NEW AND VACANT POSITIONS. 4.01 All new and vacant in-scope positions shall be filled in accordance with the terms of the Collective Agreement and that bargaining unit, unless otherwise mutually agreed between affected employers and affected bargaining units/unions. 4.02 When a new or vacant in-scope position is not filled by an internal employee as specified in 4.01, the receiving facility within a region, as defined in Appendix VII, shall give preferential consideration to qualified applicants from the same region who are on the Central Redeployment List. If there are no applicants/no qualified applicants from the same region, the receiving facility shall provide preferential consideration to qualified applicants from other regions who are on the Central Redeployment List. The following provisions shall apply in filling the vacancy: (a) Employees on the Central Redeployment List shall be listed in order of seniority [as per "sending" Collective Agreement(s)]; (b) subject to 4.01, selection shall be made from applicants on the Central Redeployment List as described above. Copies of the above- mentioned new or vacant in-scope position postings will be sent as they occur to the MCHCU and participating employers (process to be established); (c) seniority shall be applicable to the selection in accordance with the receiving Collective Agreement; (d) in assessing an employee's history only formally documented material contained in the employee's personnel file will be considered; (e) receiving facilities job description applies vis-a-vis qualification requirements; (f) Once an employee has been permanently redeployed and has completed the trial period with a receiving employer, she/he shall relinquish any recall rights to her/his former employer unless she/he is laid off from the receiving employer. Should an employee be laid off from the receiving employer, she/he will be placed back on the recall list with the sending employer for the balance of time she/he would have been on the recall list. She/he will also have recall rights in accordance with the Collective Agreement of the receiving employer and be placed back on the Central Redeployment List. For the purposes of the Central Redeployment List, an employee's seniority shall be the cumulative seniority from the original sending employer and the original receiving employer.

NEW AND VACANT POSITIONS. New positions are those which did not previously exist within the District and vacant positions are those created by resignations, retirements, non-renewals, or dismissals for cause, and both new and vacant positions refer to positions approved by the Board. When filling new and vacant positions, the District shall take into consideration certifications, qualifications, merit and ability, including performance evaluations, and relevant experience. When these factors are equal, the District shall base its decision on the length of continuing service with District. The District’s decision to select a particular candidate to fill a new or vacant position is not subject to review under the grievance procedure in this Agreement.

Such notice shall be posted in all five schools sufficiently in advance of filling the position to allow bargaining unit members an adequate opportunity to apply. A copy of said notice shall be mailed to the Congress. 2. The Board, or its representatives, before acting to fill a new position to commence in September, or a position to become vacant in September, shall post a notice indicating the nature of the position. Such notice shall be posted in all schools within a reasonable period of time after notice of the position comes to the attention of the Superintendent.

NEW AND VACANT POSITIONS. A. All hiring of certificated/licensed employees for the District shall be by the Board upon the recommendation of the Superintendent. An attempt will be made to hire the most qualified individuals available. B. A new and/or vacant position exists when the Board determines it is necessary to create a new position and/or elects to fill a vacant position. The filling of such position will be consistent with Article III, Section 3.03 (Recall) of this agreement. C. Newly created certificated/licensed positions which fall under the terms of this agreement, or vacancies in existing positions which fall under the terms of this agreement, shall be posted for seven (7) school days prior to filling the position. Said postings shall be in the form of "Notices of Vacancy" and shall be posted on the bulletin board in the faculty lounge. During the summer months, the Association President shall receive a copy of the notice on or before the date of posting. D. Notices of Vacancies will set forth the department, grade level, building, subject(s) to be taught, certification/licensure required, job descriptions, qualifications, conditions of employment, and procedure for making application for the new or vacant position. E. Notices of Vacancies which occur in the summer months (end of school through start of next school year), shall be emailed to all members of the bargaining unit who have email service and direct mailed to all others. F. In the event a vacancy occurs during the summer recess, said position may be filled ten (10) days from the date of posting, excluding Saturdays, Sundays and legal holidays. In the event a position becomes vacant less than twenty (20) days prior to the first day of school, the posting period shall be five (5) days. The purpose of this provision is to provide members of the Association the opportunity to apply for vacancies. G. Candidates from within the District, who meet the certification/licensure requirements and express an interest in a new or vacant position, will be interviewed by the administration and then considered on an equal basis with other applicants. H. Unit members shall not be transferred involuntarily to a new or vacant position, nor will there be any involuntary transfers from one building to another.

All in-scope employees will be notified via the Authority’s e-mail system to the extent possible.
