Jury or Witness Duty Leave. 23.7.1 Where an employee is absent by reason of a summons to serve as a juror or a subpoena as a witness, the employee may, at his or her option:
(a) treat the absence as a leave without pay and retain any fee he or she receives as a juror or as a witness; or
(b) deduct the period of absence from his or her vacation credits or his or her accumulated compensation leave, and retain any fee he or she receives as a juror or as a witness; or
(c) treat the absence as a leave with pay and pay to the ministry any fee he or she has received as a juror or as a witness.
23.7.2 An employee on a leave of absence pursuant to Article 23.7.1 (a) shall not accrue credits or be covered by benefits plans during such leave, if the leave is greater than one (1) calendar month. An employee on leave pursuant to Article 23.7.1(b) or (c) shall accrue credits and be covered by benefits plans during such leave.
Jury or Witness Duty Leave. 22.1 Where an employee is absent by reason of a summons to serve as a juror or a subpoena to appear as a witness, the employee may at his/her option,
a) treat the absence as leave without pay and retain any fee he/she receives as a juror or as a witness; or
b) deduct the period of absence from his/her vacation credits or accumulated credits or both and retain any fee he / she receives as a juror or as a witness; or
c) treat the absence as leave with pay and pay to the Minister of Finance any fee he / she has received as a juror or as a witness.
Jury or Witness Duty Leave. Where an employee is absent by reason of a summons to serve as a juror or a subpoena as a witness, the employee may, at his or her option:
Jury or Witness Duty Leave a) An employee who is absent from work as a result of being subpoenaed to be a witness in a court, or who is required to serve on a jury, shall be paid their normal salary while absent.
b) The employee shall notify the Employer as soon as possible after receipt of notice for such an absence.
c) This provision does not apply to an employee:
i. Who has a direct or indirect interest in the outcome of any proceedings; or
ii. Who appears as an accused in any proceedings
Jury or Witness Duty Leave. 23.7.1 An employee required to serve on jury duty or as a witness in a case in which the employee has been given a subpoena to attend a court proceeding in which the Crown is a party, shall not lose regular pay because of necessary absence from work due to such attendance, shall not be required to work on the day of such duty and shall not be required to work the night shift immediately prior to such attendance. The Hospital shall not unreasonably deny any necessary schedule changes to accommodate such duty. The employee shall not be required to work extra hours as a result of such duty or accommodations made to allow attendance at such duty. Employee attendance for jury or witness duty shall be treated as a work day for the employee, provided that the employee:
i) Informs the Hospital immediately upon being notified that the employee will be required for such attendance.
ii) Presents proof of service requiring the employee’s attendance, and promptly repays the Hospital the amount (other than expenses) paid to the employee for such service as a juror or for attendance as such witness where any monetary compensation is provided for attendance.
Jury or Witness Duty Leave. 23.7.1 Where an employee is absent by reason of a summons to serve as a juror or a subpoena as a witness, the employee may, at their option:
(a) treat the absence as a leave without pay and retain any fee they receive as a juror or as a witness; or
(b) deduct the period of absence from their vacation credits or accumulated compensation leave, and retain any fee they receive as a juror or as a witness; or
(c) treat the absence as a leave with pay and pay to the ministry any fee they have received as a juror or as a witness.
23.7.2 An employee on a leave of absence pursuant to Article 23.7.1 (a) shall not accrue credits or be covered by benefits plans during such leave, if the leave is greater than one (1) calendar month. An employee on leave pursuant to Article 23.7.1(b) or (c) shall accrue credits and be covered by benefits plans during such leave.
Jury or Witness Duty Leave. (a) An employee on jury or witness duty leave shall suffer no loss of daily wages and may retain jury duty or witness fees in addition to their regular pay for any day on which they are absent from scheduled School District duties because they have been summoned for jury duty or because they have been subpoenaed for appearance in court as a witness at a time conflicting with their regular duties.
(b) The employee shall present evidence of such jury duty or court appearance to the District.
Jury or Witness Duty Leave. A bargaining unit employee who is required to serve jury duty or who receives a subpoena and is required to miss work as a result of complying with the subpoena, will be granted an administrative leave with pay, except as otherwise provided in this Section. The employee will submit a request for administrative leave for court purposes to the immediate non-bargaining unit supervisor. The Board will not reimburse an employee for meals, lodging, or travel expenses incurred while serving as a juror or as a witness. The employee will retain any jury duty fees. Normally, witness fees will be retained by the employee. If an employee will receive expert witness fees or consulting fees for any appearance under this Section, a vacation leave, a personal leave with pay, or a personal leave without pay must be requested. An employee who is a party in a non-College related lawsuit may not request administrative leave with pay for court purposes or for the prosecution or defense of a lawsuit. The employee may request vacation leave or personal leave. An employee who is a defendant or a witness in a lawsuit due to College employment will be considered on duty and need not submit a request for leave of absence. An employee who is a witness in an arbitration case under this contract or before the Public Employees Relations Commission, unless subpoenaed by the College, may not request administrative leave with pay. The employee may request vacation or personal leave.
Jury or Witness Duty Leave. The Employer shall grant leave of absence to an employee subpoenaed to serve as a juror or witness in any court. The Employer shall pay such employee the difference between his regular earnings and the payment he receives for jury or witness duty excluding payment for travelling, meals or other expenses, conditional upon the employee presenting proof of service and proof of the amount of pay received. Leave of absence without pay shall be granted to any employee whose private affairs require his appearance in court.

Financial remuneration received (other than travel expenses) for the time and service rendered will be refunded to the District. Leave for this purpose is granted without prior approval of Board or administration. Proper prior notification will be given to the immediate supervisor and the District certificate of absence will be completed upon return of the employee.
2. An employee who receives a subpoena for an appearance in court, as long as the employee is not a litigant in the court action, will be granted such leave with no loss of salary or sick leave. Financial remuneration received (other than travel expenses) for time and services rendered will be refunded to the District. Leave for this purpose is granted without prior approval of the Board or administration. Proper prior notification will be given to the immediate supervisor and the District certificate of absence will be completed upon the return of the employee.
