A non-exempt employee who elects to leave when the work is done, if the time worked is less than three (3) hours, shall receive overtime pay only for the actual time worked, computed to the nearest quarter hour. However, in the event an on-duty fire investigator is called out to work overtime, which has been specifically authorized by supervisory or command personnel, which is not an extension at the beginning or end of a normal shift or the employee is physically called out and is then turned around en route, the employee shall be paid a minimum of three (3) hours at the overtime rate; however, if the employee’s regular shift starts less than three (3) hours from the time he/she started work as the result of a call out situation, he/she will be paid overtime for only such time as occurs before the start of his/her regular scheduled shift. An employee may be required to respond to more than one call out within the three (3)) hour minimum without being additionally compensated with another three (3) overtime. The employer may require work of the employee called out beyond that initially prompting the call out. In the event an on-duty fire investigator provides assistance of at least fifteen (15) minutes in duration without physically responding to work or the worksite (i.e., addressing the issue by phone, electronically or other means) the employee shall be paid a minimum of thirty (30) minutes at the overtime rate. An employee responding to and completing multiple calls, without physically responding to work or the worksite, within the same 30-minute period will not be entitled to additional compensation beyond the minimum overtime rate. The amended overtime minimum pay language shall be effective the first full month following the last party to sign this agreement.

An officer's shift ends at 6:00 AM and an emergency meeting is called by the Chief to begin at 6:00 AM and lasts for one hour. This would be considered a continuation of the officer's shift and only generate one hour of time worked rather than triggering a two-hour minimum. Likewise, if the meeting occurred at 6:00 PM, the officers scheduled to end their regular shift at 6:00 PM who were required to attend late generate an hour of time worked to attend the one-hour meeting. Any officer not scheduled to work that day and who was required to attend would be eligible for the two-hour minimum for overtime. An officer's shift begins at 6:00 AM and a meeting is called by the Chief to begin at 5:00 AM and lasts for one hour. This would be considered a continuation of the officer's shift and only generate one hour of time worked rather than triggering a two-hour minimum. Likewise, if the meeting occurred at 5:00 PM, the officers scheduled to begin their regular shift at 6:00 PM who were required to come early would generate a single hour of time worked to attend the one-hour meeting.   • Minimum Payment (a) Overtime worked on a Saturday or Sunday will be paid for at the rate of double Ordinary Rates. Employees required to work on a Saturday or Sunday will be afforded a minimum 4 hours work, or be paid as if for 4 hours at the aforementioned overtime rates.

Contributions made or costs reasonably anticipated for bona fide fringe benefits under section 1(b)(2) of the Xxxxx-Xxxxx Act on behalf of laborers or mechanics are considered wages paid to such laborers or mechanics, subject to the provisions of paragraph 1.d. of this section; also, regular contributions made or costs incurred for more than a weekly period (but not less often than quarterly) under plans, funds, or programs which cover the particular weekly period, are deemed to be constructively made or incurred during such weekly period. Such laborers and mechanics shall be paid the appropriate wage rate and fringe benefits on the wage determination for the classification of work actually performed, without regard to skill, except as provided in 29 CFR 5.5(a)(4). Laborers or mechanics performing work in more than one classification may be compensated at the rate specified for each classification for the time actually worked therein: Provided, That the employer's payroll records accurately set forth the time spent in each classification in which work is performed. The wage determination (including any additional classification and wage rates conformed under paragraph 1.b. of this section) and the Xxxxx-Xxxxx poster (WH–1321) shall be posted at all times by the contractor and its subcontractors at the site of the work in a prominent and accessible place where it can be easily seen by the workers. (1) The contracting officer shall require that any class of laborers or mechanics, including helpers, which is not listed in the wage determination and which is to be employed under the contract shall be classified in conformance with the wage determination. The contracting officer shall approve an additional classification and wage rate and fringe benefits therefore only when the following criteria have been met: (i) The work to be performed by the classification requested is not performed by a classification in the wage determination; and (ii) The classification is utilized in the area by the construction industry; and (iii) The proposed wage rate, including any bona fide fringe benefits, bears a reasonable relationship to the wage rates contained in the wage determination. (2) If the contractor and the laborers and mechanics to be employed in the classification (if known), or their representatives, and the contracting officer agree on the classification and wage rate (including the amount designated for fringe benefits where appropriate), a report of the action taken shall be sent by the contracting officer to the Administrator of the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, Washington, DC 20210. The Administrator, or an authorized representative, will approve, modify, or disapprove every additional classification action within 30 days of receipt and so advise the contracting officer or will notify the contracting officer within the 30-day period that additional time is necessary. (3) In the event the contractor, the laborers or mechanics to be employed in the classification or their representatives, and the contracting officer do not agree on the proposed classification and wage rate (including the amount designated for fringe benefits, where appropriate), the contracting officer shall refer the questions, including the views of all interested parties and the recommendation of the contracting officer, to the Wage and Hour Administrator for determination. The Wage and Hour Administrator, or an authorized representative, will issue a determination within 30 days of receipt and so advise the contracting officer or will notify the contracting officer within the 30-day period that additional time is necessary. (4) The wage rate (including fringe benefits where appropriate) determined pursuant to paragraphs 1.b.(2) or 1.b.

  • Overtime Pay ‌ Overtime pay shall be paid to the employee on the next paycheque after the expiration of the pay period in which the overtime was earned except as provided in Article 16.6 (Compensating Time Off) below.

  • Overtime Meal Allowance Employees required to work more than two (2) hours overtime consecutive with a shift shall be provided with a meal by the Employer.

  • Overtime/Compensatory Time A. Employees working assigned, pre-approved time in excess of forty (40) hours per week shall be given either overtime pay or compensatory time at the rate of one and one-half times the employee’s regular rate of pay. The name of the supervisor authorized to approve overtime assignments shall be posted in each building. The employee may elect to take either overtime pay or compensatory time off. Only forty-five (45) hours of compensatory time can be earned in a contract year. Use of compensatory time must be approved by the employee’s immediate supervisor. Compensatory time earned must be used during the contract year in which it is earned or cashed in for pay at the rate in effect for the employee at the time the employee receives such payment. Employees who have accumulated more than forty (40) hours of compensatory time at the time of execution of this Agreement shall retain all such accumulated time, provided, however, that such employees shall not be allowed to use more than forty (40) hours in any contract year. All compensatory time must be submitted on a timesheet. C. All overtime worked must be submitted on a timesheet to the building principal in accordance with business office procedures for processing payroll. Requests for use of compensatory time off shall be submitted in writing to the building principal in accordance with business office procedures for processing payroll. X. Xx employee called in to work on his/her day off will be paid for a minimum of two (2) hours at the appropriate rate. E. The decision to assign overtime will not be based upon an employee’s preference for either compensatory time or overtime pay. F. In the event an employee’s regular permanent assignment requires the performance of duties in more than one job classification, the overtime rate to be used to calculate compensation for the employee for the overtime work shall be the rate of the classification which caused the employee to work such overtime hours.
