Sick Leave Bank Policy. To assist the licensed teachers who need additional sick leave, a sick leave bank shall be established as follows: a. A review committee of three licensed teachers will grant withdrawals from the bank. There will be three representatives from pre-kindergarten through grade12. One of the committee members may be other personnel (i.e., an administrator or nurse). Licensed teacher representatives shall be approved and/or elected by the Association (see definition pg. 1). b. A licensed teacher will not be able to withdraw from the bank until All current year and accumulated sick leave have been depleted determined by the review committee. (Cut-according to the criteria established by the review committee). c. A licensed teacher can withdraw on their first request up to twenty-one (21) days from the bank. The number of sick leave days granted from the bank shall be determined by the review committee according to criteria established by the review committee. Applicants may reapply according to their need. d. Written application must be made to the review committee and applicants must complete forms and qualify for FMLA except for the requirements for years of service and the minimum number of employee requirements. For purposes of this policy immediate family shall include the list from the definition pg 1. #8. The review committee will file documentation in the Superintendent’s office e. Only licensed teachers who need additional sick leave for themselves or to care for an immediate family member (see definitions, page 1, #8) who is hospitalized or under the care of a physician may apply to use the sick leave bank. f. If, at the end of any school year, the sick leave bank balance of available days is less than 30 days, each licensed teacher with a balance of one (1) or more leave days shall contribute one day of their annual leave to the sick leave bank. g. Any licensed teacher, when leaving the district, may (at their own choice) donate all of their remaining sick leave days to the sick leave bank. h. Any licensed teacher may donate days to the sick leave bank at the end of a given school year if their accumulated leave exceeds 25 days.

Sick Leave Bank Policy a. On the first day of school, one sick leave day shall be deducted from each Town of Xxxx Union Free School District teacher's accumulation or allotment of sick leave days, and these days shall be used to establish a Sick Leave Bank. 1. A maximum accumulation of 200 days will be carried in the Bank. 2. The School District shall appropriate an amount (in addition to regular substitutes) to cover the anticipated expenditure. b. The Bank shall be available to any teacher after he/she has exhausted his/her personal accumulation of sick leave days. I. The Bank shall be governed by a Committee made up as follows: Two (2) members of the teacher bargaining unit appointed by the Association President; two (2) Board of Education members; and the Superintendent of Schools, who has no vole and acts as advisor to the Committee. c. All requests for the use of the Bank shall be submitted to the abovementioned Committee. d. All teachers will come under the Bank after the first day of work. e. A physician's certificate or statement must be presented showing the estimated length of disability. f. The judgment of the Committee shall be allowed to remain flexible enough to cover unusual circumstances, number of days of sick leave bank time allowed, etc. g. The Bank (once accepted by a majority), will be non-voluntary. h. All teachers will cooperate actively with the administration to discourage the improper use of sick, leave.
Sick Leave Bank Policy. It is the understanding and policy of Clinton Community College and Faculty Association to encourage every Faculty Member to recognize leave time as a negotiated benefit, and to utilize such leave for the purpose for which it is intended. It is the further understanding that there may be circumstances in which a full-time Faculty Member would require additional leave time to accommodate a serious illness or temporary disability after exhaustion of all accumulated leave time. It is on this basis, that agreement has been reached to establish a Sick Leave Bank. 1. Sick Leave Bank shall be administered by one representative designated by the Faculty Association President and one representative designated by the President of the College, whose names shall be given to the Human Resource Officer and the President of the Faculty Association, in writing, by September 1st of each year. 2. Each request will be reviewed and a decision will be reached by a majority vote of the Sick Leave Bank Committee (SLB). If there is a tie in the Committee, the parties will treat this as a denial of the request. 3. The Committee’s decision is final and is not subject to appeal or the grievance procedure. 4. The Committee will determine the number of days to be granted, but will at no time allow more than 30 workdays per year. 5. Enrollment in the Bank automatically allows the SLB Committee members to review the applying Faculty Member’s leave time record without further authorization. 6. The Committee shall meet within ten (10) working days from the receipt of the request in the Human Resource Department. 7. The Faculty Member and his/her non-bargaining unit supervisor shall be notified in writing within five (5) working days of the Committee’s determination. 8. Bank leave will be applied in full day increments only.
Sick Leave Bank Policy. The purpose of the Sick Leave Bank is to provide a means of obtaining additional sick leave days to avoid loss of compensation due to a catastrophic illness, pregnancy or injury of the employee sick leave bank member that requires intermittent or continuous absence from work. Catastrophic injury or illness is defined as a life-threatening condition or combination of conditions affecting the mental or physical health of the employee, and includes, but is not limited to, the following: lengthy hospitalizations, necessary surgery requiring a lengthy recovery, an ongoing treatment regimen requiring frequent time off work, or complicated pregnancy requiring bed rest or hospitalization. The catastrophic illness or injury must require services of a health provider. This benefit is available to eligible, voluntarily participating faculty and staff who have legitimately exhausted all of their accumulated sick and vacation leave.

