Health and Hardship Leave a. At the discretion of the District, a unit member may be granted a leave of absence not to exceed one (1) calendar year without pay for health reasons. Unit members may apply for an extension of this leave. b. At the discretion of the District, unit members may be required to furnish a physician's statement or other acceptable proof to substantiate sick leave need or leave of absence for reasons of health. c. Reinstatement after health and hardship leave: Upon returning from a leave of absence, the unit member shall be reinstated to his/her original position if arrangements have been made and stipulated in writing at the time of leave. Otherwise, a person returning from leave of absence shall be eligible for reassignment, within the same classification. d. For purposes of retirement, long-term leaves of absence shall not be considered as a break in service.

Health and Hardship Leave. A bargaining unit member, whose personal illness extends beyond the period covered by accumulated sick leave shall be placed on a health and hardship leave for the period of time necessary for complete recovery, but not to exceed one (1) calendar year from the date of inception of the illness or disability. Health and hardship leaves shall be without pay, however, the bargaining unit member shall continue for the remainder of the bargaining unit member’s workyear to accrue seniority and experience credit toward any salary increments. a. Upon recovery, the bargaining unit member shall be required to submit a physician’s statement attesting to the bargaining unit member’s ability to fully perform the duties of his/her position. b. The Board reserves the right to require, at its expense, an examination by a physician of the Board’s choice. In the event of a conflict between the bargaining unit member’s physician’s statement and the Board’s physician’s statement regarding the bargaining unit member’s fitness, the statement of the Board’s physician shall be controlling. c. In the event the bargaining unit member presents acceptable evidence of recovered health within one (1) year from the last day worked, the bargaining unit member shall be reinstated to the same or an equivalent position. d. Should the illness or disability be of such an extent that the bargaining unit member is unable to present acceptable evidence of recovered health within one (1) year, the bargaining unit member may be re-employed at the discretion of the Board.

The Board may grant a leave of absence for not more than one (1) year without compensation to any personnel member who is unable to perform his/her regular duties for an extended period of time because of personal illness, accident, or equally grave emergency, provided written request for such leave of absence is submitted by the personnel, and provided a written certification of illness is received from a physician for a health leave. 2. In computing service to determine said personnel's salary at expiration of leave, time spent on leave shall not be counted as active service. Personnel must provide a statement from a licensed physician as evidence of recovered health before being permitted to return to duties in the Okemos Schools. Returning personnel shall be given the same classification and salary step as they had at the time leave was taken, but shall be granted such increase or decrease as pertaining to that same classification and salary step provided by the new salary schedule.

Should the illness or disability be of such an extent that the bargaining unit member is unable to present acceptable evidence of recovered health within one (1) year, the bargaining unit member may be re- employed provided there is a vacancy for which the bargaining unit member is certified and qualified at the time of recovery. f. The Board reserves the right to fill a position which is vacant due to health and hardship with a long- term substitute. g. A bargaining unit member on a health and hardship leave may be eligible for the benefits under a Family Medical Leave.
Health and Hardship Leave. A. Any driver whose personal illness extends beyond the period covered by accumulated sick leave maybe placed on the health and hardship leave for a period of time necessary for complete recovery, but not to exceed the balance of the current school year. Renewal of the leave shall be at the discretion of the Board. B. Upon recovery, the driver shall be required to submit a physician’s statement attesting to the driver’s ability to fully perform the duties of one’s position, subject to Article XVII, Section 5. C. Upon granting of the leave, the Board shall specify the beginning and ending dates of the leave. D. Drivers who have been on health and hardship leave at the end of a school year may be granted an extension of that leave if they are physically unable to return to work at the beginning of the following school year. If granted, the leave extension under this provision shall extend one (1) calendar year beyond the beginning date of the original health and hardship leave. Drivers returning from health and hardship leave within the same school year that the disability occurred shall be reinstated in position. Drivers who have requested an extension of the health and hardship leave may return upon submitting a physician’s statement as provided for in Section 1.B. Senior drivers may bump into the least senior driver’s regular run and Kindergarten run if they had one before going on sick leave.

Upon recovery, the bus driver shall be required to submit a physician’s statement attesting to the bus driver’s ability to fully perform the duties of his/her position, subject to Article XXIII, Section 5 below.

Health and Hardship Leave. Any custodian whose personal illness, including pregnancy, extends beyond the period covered by accumulated sick leave and vacation leave (if the employee chooses to use vacation) shall request in writing an unpaid health and hardship leave. The custodian shall be placed on a health and hardship leave for the period of time necessary for complete recovery, but not to exceed one calendar year from the beginning of the health and hardship leave. Upon recovery, the custodian shall be required to submit a physician’s statement attesting to the custodian’s ability to fully perform the duties of their position. The Board reserves the right, at its option, to require an examination by a physician of the Board’s choice at its expense. In the event of a conflict of a custodian’s physician’s statement and the Board’s physician’s statement regarding the custodian’s fitness to return, the opinion of Board’s physician shall be controlling. In the event the custodian presents acceptable evidence of recovered health as provided above within one year from the commencement of the health and hardship leave, the custodian shall be returned to the same position from which the leave was taken if such position exists, or, if such position has been eliminated, to an equivalent position for which qualified. In case of reduction in staff during the period of such leave, the provisions of Section 6.1 shall prevail. Should the illness or disability be of such an extent that the custodian is unable to present acceptable evidence of recovered health within one year from the commencement of the health and hardship leave, the custodian may be re-employed at the discretion of the Board providing a vacancy for which the custodian is qualified exists at the time of recovery. The Board shall have the right to fill the position during the leave with a long-term substitute. A custodian on a health and hardship leave may be eligible for benefits under a Family Medical Leave in this Section
Health and Hardship Leave. A leave of absence for temporary illness, not to exceed a period of two (2) school years, may be granted to teachers with at least two (2) consecutive school years as a full-time teacher. The leave shall be without salary or benefits, but the recipient may elect to continue membership in the District group insurance programs at his/her own expense. Upon request for reinstatement by the teacher by March 1 of the last year of said leave, accompanied by proof of physical fitness, the teacher shall be reinstated at the beginning of the next school year, or by mutual agreement during the school term, at the same relative position in the salary structure which he/she held at the time the leave became effective, subject to any interim general increases or decreases of the salary structure. A non-tenured teacher on leave in accordance with this section will not receive service credit for purposes of fulfilling the requirements delineated under Section 24-11 of the School Code for tenure acquisition; provided, however, that such leave shall not constitute a break in consecutive years of service to the extent permissible under Section 24-11 of the School Code.
