Jury and Subpoena Leave. 1. Employees in a pay status ordered to perform jury service or subpoenaed to court or any legislative body shall be entitled to leave of absence with pay for the entire day for each day served, and without deduction from leave, at an amount equal to the employee's regular daily earnings. In the case of subpoena leave above, the employees are eligible if the appearance time occurs during their normal working hours, and they are not a party to the suit.
2. The term regular earnings in (1) above means full pay for regularly scheduled work, which the employees would have received had they not been called to jury service or subpoenaed, including schedule differentials that would have resulted from regularly scheduled work.
3. All time spent on jury duty or subpoena leave must be accounted for by the employees. If employees are excused from jury service or subpoena on a normal workday, they are expected to report for work. Employees must account to their departments for any time off for illness or other reasons, while on jury duty or subpoena leave.
4. Upon completion of jury service or subpoenaed time, the employees upon receipt, shall submit to the City the warrant for jury fees, witness fees and/or mileage and a copy of the court report of jury time served. When employees are served with a subpoena, the employees shall request witness fees. The employees shall retain or be reimbursed the amount paid by the court for mileage and jury fees representing jury service performed by the employees on their regular day off.

Leave of absence with pay will be granted for jury duty and/or when an employee has been subpoenaed to appear in a court of law in his/her capacity as an employee of the District. The employee will notify the District when notified to serve on jury duty or when so served with a subpoena. Any compensation received by the employee for services performed applicable under this section on and during contracted days will be deducted from the employee's salary, less documented expenses incurred in fulfilling such service. Jury/Subpoena leave will not be deducted from an employee's sick leave. If an employee is named as a co-defendant with or a witness for the District in a court action, the provisions of this section will apply. If the employee is the plaintiff against the District, this section will not apply and the employee must use leave without pay.
Jury and Subpoena Leave. (a) A leave of absence with pay shall be allowed for jury duty. Employees may keep jury travel allowances.
(b) Leaves of absence shall be granted when an employee is subpoenaed to appear in a court of law. Such leave shall be granted with full pay. The employee shall make reasonable efforts to cooperate with the District to minimize the amount of such leave required.
(c) Upon receipt of a jury summons or a subpoena, the certificated employee shall notify the District.

Employees who lose work because of absence on jury duty will be paid the difference between the regular scheduled earnings, which would otherwise have been received, and their reimbursement as jurors, exclusive of mileage reimbursements, up to a maximum of eight (8) hours for each day. The employee shall report promptly to work if he/she is excused from jury duty or witness service during the workday. In the event that a regular part time employee has more than one employer. The employees will pro rate the jury duty pay based on the number of documented hours normally worked.

Jury and Subpoena Leave. 1. Leave of absence with pay shall be granted for jury duty; however, the pay provided by the court for jury duty must be remitted to the District to help offset the loss of service. The employee may keep the expense money provided by the court.
2. A certificated employee will be granted subpoena leave as may be required by the subpoena, and shall be paid their regular salary, up to and including five (5) days, less any compensation received for their services, excluding transportation, except when the employee is the plaintiff or defendant in such action.
3. This exception shall not apply when the employee is named as plaintiff or defendant for events or actions arising out of the performance of their duties in the District.
4. Where officially documented written statement(s) are acceptable as testimony by the court, the employee should make such arrangements.
5. In serving as a witness, the employee will make a maximum effort to minimize the amount of time spent away from their employment. The office of the superintendent may extend the definition and intent of the subpoena leave policy on an individual basis.
