EXTENDED LAYOFF. In the event that a layoff exceeds the five (5) day temporary layoff provision, then the layoff is considered to be an extended layoff and the provision for plant-wide seniority comes into effect. All bumps will be done as follows:
1) in person between the member, personnel and union representative in the personnel office, or
2) By phone with a union representative present, if the employee agrees or does not report for his/her next scheduled shift. A record will be made of all classifications offered during the bumping process.
(a) An employee having more seniority than any other employee will be allowed to exercise his/her seniority providing he/she is able to do the work required.
(b) If the classification selected is one that does not require extended training as per Appendix A, the employee moving to that job must be capable of carrying out the job responsibilities after a trial period of four (4) working days of being transferred, or a shorter period if mutually agreed upon.
(c) If the classification selected is one that requires extended training as per Appendix A, the employee moving to that job must be capable of carrying out the job responsibilities immediately upon being transferred.
(d) The Company will notify all affected employees of an extended layoff exceeding thirteen (13) weeks in a twenty (20) consecutive week period as follows:
i) at least one week before the layoff, if the employee's seniority is less than one year;
ii) at least two weeks before the layoff, if the employee's seniority is one year or more and fewer than five years;
iii) at least three weeks before the layoff, if the employee's seniority is five years or more. The Company will pay to each employee who has not been given the notice referenced above, wages in an amount equal to the notice the employee was entitled to above calculated at 40 hours of regular wages for each week.
EXTENDED LAYOFF. The following provisions shall apply in the event of an extended layoff:
EXTENDED LAYOFF. A layoff extending for more than thirty (30) work days shall not be implemented until the Association shall have had the opportunity to make its recommendations to the Board regarding priorities and procedures to be followed in such layoff, provided that any such recommendations shall be made within fifteen (15) calendar days from and after the date on which the Board notifies the Association of its intentions. An extended layoff shall conform to the following guidelines:
1. The Board shall give not less than twenty (20) calendar days notice of layoff if such layoff is scheduled to take effect during a school year or not later than July 1, if such layoff is to take effect at the opening of a new school year, except in the case of unforeseen circumstances.
2. Any layoff shall suspend for the duration of the layoff the Board's obligation to pay salary or fringe benefits under any individual contract of employment or under this Agreement; however, a teacher shall be eligible to receive any benefits, which were earned but not yet paid prior to the layoff.
EXTENDED LAYOFF. An extended layoff is one which is expected to exceed, or which exceeds ten (10) working days.
EXTENDED LAYOFF. For the purposes of extended layoff, an employee shall be regarded as having the ability to do a job if his/her experience, education, or skills qualify him/her to perform the required duties.
EXTENDED LAYOFF. In the event that a layoff exceeds the three (3)day temporary layoff provision, then the layoff is con- sidered to be an extended layoff and the provisionfor plant-wide seniority comes into effect. An employee having more seniority than any other employee shall be retainedat work providinghe is able and willing to do the work required. Any employee transferred due to a reduction the workforce must be capable of performing any of the general classifications selected within a period of three (3)working days. If the classification selected is one that requires "extendedtraining and/or educational backgroundthe employee moving to that job must be capable of carrying out the job responsibilities immediately upon being transferred.
EXTENDED LAYOFF. A reduction of straight time work opportunity from a regular full-time or regular part-time (Predetermined) employee’s regular work schedule and which at the time of layoff is expected to exceed thirty (30) calendar days in duration but is not expected to be permanent. The reduction of straight time work opportunity must be sufficient to cause a change in employment status of the employee.
EXTENDED LAYOFF. [a] As used in section 24.3(b)(2)[b] below, reasonably qualified means able to meet the competency requirements and perform the duties of the position within a reasonable period of orientation, to be determined by the manager/supervisor and the employee. [b] Any employee impacted per Section24.3(a)(1), Extended Layoff, shall: [i] Be placed in a vacant position in an area for which the employee is reasonably qualified. [ii] If there is no vacant position for which the employee is reasonably qualified, the employee shall displace the least senior employee in their job classification provided they are reasonably qualified.
EXTENDED LAYOFF. The following provisions shall apply in the event of an extended layoff.
(a) The Company agrees to give the Union and the employees concerned ten (10) full working days notice of an extended layoff or pay in lieu thereof. Whenever possible, all extended layoffs shall only take place upon completion of the employees' Friday shift. The Union Committee shall be given adequate notice of pending layoffs.
(b) The Company xxxx determine the number of employees required in each job classification within each department.
(c) All probationary employees shall be laid off prior to employees who shall have attained seniority status excepting such probationary employees as are necessary to provide for the proper functioning of the operations of the Company.
(d) The senior employee shall receive the preference of being retained in his/her department at the time of layoff.
(e) Employees displaced by (d) above will exercise their office wide seniority and displace an employee with less seniority provided he/she is able to perform the work.
(f) The parties agree that when exercising their rights under this clause, the Company will grant such employees a period of up to ten (10) working days to acquaint themselves with such information as is normally required to do the job.
(g) Notwithstanding the provisions of (e) and (f) above, if the displacement would be to a job classification having a rate equal to or lower than the job classification from which the employee is being laid off, the following special training provision will be applied. Specifically, the displacement will be permitted if it is expected that the employee would be able to perform the work in ten (10) working days with up to ten (10) clays of training normally provided in the area. The displacing employee will be expected to apply him/herself to developing proficiency on the job and to demonstrate reasonable progress during the training period. While the Supervisor remains responsible for ensuring that training is provided, it is further understood that employees in the area where such training is taking place will cooperate in providing training and instruction as assigned. The basis on which an employee can displace under this Section is that there is reasonable evidence that the employee will be able to perform the job. Such evidence shall include that previously, during his/her employment with the Company, an employee has met the requirements of that or a similar kind of work, and has sufficient transfer...
EXTENDED LAYOFF. In the event of extended layoff of employees (over ten (10) work days) for lack of work, employees shall be moved, laid off and recalled by non-interchangeable occupational groups (set out in Appendix A) within their seniority unit in accordance with their seniority, skill and ability, and whenever the skill and ability of two or more employees are equal to do the work then required, seniority shall govern. Except in an emergency, or for reasons or conditions over which the Company has no control, when there is an extended layoff over ten (10) work days, notice shall be given to the Chair of the Shop Committee seven (7) work days before such layoff. Any employee who at the time of an extended layoff is subject to being moved to a lower listed job shall have the right to accept layoff in lieu of such move.
