WORK HOURS PER DAY. 1. Eight (8) hours per day shall constitute a day's work and forty (40) hours per week, Monday to Friday, inclusive, shall constitute a week's work. The regular starting time shall be eight (8:00) A.M., and the regular quitting time shall be four thirty (4:30) P.M.; lunch time shall be twelve (12:00) noon to twelve thirty (12:30) P.M. 2. When shifts are required, the first (1st) shift shall work eight (8) hours at the regular straight- time rate. The second (2nd) shift shall work eight (8) hours at the regular straight-time rate, plus a $2.00 per hour shift additive. The third shift shall work eight (8) hours at the regular straight- time rate, plus a $2.25 per hour shift additive. A thirty (30) minute lunch period shall be mutually agreed upon by the Job Superintendent and the Union Representative and shall not be considered as time worked. 3. All time worked before and after the established work day of eight (8) hours, Monday through Friday, shall be paid at the appropriate overtime rate. All work commencing with the beginning of the established work day on Saturday shall be paid at the rate of time and one-half (1 ½). All work commencing with the beginning of the established work day on Sundays and/or Holidays shall be paid at the rate applicable in the appropriate local agreement, not to exceed double-time. 4. By mutual consent of the Employer and the Union, the starting and quitting times of any shift, including day work, may be changed for all or any portion of a particular job. For the purpose of this Article, the standard work day of eight (8) hours for the job or portion thereof to which any such change of starting time applies shall begin with such agreed starting time. 5. Employees shall be at their posts prepared to start work at the regular starting time. 6. Local labor agreement provisions regarding minimum number of days to establish shifts or shift starts are waived for work performed under this Agreement. 7a. The Employer may establish a four (4) day, ten (10) hour shift exclusive of the thirty (30) minute unpaid lunch period at the straight time rate. The starting time shall be between 7:00 A.M. and 8:00 A.M. Forty (40) hours per week shall constitute a week's work Monday through Thursday. WORK HOURS PER DAY. A. In order to take advantage of daylight hours, weather conditions, shift, or traffic conditions, the EMPLOYER, if agreeable among the crafts involved, may elect to work eight (8) consecutive hours between the hours of 6:00 a.m. and 4:30 p.m. with a one-half (½) hour unpaid lunch period between the fourth and fifth hour after starting time. Notice of a change in starting time must be given forty-eight (48) hours in advance and all employees of the Employer on the job site shall have the same starting time, except when other arrangements are mutually agreed to between the employer and the business manager. All time worked before the established starting time and after quitting time shall be overtime and shall be paid for at the overtime rate provided for in this Agreement. Further, if an employee worked during the established lunch period, (s)he shall be paid at the overtime rate provided for in this Agreement. B. Employees who are required to work in excess of ten and one-half (10½) hours will be allowed an additional dinner period with pay. C. By mutual agreement between the UNION and the EMPLOYER, a work week consisting of four (4) ten (10) hour days may be utilized on a project. (1) The work day shall consist of ten (10) hours worked between the hours of seven o'clock (7:00) a.m. and five-thirty (5:30) p.m., including lunch. The starting time may be changed by mutual agreement. (2) The work week shall consist of four (4) ten (10) hour days commencing Monday and ending Thursday. (3) All hours worked in excess of ten (10) hours per day, Monday through Thursday, shall be paid at the rate of time and one-half (1½) the regular rate of pay. In the event any other craft is receiving overtime rate of pay, the Ironworkers will also receive the appropriate rate of overtime pay. (4) In the event that weather conditions or other acceptable conditions to the UNION, prevent work from being performed on a regular workday, then Friday shall be considered a regular workday (minimum of 8 hour schedule) at the straight time rate of pay only to attain forty (40) hours per week. All other hours after forty (40) will be paid at time and one-half (1½). Any work performed on Saturday will be paid at the time and one-half (1½) rate of pay. They shall remain at their place of work under the supervision of their Employer until the scheduled quitting time. There shall be no practices that result in starting work late at the beginning of a shift or after lunch or in stopping work early at lunch time or prior to the scheduled quitting time. The parties are in accord that the intent of the Agreement is “a fair day’s work for a fair day’s pay,” and the Project should be operated and managed in such a manner to enable the Employers to maintain increased efficiency consistent with fair labor standards.
