Seniority Pool Clause Samples

A Seniority Pool clause establishes a system for ranking or grouping employees based on their length of service with an organization. In practice, this clause is often used to determine the order in which employees are considered for promotions, layoffs, or other employment decisions, with those having greater seniority receiving preferential treatment. By clearly defining how seniority is calculated and applied, the clause ensures fairness and transparency in workforce management, helping to prevent disputes and maintain morale among employees.
Seniority Pool. Employees initially laid off shall form a pool and be ranked in order of seniority. In order of seniority, Employees shall identify and exercise their preference for options described in Article 26.
Seniority Pool. All Local 6070 Bargaining Unit Members in the same shop constitute a seniority pool. 1. For the purpose of implementation of this Agreement, shop shall be defined as follows: a. Seniority Pool. Employees who have received notice of lay off shall form a pool and be ranked in order of seniority. At all times, the most senior employee in the pool is the first to identify their preference for bumping, lay-off or placement; as more junior employees are bumped, they are added to the pool and ranked in order of seniority to identify the order for indicating their preference. (i) A full-time employee who is subject to lay-off or bumped by another employee who has been laid off shall have the right to elect one of the following: (a) accept the lay-off; or (b) bump a full-time employee, subject to and in accordance with the criteria of Article 14.01, who has lesser bargaining unit seniority and who is the least senior employee in the same or lower job grade in the bargaining unit; or (c) to accept placement into a vacancy in accordance with Article 14.04; or (d) bump a part-time employee in Category I or II, subject to and in accordance with the criteria of Article 14.01, who has lesser bargaining unit hourly seniority and who is the least senior employee in Category I or II who is in the same or lower job grade in the bargaining unit; or (e) accept an Employer initiated reduction of hours in their current position. (ii) A part-time Category I employee who is subject to lay-off or bumped by another employee who has been laid off shall have the right to: (a) bump a part-time employee in Category I or II, subject to and in accordance with the criteria of Article 14.01, who has lesser bargaining unit hourly seniority and who is the least senior employee in Category I or II who is in the same or lower job grade in the bargaining unit. (iii) A part-time Category I or II employee who is subject to lay-off or bumped by another employee who has been laid off shall have the right to elect one of the following: (a) accept placement in part-time Category III; or (b) be placed on the recall list for part-time recall in their same or lower category of part-time. (iv) Part-time employees classified by the Employer as qualified may bump qualified or unqualified employees while unqualified employees shall only bump unqualified employees. Employees shall have forty-eight (48) hours to elect one of the above options otherwise they will be automatically laid off and placed on recall.
Seniority Pool. Access to the Seniority Pool for Temporary Full-Time, Auxiliary and Regular Part-Time Employees shall enable such employees to use their accumulated seniority for the purposes of: (a) gaining access, in order of seniority, to the first available opportunities for regular full-time work in the class of Operations Worker II (or such other classes at an equivalent or lower pay rate) within their Branch provided they are qualified to perform the work; (b) distinguishing between equivalently qualified applicants to posted positions within their Branch in accordance with Clause 12.1(a) of the Collective Agreement; (c) being laid off in reverse order of seniority within their Branch provided they are qualified to perform the work; (d) receiving ten (10) working daysnotice of layoff within their Branch or payment in lieu of such notice for the balance of the ten (10) working days (subject to the exceptions listed in Clause 14.1(c) of the Collective Agreement); and (e) being recalled to their own Branch during the one (1) year recall period, in order of seniority, provided they are qualified to perform the work. Note: The offer of short term temporary and/or auxiliary assignments (i.e. up to the equivalent of four (4) weeks or one hundred sixty (160) hours) to employees with access to the Seniority Pool who have been laid off shall not be considered a recall. An employee who accepts such temporary and/or auxiliary work shall not receive a further layoff notice at the conclusion of such work. Employees who decline such work will not be considered to have refused a recall. Employees’ who refuse assignments greater than four (4) weeks or one hundred sixty (160) hours shall be placed at the bottom of the Seniority List for the balance of the recall period. (f) Employees who had previously attained access to the Seniority Pool and subsequently resign and return within one (1) year or change status and work less than twenty (20) hours per week shall be required to work a minimum of one hundred and sixty (160) hours following their rehire or change in status before being reinstated on the Seniority Pool list.

At all times, the Employee with most seniority in the pool will be first to identify her/his preference for available options. As Employees with less seniority are displaced, they will be added to the pool and ranked in order of seniority to identify her/his preferred option.

Seniority Pool. Access to the Seniority Pool for Temporary Full-Time, Auxiliary and Regular Part- Time Employees shall enable such employees to use their accumulated seniority for the purposes of: (a) gaining access, in order of seniority, to the first available opportunities for regular full-time work in the class of Operations Worker II (or such other classes at an equivalent or lower pay rate) provided they are qualified to perform the work; (b) distinguishing between equivalently qualified applicants to posted positions in accordance with Clause 12.1(a) of the Collective Agreement; (c) being laid off in reverse order of seniority within the Work Location to which they are assigned provided they are qualified to perform the work; (d) receiving ten (10) working daysnotice of layoff in their Work Location or payment in lieu of such notice for the balance of the ten (10) working days (subject to the exceptions listed in Clause 14.1(c) of the Collective Agreement); and (e) being recalled during the one (1) year recall period, in order of seniority, to any of the Work Locations listed below, provided they are qualified to perform the work. (g) Employees who had previously attained access to the Seniority Pool and subsequently resign and return within one (1) year or change status and work less than twenty (20) hours per week shall be required to work a minimum of one hundred and sixty (160) hours following their rehire or change in status before being reinstated on the Seniority Pool list.
Seniority Pool. All employees holding the same job classification, who are qualified to work in a particular Job Code, shall constitute a seniority pool for that Job Code.‌

  • Seniority Roster The District shall maintain an updated seniority roster, indicating employee's class seniority and hire date seniority. Such rosters shall be available to CSEA.

  • Seniority Rosters The Employer agrees to furnish the Union each January 31 and July 31 with rosters of all employees who accrue seniority, their current and prior classifications, and start date in each classification and University start date per Section 1. Employees who have accepted positions outside the bargaining unit do not accrue class seniority in the bargaining unit when employed in positions outside the bargaining unit, but retain prior seniority earned in the bargaining unit. When two (2) or more employees have the same classification seniority date, ties shall be broken by recognizing the employee with the greater University seniority first. If a tie still continues, the employee's seniority position shall be determined by lot.

  • Seniority Date Employees shall acquire seniority upon completion of the probationary period as defined in Article XIII and upon acquiring seniority, the seniority date shall relate back to the first date of continuous service in the bargaining unit. If more than one employee commences work on the same date, lot shall determine seniority ranking for such employees. A District-Wide seniority list will be provided for the exclusive representative no later than November 1 of each year.

  • Seniority Retention Laid off employees shall retain their seniority accumulated up to the time of layoff as follows: (a) If laid off after three (3) months’ continuous employment – up to three (3) months; or (b) If laid off after twelve (12) or more months’ continuous employment – up to one (1) year.

  • Seniority List The Employer shall maintain a seniority list showing the date upon which each employee's service commenced. An up-to-date seniority list shall be sent to the Union and posted on all bulletin boards in January of each year.
