LEAVE OF ABSENCE WITHOUT SALARY.
20:01 A member may apply to the Xxxxxxx for, and may be granted, a leave of absence without salary for a mutually agreed period. The Xxxx and Head (in the case of librarian members, the University Librarian or Law Librarian as appropriate and the Associate University Librarian) shall provide the Xxxxxxx with letters of appraisal of the member's application, which shall not be deemed confidential. The parties, however, recognize that such leave should be mutually beneficial to the member and the University, and the parties recognize further the responsibility of the University for ensuring the uninterrupted continuation and quality of program(s) of the University in which members are involved, and, in the light of this objective and responsibility, leave under this Article shall not be withheld unreasonably. A member on leave under this Article 20 shall be entitled at her/his sole expense to participate in any or all of the University's fringe benefit Plans (including the University Retirement Plan) for members from time to time in force if and so long as such plans permit. A member may terminate her/his leave and return to the University at the beginning of any academic year or at the beginning of the second (2nd) semester, if written notice of her/his return is given to the Xxxx and Head (or in the case of librarian members the University Librarian or Law Librarian, as appropriate) prior to the assignment of teaching responsibilities (or in the case of librarian members, workload assignments) for the semester in which they intend to return, or by mutual agreement.
LEAVE OF ABSENCE WITHOUT SALARY. 10.05.1 Leave of absence without salary may be granted to an Employee at any time at the discretion of the President in accordance with the procedures outlined in Articles 10.05.6, 10.05.7 and 10.05.
LEAVE OF ABSENCE WITHOUT SALARY. Upon recommendation of the President, which recommendation shall not be unreasonably withheld, leave of absence without salary may be granted by the Board for a period not to exceed two (2) years, except that upon establishment of actual disability such leave shall be granted. Faculty members shall be eligible for leave of absence without salary after two years of full-time service on non-tenured appointments, except that a leave for educational advancement may be granted after one year of service and a Parental leave, as defined in Section 18.7.2., below shall be granted after six months of service. The terms and conditions of such leave of absence shall be agreed upon by the college President and Faculty member concerned. The Faculty Member may be represented by the Federation. Such agreement shall be subject to the approval of the Board and shall be in writing.
LEAVE OF ABSENCE WITHOUT SALARY. The purpose of leaves of absence without salary is to allow the teacher to pursue opportunities directly related to current or potential educational responsibilities. Leaves of absence without salary may be granted to certified staff members by the Board of Education upon the recommendation of the Superintendent of Schools, subject to the following:
a. Employees who have completed five (5) full years of service in the system may apply for a school year's leave of absence (September 1 through August 31).
b. Leaves without salary may be taken for a full school year or for either the first half or the second half of the school year.
c. No employee shall be granted a school year leave of absence without pay more than once in any five (5) year period.
d. Applications must be submitted, in writing, to the Superintendent of Schools prior to February 1 of the school year for which the leave is being requested. Applicants need to give reason(s) for which leave of absence without salary is requested.
e. Leaves of absence without salary may be recommended by the Superintendent. Successful applicants will be notified, in writing, no later than March 1.
f. Requests for leave may be withdrawn by the applicant no later than April 1 or 30 calendar days after Board grants the leave, whichever is later.
g. Employees granted a school year's leave of absence without salary shall be permitted to continue insurance benefits to which they are entitled at the time of application. Employees must assume 100% of the costs of these benefits.
h. Employees on leave may make voluntary contributions to the retirement plan in accordance with state law.
i. Any employee on leave of absence without salary shall inform the Superintendent of Schools, in writing, by registered mail, no later than February 1 of the year of the leave of his/her intention to return as of the beginning of the following school year. Failure to inform prior to February 1 of the intent to return shall be construed as a resignation from employment.
j. Salary scale credit for the year of absence is at the discretion of the Superintendent of Schools.
k. While on leave of absence, an employee is subject to the same reduction in force possibilities and provision as though he/she were on active service.
l. A teacher returning from a leave of absence without salary shall be guaranteed a position for which he/she is certified and qualified.

LEAVE OF ABSENCE WITHOUT SALARY. 10.05.1 Leave of absence without salary may be granted to an Employee at any time at the
LEAVE OF ABSENCE WITHOUT SALARY. A full leave of absence without salary or a partial leave with pro-rated salary may be agreed upon by the Corporation and a member at any time. Permission for such leave shall not be unreasonably denied by the Corporation. In the event of denial the member will receive a written statement of reasons for the denial within thirty (30) days of application for leave. Leave of absence without salary shall not normally extend beyond three (3) consecutive years, except as provided for in Article 10.24 above. Members on leave without salary shall continue to be members of the bargaining unit.
LEAVE OF ABSENCE WITHOUT SALARY. Faculty Members
(a) Leave of absence without salary is not sabbatical leave and may be granted at any time by the Academic Vice-President on the recommendation of the appropriate Xxxx. The Faculty Member shall make his/her request, in writing, specifying reasons and requested duration, to his/her Department Chairperson not later than December 1st of the academic year preceding that in which leave is requested to begin. The Department Chairperson shall forward the application, together with the Department's written recommendation to the Academic Vice-President through normal channels, within fifteen (15) days of receipt of the application. The Academic Vice-President shall give a written decision within thirty (30) days of his/her receipt of the application. These dates may be varied by mutual agreement. The Academic Vice President shall consult with the Department prior to making a decision which is contrary to the Department's recommendation. In the event the Academic Vice-President's decision is negative, he shall communicate written reasons for his decision to the applicant.
(b) Leave of absence without salary may be sought for further studies, research, public service, or for other reasons which the faculty member shall specify and which the Academic Vice-President may accept. Except for the leaves provided in 19.5, or in exceptional circumstances such leave shall not exceed three (3) years.
(c) An Employee on leave of absence without salary shall be entitled to participate in University benefit plans from time to time in force, subject to University policy and provided the plans so permit.
LEAVE OF ABSENCE WITHOUT SALARY. Faculty Members 19.8 Leave of Absence Without Salary - Professional Librarians
LEAVE OF ABSENCE WITHOUT SALARY. In cases not covered by this agreement, a regular Member who, for valid reasons, wishes to obtain an unpaid leave must make a written application to the University Librarian. The Corporation will not refuse such a leave without a valid reason. The duration of an unpaid leave will not generally exceed a twenty-four (24) month period. Except in the case of agreement or provision to the contrary, a Member on unpaid leave is not entitled to the benefits described in this agreement, however, if the Member requests to continue their Health benefits and pension plan for the duration of their unpaid leave, the Member will be required to pay the Employee contributions for both programs and the Corporation will continue to pay the Employer contributions.
LEAVE OF ABSENCE WITHOUT SALARY. Leaves of absence without salary shall commence on July 1 or January 1, shall be for a period of either 6, 12, 18 or 24 months, shall not extend beyond two (2) consecutive years nor exceed the equivalent of 24 months during a member's career at the University. The Corporation shall approve request(s) for leave without salary consistent with the above paragraph, provided that Members provide at least three months notice in writing of their request(s). All letters concerning leaves issued by the Corporation to Members shall be copied to the Association. Exceptionally, and subject to the positive recommendation of the Evaluation Committee, a Member who will be returning to the University may be granted a leave of absence by the Corporation in order to pursue professional opportunities. Time away from the University on such a leave would not be subtracted from the member's regular allotment of 24 months.
