TEMPORARY ALTERNATIVE DUTY. In accordance with the provisions of RSA 281-A: 23-b, the Town will provide temporary alternative work opportunities for employees who suffer a work-related injury or illness. When practicable, employees will be returned to their regular duties with modifications consistent with a healthcare provider’s stipulated work restrictions. In the event that such restrictions make it impracticable for an employee to perform his or her normal job duties, even with modification, the employee may be reassigned to different duties or a different work schedule and may include assignment to a different department with the Town.
TEMPORARY ALTERNATIVE DUTY. (A) In compliance with RSA 281-A:23-b, the Chief of Police, under delegation of authority from the Commission, may provide temporary alternate duty assignments (light duty) for injured employees. (B) Employees covered by this working agreement who have been on authorized leave due to illness or injury, may request a light duty assignment. The officer must provide management with a release from his or her physician utilizing the State forms outlining the duties that can and can not be performed. The officer will return to a light duty assignment within the sworn service of the Police Department. Said assignments shall be in accordance with the following: 1) PATROL DIVISIONEmployees assigned to the patrol division who request light duty in accordance with this section, may work light duty assignments within the patrol division, and will have the same work schedule, subject to authorization from his/her physician and the availability of a light duty assignment. The Department will make a reasonable attempt to insure that the Officer's days off and hours of light duty will coincide, to the extent possible, with the officers selected shift he/she selected pursuant to the "Shift Pick". If an officer can not be assigned to his/her previously selected shift due to the lack of light duty work, the Department shall consider the officers individual circumstances in making a light duty assignment. 2) SPECIAL DETAILS — Officers assigned to Special Details may perform light duty that is consistent with "Special Detail" assignments. (Amended: July 19, 2004) 3) ADMINISTRATIVE ASSIGNMENTS — Officers assigned to administrative assignments may perform light duty that is consistent with such assignments. (C) Nothing in this agreement shall be construed as conflicting with the injured leave section of the contract. (D) It shall be entirely optional for employees with non-work related injuries or illnesses to accept a light duty assignment. It is the sole discretion of the Chief of Police whether or not to offer a light-duty assignment to officers who are injured off-duty. Officers who return to a light- duty position due to an off-duty injury will receive compensation for the hours worked. TEMPORARY ALTERNATIVE DUTY. EMPLOYEE(S) who are temporarily disabled by injury or illness are obliged to return to temporary alternative duty within the Divisions of the Fire Department on one of the above work schedules as designated by the Fire Chief or their designee provided: 1. They have been released to work by their treating physician. 2. Their physician prescribed work conditions can be met within the limits of reasonable accommodation by the EMPLOYER. Firefighters assigned to light duty shall be assigned to the same shift as their assignment before the injury, subject to the limitations in Paragraph 2 (a) above. (7). The Fire Chief may require a firefighter to be examined by the Work Performance Center anytime after four weeks if the Chief has a concern that the firefighter is fit for regular duty. TEMPORARY ALTERNATIVE DUTY a. An injured employee is responsible for notifying the workers’ compensation coordinator and/or medical case manager immediately if his/her injury involves any time loss from work or work restrictions. b. Prior to reaching Maximum Medical Improvement (―MMI‖), if eligible and if the restrictions permit, an employee may be offered temporary alternative duty if available, not to exceed ninety (90) days from the date of injury. ―Temporary Alternative Duty‖ assignments may be available from the first date of injury. c. Temporary alternative duty assignments generally shall be outside the employee’s department. In fulfilling the tasks of the temporary assignment, the employee will not displace any other employee and will not fill any complete regular position or job description. The employee will usually fulfill various discreet tasks involving limited and temporary work available from time to time in various departments. The tasks assigned will generally require the employee to work in different departments from week to week, day to day, or hour to hour. d. Any time off work must have written physician approval. e. Failure to accept a written offer of ―Temporary Alternative Duty‖ may result in suspension of salary/benefits per Colorado law. f. Employees will continue to be subject to performance expectations, and principles and guidelines while participating in the ―Temporary Alternative Duty‖ Program.
