Make up pay. J2.1 When incapacity from work is due to a cause that would entitle an employee to payment of workers’ compensation, the head of service will pay the difference between the amount of the workers’ compensation payment and full pay. The provisions of the clause will not affect the employee’s entitlement to sick leave arising from ordinary illness.

Make up pay. This current arrangement maintains firefighter’s normal weekly earnings (NWE) at 100 per cent while the firefighter remains covered by the enterprise agreement regardless of the length of absence on compensation. This benefit exceeds that payable to other ACT Public Sector (ACTPS) employees whose salary reverts to 75 per cent of NWE, where absence on workers’ compensation exceeds 45 weeks. This arrangement has been available to firefighting personnel since the late 1980s and was enshrined in the relevant Industrial Award and now enterprise agreements. The benefits of this proposed reform are more significant to organisational culture i.e. rehabilitation outcomes than the direct financial benefit to ESA.
Make up pay. Subject to the conditions outlined in this Clause an employee who qualifies for worker's compensation under the relevant State Legislation will receive as accident pay an amount equal to the difference between the total amounts received as workers compensation payments and the minimum weekly payment applicable to the employee's classification. Payment under this Clause is conditional upon the employee accepting suitable work in accordance with the terms of any treating doctor's certificate issued in respect of the relevant accident. No payment shall be made in respect of any absence following a recurrence of injury arising out of employment with another Employer. No payment shall be made in respect of any period of other paid leave of absence. Payment under this Agreement is limited to a maximum of 52 weeks on account of any one injury. In the case of termination of employment by the Employer, payment shall continue until the balance of the employee's current entitlement has expired. An employee on engagement may be required to declare all workers' compensation claims made in the previous five (5) year, and in the event of false information being deliberately and knowingly declared the Employer may require the employee to forfeit the entitlement to payment under this Agreement. Where there is redemption of weekly compensation payments under the relevant State legislation the Employer's liability to pay accident pay shall cease as from the date of such redemption. Entitlement under this Agreement shall cease on the death of any employee. Make up pay. The parties to this Agreement agree to maintain the provisions of workers compensation make-up pay as stated in clause 5.3 of the Goninan Taree Plant Award 2002 at the time of the lodging of the Agreement. These provisions will remain in effect for the life of the Agreement.

Make up pay. An employee who fails to complete a full week for any reason (normally 38 hours) shall use overtime worked to make up the employee’s ordinary hours for that week The make up time will be deducted from double time first, then time and half. It will be paid as ordinary time. If there is no overtime available, the employee may use annual leave to make up the ordinary hours owed. Failing annual leave being available, leave will be without pay. Example: An employee takes three (3) ordinary hours off during the week on a Thursday, making the employee three (3) hours short in that week. The employee subsequently works 3 hours overtime on Friday which is paid at ordinary time making up the three (3) ordinary hours lost on the day before e.g. time for time. A leave form must be completed before the pay for that week is authorised. See Part 7Leave of absence and Public Holidays.