Sick Leave Bank Policy. The Sick-Leave Bank Policy is attached as Appendix F to this Agreement. The Superintendent and/or his/her designee shall be responsible for notifying employees at their date of hire that this benefit is available. New employees shall be provided a form to complete within thirty (30) days of the first day of employment. If the teacher does not choose to join during that first thirty (30) days, he/she shall be precluded from joining the Sick-Leave Bank in the future. The Superintendent shall notify the Federation by October 1 of each year of the names of the members in the Bank. After receipt of these names, the GFT Sick-Leave Bank Committee shall be responsible for approving leave and assisting the District bookkeeper with record keeping. All new teachers shall be eligible to join the Sick Leave Bank during the first thirty (30) days of their initial employment. If teachers do not join during that time period, the individual will be forever precluded from joining the Sick- Leave Bank.

  • Sick Leave Bank The school corporation agrees to, and hereby establishes a voluntary sick leave bank to which certificated persons may contribute unused sick leave days, and from which a contributing individual may draw sick leave days when the individual’s annual and accumulated sick leave days are exhausted, in accordance with the following provisions. Please see the definitions of sick leave under Article IV. 1. The sick leave bank shall apply to all persons employed by the school corporation whose employment requires the holding of a license issued by the Indiana Department of Education, whether or not any such person is a member of the bargaining unit to which this contract applies. 2. A “contributing individual” is one who, within the first thirty (30) days of the contract year, signs a contribution form. Such contribution form shall require the assigning of one (1) day of sick leave to the sick leave bank and an individual may contribute up to five (5) total days if so motivated during any enrollment period. 3. A person shall cease to be a contributing individual upon the failure of such individual to sign such contribution form and such individual shall thereafter not be entitled to draw any sick leave days from the sick leave bank until becoming a contributing member the following year. 4. Present and new faculty members who wish to become “contributing individuals” may do so by following the procedure in paragraph two (2). Staff who hire in after the annual enrollment period closes can still enroll under equivalent timelines as original enrollment period. 5. Use of the sick leave bank shall be subject to the following limitations: a. Sick bank leave shall be used on a teacher’s first day receiving no pay as long as the teacher has exhausted all accumulated sick days, as well as all annual sick and personal days. Days may need to be allotted retroactively to allow time for the sick bank committee to meet and review the request. In the event a teacher on sick bank leave returns to work and then finds it necessary on advice of a doctor to take additional leave for the same disability, no additional days shall be deducted subject to the approve of the Sick Bank Review Committee. b. In the even a teacher is disabled as a result of illness or injury of a different nature during the same school year, any additional sick leave bank time granted is subject to approval of the Sick Bank Review Committee. c. Sick bank leave shall be used for the purposes permitted by the Federal Medical Leave Act (FMLA) and must be supported by a written request by the contributing individual and the appropriate FMLA certification specifying the nature of the illness and prognosis report for the teacher’s return to work. d. Days taken from the sick leave bank shall apply only to those days on which a teacher would receive pay if the teacher were not under disability. e. All contractual leave days shall be waived while drawing pay from the sick leave bank so that a teacher in no case will be drawing double pay for any day. f. This sick leave bank section shall not operate in any manner such that any teacher receiving workers compensation benefits receives more than such teacher’s regular pay. g. Paid holidays, if any, shall not be charged against the sick leave bank, but shall be compensated for under the terms of the teacher’s contract. h. Sick leave bank days shall not be used during summer school employment, nor shall such days be used at any other times except the regular school year. i. Leave from the sick leave bank may not be used for maternity or childbirth leave, but may be used for any physical disability arising out of a pregnancy. j. Teachers who, as of the beginning of the school year in which sick leave bank benefits are requested and used, have accumulated the following number of sick leave days under the sick leave section of this contract, shall be eligible to draw up to a maximum number of days from the sick leave bank in any single year as follows: (1) 0-10: Up to 60 days (2) 11-40: Up to 90 days (3) 41 or over: Up to 120 days k. Teachers may be awarded fewer than maximum days (listed in Section j) at the discretion of the Sick Bank Review Committee. 6. Should the sick leave bank fall to a thirty (30) day balance during a school year, an additional contribution will be requested and will count toward the subsequent enrollment period. 7. A Sick Bank Review Committee shall be formed and shall be comprised of three (3) members appointed by the exclusive representative and one (1) individual appointed by the Superintendent. The committee shall consider and review all requests for use of sick bank days to ensure that all applications submitted, and any grants made, are in accordance with the provisions of this contract. 8. The school district shall notify certificated employees of the enrollment period for the sick bank, including required contribution forms and appropriate deadlines, within the first five (5) school days of each school year. 9. If there are seven hundred and fifty (750) days in the bank at the time of open enrollment, no contribution will be necessary unless it falls below the previously described number of thirty (30) days.

