Letter of Understanding – Training. The Company agrees to recognize a list of Welder 2ís to a maximum number of twenty-four (24) employees. In this regard, the Company agrees that any employees who, on their own initiative, take the training and testing and successfully obtain their CWB All Position Stick Welding Certification, will be reimbursed their tuition costs and will be added to the list of Welder 2ís, up to the said maximum of twenty-four (24) employees, inclusive of those employees who have earlier obtained their Certification. If 24 employees hold their CWB All Position Stick Welding Certification, any other employees who, on their own initiative, takes the training and testing and successfully obtains his CWB All Position Stick Welding Certification, will be eligible for Tuition reimbursement pursuant to Article 13 of the Collective Agreement, but will not be added to the list of Welder 2ís. Such employee will only be eligible to be added to the list of Welder 2ís in the event of a vacancy on the list. It is understood and agreed that all Welder 2s who are recognized as such on the list of Welder 2s provided for above must maintain their certification in CWB All Position Stick Welding to retain status on the said list. It is acknowledged and agreed that maintaining this certification requires recertification every two years. The Company agrees to pay for fees involved for any Welder 2 in respect of his or her first attempt at recertification. If the Welder 2 fails such first attempt at recertification, he or she will be responsible for all costs involved in making further attempts at recertification, including any training costs that may be involved. Any Welder 2 who fails recertification or otherwise does not maintain his or her status as a certified CWB All Position Stick Welder will be removed from the list of Welder 2s at the time certification lapses. Such employee will not be eligible to be again included in the list of Welder 2s until certification status is again obtained and a vacancy exists on the list that can be filled by the said employee. Letter of Understanding – Training. The Company will select 3 people and the Union will select 3 people to establish a joint training committee. The purpose of the committee will be to review the plant training requirements and establish appropriate training schedules for employees who post into new positions. In addition the committee will establish a long term training strategy for senior employees interested in developing and upgrading their skills. It is understood that Plant budgetary constraints will determine the extent and frequency of any approved training schedules. The committee will meet on a quarterly basis or more frequently if required. The Company agrees to deduct, through payroll deduction, any employee volunteer contribution made through the District 6 Savings Plan. All monies will be deducted on a weekly basis and forwarded to the administrator of the District 6 Savings Plan. Students can be in the summer for the purposes of assisting as vacation replacement during the period starting the second week of April up to and including the second week of September, following which their service, seniority and employment will be automatically terminated. Students will be considered as temporary employees and will not acquire seniority over permanent employees; however once they complete their probationary period, students will acquire seniority within the temporary student group only. In the event of lay offs, students will be laid off first before permanent employees. If a student becomes a permanent employee his date of hire will be the first of as a permanent employee he/she’ acquire seniority after completing a new probationary period. Students will not be eligible for benefits outlined in Section and Appendix Section A, C D of the collective agreement. For the purpose of overtime sharing, students will be allowed to share in overtime after permanent employees in same department and shift have been asked to work. For the purposes of weekend overtime, students within a department will be eligible to work after the permanent employees of that department have been asked. Students will be credited with the highest overtime hours of the shift in the department which enters. Letter of Understanding – Training. The Company and the Union mutually recognize the importance of training to improve efficiency, productivity, and employee job satisfaction. When an employee is required by the Company to take training, the employee shall be reimbursed for approved expenses as per current practice. Employees may make requests directly to their supervisor for training. Approval of such training shall be at the sole discretion of the Company.
Letter of Understanding – Training. The Company and the Union agree that well trained employees are essential for the safe and efficient operation of the Plant and the health and safety of the employees. To meet that end, the Company will select, from employees in the bargaining unit, individual(s) in each department who as part of their duties including training employees. The Company will first solicit volunteers by Seniority before assigning an Employee to conduct training. These employees will work in coordination with other trainers, both bargaining unit and salary employees, within the Company. The ap- plicable training rate will apply when performing these duties. LETTER OF UNDERSTANDING COMMITTEES, TEAMS OR EVENTS The Company will discuss with the Union all new committees, teams, or events that will involve the bargaining unit employees at monthly Union/Management meetings. Committees, teams or events will be added as an agenda item at the monthly Union/ Management meeting. The Union may discuss issues with the func- tion of the committees, teams or events and/or involvement of bar- gaining unit employees at monthly Union/Management meeting. Participation of the employee will be voluntary and will be dis- cussed with the employee beforehand. It is the Company’s intent to involve as many volunteer bargaining unit employees as possible to enhance Company operations and ef- ficiencies. The Company will provide a list of employees involved in such committees, teams or events on an annual basis. LETTERS OF UNDERSTANDING “OHSA SUPERVISOR” INDEMNIFICATION The Company recognizes and values the work performed by em- ployees in furtherance of the requirements of the Occupational Health and Safety Act, as amended (“OHSA”), and its regulations. The Company and Union agree that certain employees in the bar- gaining unit may be directed by management to assume some dut- ies and responsibilities that could bring them within the definition of “supervisor”, for the purposes of, and as defined in the OHSA and its regulations. This may include, but is not necessarily limited to the positions of Expediter, Lead Tradesman, Lead Shipper, As- sistant Chief Operating Engineer, Shift Operating Engineer, Trainer and Relief Shift Supervisor and Senior Lab Technician. While acting as a supervisor as that term is defined under OHSA, in the event an employee is charged as a supervisor by the Ministry of Labour, or other applicable enforcement agency, with an alleged violation of the OHSA or its regulations, the C...
