RESTRICTION DUTY a) An employee performing restriction duty in accordance with clause 36 will be paid: • at a rate of 7.5% of the employee's hourly rate of salary for each hour restricted Monday to Friday; • at a rate of 10% of the employee's hourly rate of salary for each hour restricted Saturday and Sunday; and • at a rate of 15% of the employee's hourly rate of salary for each hour restricted on public holidays. b) The hourly rate of payment will be calculated according to the following formula: annual salary X 6 X % of salary prescribed at c) or d) 313 37.5 c) An employee's salary for the purpose of calculation of restriction allowance will include higher duties allowance and any other allowances in the nature of salary. d) Where approval has been made for payment of restriction allowance to an employee above the salary barrier, the annual salary component of the formula at will be the annual salary payable to an APS Level 6. e) Restriction allowance will be payable for each hour or part hour the employee is restricted outside the employee's ordinary hours of duty. Any part of a period of restriction for which the employee receives another payment will not be included for calculating payments. f) Where an employee who has been restricted under this subclause is required to perform duty, but is not required to be recalled to work, overtime payment will be made, subject to a one hour minimum payment. g) Where an employee who has been restricted outside the employee's normal hours is recalled to duty at a place of work, payment in accordance with the relevant overtime provisions will be made subject to a 3 hour minimum payment. h) Payment of restriction allowance will be subject to the following conditions: • the restriction situation is imposed by prior written direction, or is subsequently approved in writing; and • emergency duty under sub-clause 19.2 will not apply where an employee is recalled to duty while restricted. i) Notwithstanding the provisions of this Section, where an employee is placed in a restriction situation outside of the employee's ordinary hours of duty, the employee may be paid at an alternative rate having regard to the circumstances of the restriction situation.
RESTRICTION DUTY. 26.1 Restriction direction The Delegate may direct an officer to be contactable and remain available to perform extra duty outside that officer’s normal hours of duty.
RESTRICTION DUTY. Where the Commissioner approves for an employee to be contactable and to be available to perform extra duty outside the bandwidth, for a period(s) of no less than 12 hours per period unless a reduced period is required and is approved by the Commissioner, the employee will be paid a Restriction Allowance at a flat rate of $46.80 per weekday and $57.20 for Saturdays, Sundays, public holidays and days falling within closedown periods. That is, if an employee is on restriction for less than one day, they will still receive the daily rate. The allowance rates will be indexed on 13 March 2025, having regard to the annual percentage change in the Consumer Price Index in the preceding December quarter. Where an employee in receipt of a Restriction Allowance is recalled to duty at a work location, a three hour minimum overtime payment will apply and where the employee is required to perform duty, but is not recalled to a work location, a one hour minimum overtime payment will apply. Restriction Allowance will continue to be paid for periods of overtime worked while restricted. Restriction Allowance is not payable to an employee while they are on leave. The Commissioner will approve the payment of overtime meal allowance to an employee who works approved overtime before or after ordinary hours or for a period not continuous with their ordinary hours where the overtime worked is up to the completion of, or beyond, a meal period specified below:
RESTRICTION DUTY. ‌ 24.1 You will be paid a restriction allowance of $3.50 (Monday to Friday) and $5.09 (Saturday, Sunday and public holidays) for each hour, or part thereof, you are restricted. 24.2 For the purposes of this clause: (a) you are restricted if we require you to be immediately contactable and available to work outside your ordinary hours of duty; and (b) you are contactable and available if you are: (i) contactable by telephone; and (ii) fit, ready and able to return to work within a reasonable time of being contacted.

OVERTIME MEAL ALLOWANCE The Secretary will approve the payment of an overtime meal allowance to an employee who works approved overtime before or after ordinary hours or for a period not continuous with ordinary/regular hours of work/duty, i.e. on weekends or public holidays, or outside their regular hours, to the completion of or beyond a meal period with a break for a meal and is not entitled to payment for that break or without a break for a meal over the following meal periods:
RESTRICTION DUTY. Where the Secretary requires an employee to remain contactable and available to perform extra duty outside the employee’s standard hours of duty the employee will be paid a restriction allowance while they are restricted outside the standard hours of duty.
RESTRICTION DUTY. 84.1 Where an APS1 to APS6 employee, GradABS, or EL1 employee who has been restricted under clauses 245.1 to 246.3, is required to perform extra duty in connection with that restriction duty, overtime will be paid.
RESTRICTION DUTY. 43.1 Restriction duty is where the Chief Executive Officer directs an employee to be contactable and available to perform extra duty outside of the employee's ordinary hours of duty. 43.2 Where an employee is so directed, payment will be subject to the restriction being imposed by the prior written direction of the Chief Executive Officer. 43.3 Payment for restriction duty is generally only available to Band 1 and Band 2 employees. In exceptional circumstances, the Chief Executive Officer may authorise payment for restriction duty to Band 3 employees. Any payment for Band 3 employees will be made at the salary rate equivalent to the top of Band 2. 43.4 Where an employee is directed under clause 43.1, he/she will be paid an allowance at a rate equivalent to 10% of his/her hourly rate of salary for Band 1 and Band 2 employees, or the salary rate specified under clause 43.3 for Band 3 staff for each hour so restricted. 43.5 No payment will be made to an employee for any period in which the employee does not remain contactable, or at the required degree of readiness to perform extra duty. 43.6 Where an employee is under restriction and is required to perform extra duty, the relevant overtime provisions will apply. However, where the employee is required to perform extra duty, but is not required to be recalled to the workplace, the minimum period of payment will be one hour. 43.7 The allowance for Restriction Duty is not paid during any period that attracts an overtime payment.
RESTRICTION DUTY. This is clause 57 in the current agreement. Clarification has been provided in clause 62.5(g) to set out that the minimum payment payable in a restriction situation is one hour where the employee is not recalled to the workplace (e.g. takes a phone call).