  • Sick Leave Bank Committee The committee shall consist of two members of the administration, appointed by the Superintendent, and two members of the bargaining unit, appointed by the President of the Association. The President of the Association will act as chairperson of this committee and will have no voting power except in the event of a tie vote by the committee.

  • Sick Leave Policy It is the policy of the State of Ohio to not unreasonably deny sick leave to employees when requested. It is also the policy of the State to take corrective action for unauthorized use of sick leave and/or abuse of sick leave. It is further the policy of the State that when corrective and/or disciplinary action is taken, it will be applied progressively and consistently. It is the desire of the State of Ohio that when discipline is applied it will serve the purpose of correcting the performance of the employee.

  • Leave Bank 1. A sick leave bank shall be maintained within the District. The purpose of the Leave Bank is to provide a bank of sick leave days from which staff may draw in cases of extended absences due to illness or injury which renders the staff member incapable of working. 2. The bank was funded initially by a mandatory contribution from each employee of one (1) day from that employee’s individual sick leave account, as well as a 100-day contribution from the school district. 3. The sick leave bank shall be administered by the Superintendent and the Association President(s). 4. For new employees, a mandatory contribution of one (1) day shall be made by them on the day on which their initial individual leave time is allotted to them. Leave days in the bank will carry over from year to year. The bank will contain a maximum of 500 days and a minimum of 250 days. Employees who leave the district, excluding staff who retire under PERA, shall contribute any remaining accrued days to the leave bank. At such time as the bank drops below 250 days, an additional contribution of one (1) day per employee shall be made to replenish the bank’s days at the beginning of the school year 5. Persons who have used all of their leave entitlement shall be eligible to draw from the leave bank under the following condition: a. Only when under a doctor’s care. b. For each first day granted from the leave bank per occurrence the employee shall be docked the current substitute pay. c. For a recurring illness or a medical condition that requires periodic and consistent medical treatment of a severe disablement, Sick Leave Bank Days (in increments of half days) may be granted for all absences resulting from these conditions d. Any individual who is absent as a result of a medically diagnosed catastrophic illness or injury may access the bank for up to and including sixty (60) additional days. Utilization of these days shall require the submission of a new Leave Bank Application to the bank. 6. An individual who meets the requirements stated above can use a total of no more than thirty (30) days per school year from the leave bank. 7. An individual may request days from the Leave Bank any time prior to but within thirty (30) calendar days after the individual returns to work. Applications submitted at a time outside these limits will not be considered by the Superintendent and Association President(s). The request must be submitted to the Superintendent office using the Leave Bank Application. The application can be located in the appendix of this agreement. Upon receipt of the application the Superintendent shall forward the request to the Association President(s). The Superintendent and Association President(s) shall meet, within ten (10) days to consider such request. Within five (5) days following said meeting, the applicant shall be notified, in writing, of the status of the request. 8. Any individual who has accessed the leave bank and resigns their position in the same contract year will be docked their daily rate of pay for each day used from the bank. 9. Elective treatment or surgery is defined as a condition diagnosed by a Doctor that admission sometime in the future is acceptable for a condition causing minimal or no pain, dysfunction or disability and can be safely postponed until non-contract time. Such conditions shall not qualify for Leave Bank Days. 10. The District is liable only for the total number days in the leave bank.

