ARTICLE JOB POSTING. Where a permanent vacancy occurs in a classification within the bargaining unit or a new position within the bargaining unit established by the Hospital, such vacancy shall be posted by the Hospital for a period of five days excluding Saturday, Sunday and holidays. The posting shall stipulate the qualifications, classification, rate of pay, department and shift and a copy shall be provided to the Chief Xxxxxxx. All applications are to be made in writing within the posting period. Vacancies created by the filling of a posted vacancy need not be posted, however, consideration for such subsequent vacancies will be given to employees in this bargaining unit who have a request for transfer on file. Such requests will be considered as applications for posted vacancies as well as subsequent vacancies. The maximum number of positions to which an employee may request a transfer at any one time is four Requests for transfer shall become active upon receipt and must be renewed during the month of January of each year to remain so. Employees shall be selected for positions under either Article or on the basis of their ability, experience and qualifications. Where these factors are relatively equal amongst the employees considered, seniority shall govern providing the successful applicant, if any, is qualified to perform the available work. The name of the successful applicant will be posted on the bulletin board and unsuccessful applicants will be notified. Where there are no successful applicants from within this bargaining unit positions referred to in Article and employees in other service units at the Hospital will be considered for such positions prior to considering persons not employed by the Hospital. The employees eligible for consideration shall be limited to those employees who have applied for the position in accordance with Article and and selection shall be made in accordance with Article above. Vacancies which are not expected to exceed six ( 6 ) months will not be posted and may be filled the discretion of the Hospital. In filling such vacancies consideration shall be given to part-time employees in service bargaining units who have recorded their interest in accordance with above, prior to considering persons not employed by the Hospital. During that period any employee who has completed the probationary period may apply in writing for the posting. A copy of job will be given to the Chief Xxxxxxx. Only employees with or more years of seniority can apply for lateral or lower level job vacancies.

ARTICLE JOB POSTING. Where a permanent vacancy occurs in a classification in the bargaining unit, the Employer will post a notice of such vacancy for seven working days in all Nurses shall submit written applications for the vacancy within the period indicated on the notice. Nurses shall be selected for posted positions on the basis of their skill, ability, experience, qualifications, and education established by the Employer. Where these factors are equal amongst the nurses considered, the senior applicant will be given preference provided that the successful applicant, if any, is qualified to the available Should there be no suitable from within the bargaining unit, the Employer may hire a nurse from outside the bargaining unit. Nurses from within the bargaining unit shall be given the first opportunity to fill temporary full-time they are qualified to perform the work in question. The Employer will outline the conditions and duration of such vacancies.
ARTICLE JOB POSTING. It is mutually agreed that notices within the scope of the bargaining unit of any vacancy as a result of death, retirement, resignation, promotion, demotion or termination of employment or any new jobs created, shall be posted on all bulletin boards for a of seven (7) days. It is understood that with the knowledge of the Union Committee Chairperson, the Employer may temporarily fill the vacancy during the posting. Employees shall have the right to bid during such seven (7) day period on any such vacancy or new job created. Such vacancy or new job created shall be filled from the applications received on the basis of seniority provided the senior employee possesses the necessary qualifications and ability to perform the work required. In the event the successful applicant within thirty (30) working days of commencing work in the posted position or such longer period as may be mutually agreed upon in writing, proves unsatisfactory or requests a return to his former position, he shall be returned to his former position without loss of seniority. If no applications to fill such vacancy or new job created are received from employees, then the Employer will fill the vacancy or new job created in any manner it sees fit. The Employer agrees to post on the Union bulletin boards the outcome of all job Where an employee has successfully bid for a job posting involving interdepartmental transfer and qualified under Article no further bid for interdepartmental transfer will be considered for a month period. It is understood a successful applicant for an interdepartmental transfer cannot bid back on a vacancy resulting from the original job posting.

ARTICLE JOB POSTING. The Company and the Union agree that promotions and transfers to higher paid jobs or to better jobs with equal pay will be based primarily on the skill, ability, experience, qualifications and seniority of the employee concerned. Where the skill, ability, experience and qualifications are relatively equal, seniority shall govern. The Company agrees not to discriminate against present employees who have not been trained, (i.e. if a job is posted, the Company will not take the position that only trained employees may qualify). When selecting applicants the Company and the Union shall compare employees on the same basis for the same job and provide the with the comparison if requested in a dispute.
