Operation and Maintenance (O&M. (a) Within the O&M category, the funds shall be available as follows, except as provided in Sections 4970.15.1(c):
(1) At least seventy percent (70%) for GO,
(2) At least ten percent (10%) for Development,
(3) At least ten percent (10%) for planning, and
(4) At least ten percent (10%) for acquisition.
(b) A panel of not less than three (3) individuals shall score each Application deemed compliant with these regulations. The panel shall use the Applicant’s responses to general criteria and Project-specific criteria to determine a Project score. The steps for determining the final score are as follows (see Table 4 for an example):
(1) Calculate the sum of the points received on the general criteria and the points received on the Project-specific criteria. Divide that number by the sum of the total possible points for the general criteria and the total possible points for the Project specific criteria, and
(2) Convert the result of the calculation to a percentage which is the final score.

(c) Eligible Projects shall be ranked by score. Projects shall be funded in order of score from highest to lowest until available funds are exhausted, taking into account the Project type funding restrictions in Section 4970.15.1(a). If there are not sufficient funding requests to consume the percentages specified in Section 4970.15.1(a)(1-4), the other O&M sub-category Projects shall receive funding in order of score.
(d) In the event Projects have the same score, Projects will be funded in the order of request amount starting with the smallest request amount. If more than one Project has the same request amount, the OHMVR Division will utilize a "random selection" method to break ties and determine which Project will receive funding.
(e) Projects at the funding cut-off line may require modifications to the Project Description and Project Cost Estimate to reflect reduced available funding. The modification shall be completed prior to the OHMVR Division preparing and executing the Project Agreement. Note: Authority cited: Sections 5001.5 and 5003, Public Resources Code. Operation and Maintenance (O&M. The sponsors will be responsible for the operation, maintenance, and any needed replacement of the works of improvement by actually performing the work or arranging for such work, in accordance with an O&M agreement. An O&M agreement will be entered into before Federal funds are obligated and will continue for the project life ( years). Although the sponsors’ responsibility to the Federal Government for O&M ends when the O&M agreement expires upon completion of the evaluated life of measures covered by the agreement, the sponsors acknowledge that continued liabilities and responsibilities associated with works of improvement may exist beyond the evaluated life.
Operation and Maintenance (O&M. Proponent shall comply with any and all operation and maintenance requirements in accordance with the final RAW, final RAP, or a DTSC-approved RDIP or O&M Plan. If deemed necessary, DTSC may require Proponent to enter into an O&M Agreement with DTSC.
Operation and Maintenance (O&M. During the Operation Period, the Lessee shall operate and maintain the Star Hotel in accordance with this Agreement either by itself, or through the O&M Contractor and if required, modify, repair or otherwise make improvements to the Star Hotel to comply at all times with the provisions of this Agreement, Applicable Laws and Applicable Permits, and conform to Good Industry Practice, applicable Indian laws and directives and for that purpose do all such acts, agreements, requisite arrangements and things necessary and expedient required to be done including but without limitation, as per the provisions of this Agreement.
i) The Lessee as a mandatory condition of this Lease, shall complete Minimum Development Obligations (as mentioned under clause 2.2) on the Project Site within the stipulated time period mentioned therein.
ii) Common Physical Infrastructure, Common Utilities, Common Social Infrastructure including Institutional, Landscaping and Greenery, and other basic infrastructure to be completed within a maximum period of three (3) years from signing of Lease cum Development Agreement to support the Star Hotel as per the provisions of Naya Raipur Development Plan - 2031.
iii) The Lessee shall submit a certificate from an architect approved under Bhumi Vikas Niyam – 1984, in support of the completion of the construction and a certificate cum undertaking in support of the completion and compliance of the constructions and development phase and also obtain classification for Star Hotel from Ministry of Tourism, GoI as per the requirements as set out in this Agreement or directions and observation of the NRDA from time to time, if any at the stages setout herein above
iv) The Lessee shall strictly adhere to the Standards and Specifications issued by the NRDA from time to time during the term of the Initial Lease Period and any extensions thereof. The Lessee shall itself comply and ensure that the Contractors engaged by it comply at all times with the Applicable Laws/Applicable Permits/Approvals.
v) The Lessee shall be responsible for construction and maintenance of necessary hutments for its labour within the site along with providing power, drinking water, sanitation and other facilities at its own cost. The Lessee shall demolish all such hutments and remove the debris from site before completion of project at its own cost.

Operation and Maintenance (O&M. This refers to the operation and maintenance of software beyond the development phase. Under normal circumstances an application is considered complete and no major enhancements are in process. In O&M there may be occasional adjusting of business rules and requirements, troubleshooting and correction, and database maintenance tasks.

Operation and Maintenance (O&M. AHA shall comply with any and all operation and maintenance requirements in accordance with the final Cleanup Plan. If deemed necessary, DTSC may require AHA to enter into an O&M Agreement with DTSC.

The Agency will comply with, or arrange for compliance with, all operation and maintenance (O&M) requirements or other institutional control measures, in accordance with the final RAP or Cleanup Plan. The Agency shall designate in the final RAP or Cleanup Plan the parties that will enter into an O&M Agreement, or otherwise be responsible for compliance with all O&M requirements, prior to certification of the Property or group of Properties. Compliance with any applicable O&M Agreement, and any land use covenant or other institutional control measures, must be included as a requirement for any new owner/lessee in a purchase and sale agreement for the Property or group of Properties. Any party that is responsible for O&M shall notify DTSC of any transfer of operation and maintenance responsibilities at least 30 days prior to such transfer. DTSC may, at its discretion, require the transferee to enter into a new O&M Agreement.
Operation and Maintenance (O&M. 6.2.1 The Concessionaire shall be solely and exclusively responsible for the entire operations and maintenance of the Project Assets during the Concession Period and for provisioning of all Services planned for the Project. The Concessionaire shall operate and maintain the Project Assets and render Services during the Concession Period by itself, or through Contractors, and if required, bring improvements to the Project and the provision of Services to comply with operation & maintenance requirements as may be, from time to time, required by the Authority and other requirements set forth in this Concession Agreement, Good Industry Practice, Applicable laws and Applicable Permits and more specifically:
(i) undertaking routine maintenance in compliance with this Concession Agreement;
(ii) carrying out periodic repairs and preventive maintenance to Project Assets;
(iii) preventing with the assistance of the concerned law enforcement agencies encroachments on the Project including Project Site and preserve the right of way;
(iv) maintaining a public relations unit to interface with and attend to suggestions from users of the Project Hospital, the media, Government Agencies, and other external agencies ;
(v) cleaning and sanitization of the Project Site, Project Hospital, Buildings & Infrastructure and Other Assets and infectious disease control within the Project Site;
(vi) safety and security of persons and property within the Project Site; and
(vii) management and disposal of all medical and other waste produced in the Project Site in compliance with the Applicable Laws.
6.2.2 The Concessionaire shall develop an Operations and Maintenance Manual (O&M Manual) for the hospital which shall contain standard procedures for all activities being carried out in the hospital. This O&M Manual shall be agreed and approved by the Authority within 1 year of the COD. The O&M Manual shall be for the regular and periodic operation, management and maintenance of the Project Hospital and provision of Services.
6.2.3 The Concessionaire shall incorporate suggestions from the Authority in the O&M manual within 2 months of receiving the suggestions and supply one hard copy and one soft copy of O&M Manual to the Authority. The O&M Manual shall be regularly updated to reflect changes in standard practices or incorporation of new standards and new copies shall be developed and provided to the Authority at the start of each new financial year.
