied on all members of the Union. Each such deduction shall be in the amount from time to time fixed in accordance with the by-laws of the Local Union and certified to the Company by the Secretary of the Local Union as being so fixed.
2.6 The Company will remit the aggregate amount of such deductions made in any month, on or before the last day of such month, to the Financial Secretary of the Local Union whose receipt therefore shall constitute full and complete disch...
