The Certificate(s) shall be completed and signed by an Agent, accompanied by an affidavit also signed by Broker, attesting the furnished Certificate(s) represent Broker’s current coverages. City shall not accept a Memorandum of Insurance or Binder as proof of insurance. The certificate(s) must be signed by the Authorized Representative of the carrier and list the agent’s signature and phone number. The certificate(s) shall be mailed, with copies of all applicable endorsements, directly from the insurer’s authorized representative to City. City shall have no duty to pay or perform under this Agreement until such certificate and endorsements have been received and approved by City’s TCI Department. No officer or employee, other than City’s Risk Manager, shall have authority to waive this requirement. City reserves the right to review the insurance requirements of this Exhibit B during the effective period of this Agreement and any extension or renewal hereof and to request the modification of insurance coverage and limits when deemed necessary and prudent by City’s Risk Manager, based upon changes in statutory law, court decisions or circumstances surrounding this Agreement. In no instance shall City allow modification whereby City may incur increased risk. Reporting Time Frames – The recipient shall submit Monthly or Quarterly performance achievements and performance questionnaires to the Department, within fifteen (15) days after the end of the reporting period. In addition, if the award period is extended beyond the "original" project period, additional performance achievements and performance questionnaires shall be submitted. Failure to Submit – Performance achievements and performance questionnaires that are not complete, accurate, and timely may result in sanctions, as specified in Section IV, Award Management and Reporting Requirements. Report Contents – Performance reporting must clearly articulate, where appropriate, performance during the execution of the award has met a standard against which the recipient’s performance can be measured. Responses must also reflect on accomplishments for the period and identify problems with project implementation and address actions being taken to resolve the problems. Additional information may be required if necessary to comply with federal reporting requirements. Requirement for Data on Performance and Effectiveness Under the Award - The recipient must collect and maintain data that measures the performance and effectiveness of work under this award. The data must be provided to OCJG in the manner (including within the timeframes) specified by OCJG. Data collection supports compliance with the Government Performance and Results Act (GPRA) and the GPRA Modernization Act of 2010, and other applicable laws. Financial Consequences for Failure to Perform - In accordance with s. 215.971 F.S., payments for state and federal financial assistance must be directly related to the scope of work and meet the minimum level of performance for successful completion. If the recipient fails to meet the minimum level of service or performance identified in this agreement, or is customary for awards, then the Department will apply financial consequences commensurate with the deficiency. Financial consequences may include but are not limited to withholding payments or reimbursement until the deficiency is resolved, tendering only partial payment/reimbursement, imposition of other financial consequences according to the Standard Conditions as applicable, and/or termination of contract and requisition of goods or services from an alternate source. Performance and Reporting. The most critical aspect of these Performance Level Standards and Reports is the monitoring and measuring of Vendor’s service level performance. All key services provided to Covered Persons must be carefully measured and monitored by Vendor and the results analyzed and reported to United as set forth in Attachment 1 to this Exhibit. All benchmarks, targets and metrics, as well as reporting timeframes, are described in Attachment 1. Service performance levels must be reviewed monthly by both United and Vendor. Any problems that might arise must be addressed in accordance with the terms set forth in the Performance and Reporting Specifications Attachment to this Exhibit (Attachment 1).