  • Sick Leave 1. Employees will be granted one (1) day for each month of their contract year. The days granted will be available as of the first official day of the school year or the contract, whichever is applicable. 2. Sick leave may be accrued to the amount earned which shall be shown on each salary check. 3. The Board may require proof of illness whenever there is reasonable cause to believe that an absence is not due to a bona fide illness. 4. Days of accrued sick leave may be used to assist in the health care of persons who live in the employee's household, or to care for a parent, spouse, or a child regardless of their residence or for other relatives requested in writing and approved by the Superintendent/Designee prior to the leave. The Board may require proof of illness under the same requirements as the employee’s illness. 5. The absences in excess of available sick leave, deductions from salary shall be at the rate of 1/182 for Food Services Employees and 1/189 for Food Services Managers in excess of the number provided. 6. Employees hired prior to July 1, 1997: Employee will be paid for unused sick days in the following manner: a. Payment for unused sick days will be made to the employee upon that employee’s early or full service retirement or, upon the employee’s death, to the employee’s estate. Employees eligible for early or full service retirement who resign from employment and do not receive a retirement benefit, shall forfeit all rights to payment for unused sick days. b. Employees, who have a balance of less than 250 unused sick days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to a maximum of 250 unused days at their average daily rate*. c. Employees who have a balance of unused sick days greater then 250 days as of June 30, 2002, will receive payment for 50% of the employee’s accumulated unused sick days up to their June 30, 2002, unused sick leave balance, at their average daily rate*. d. Payments for unused sick days in amounts greater than $5,000 will be paid in equal amounts over five consecutive years beginning with the year of retirement. e. Payments for unused sick days in the amount at $5,000 or less or for the death of an employee will be paid in a lump sum to the employee or the employee’s estate in the year of retirement or death.

  • Sick Leave Abuse ‌ When the Employer suspects sick leave abuse, the employee will be provided the opportunity to explain the circumstances surrounding their sick leave use prior to disciplining the employee, or making reference to sick leave use in the employee’s performance evaluation. The Employer may not adopt or enforce any policy that counts the use of paid sick leave time as an absence that may lead to or result in disciplinary action for an authorized purpose. The Employer may not discriminate or retaliate against an employee for the use of paid sick leave for an authorized purpose.

  • Sick Leave Plan The benefits of the Company’s Sick Leave Plan shall be considered as part of this Agreement. However, it is recognized that its provisions are not an automatic right of an employee and the administration of this plan and all decisions regarding the appropriateness or degree of its application shall be vested solely in the Company. The Company’s Sick Leave Plan will provide that probationary and regular employees will commence with a credit of eight days at 100 percent (100%) and 15 days at 75 percent (75%) pay, payable from the first day of sickness. This credit will continue to be available until the employee attains his/her first annual accumulation date as a regular employee. At the time of this accumulation date and each subsequent accumulation date he/she will acquire additional credits of eight days at 100 percent (100%) pay and 15 days at 75 percent (75%) pay. The accumulation of credits will be subject to the provisions of the Company’s Sick Leave Plan. Regular part-time employees shall receive a pro-rated number of sick days. When a regular part-time employee is absent due to illness on a scheduled day of work, they shall be paid for the hours of work scheduled for that day provided sick leave credits are available. Normally employees will be expected to arrange routine medical or dental appointments during non-working hours. Where such appointments cannot be arranged during non-working hours and the employee can be released from his/her duties, then the time shall be charged against an employee's sick leave time except in the case of medical appointments of less than half a day where normal earnings will be maintained. Employees who are on sick leave for 30 days or more may be eligible to participate in a vocational rehabilitation program in accordance with the Company’s policy. All major medical absence forms will be completed for any absence of four (4) continuous days/shifts or more or when requested by management. The Company will compensate the employee for the cost associated with completing these forms up to a maximum of $30.00. Additionally, the company will compensate the employee for the full cost of all medical notes, medical forms or medical information required to support LTD or other Wellness programs. This provision applies to Doctor’s notes requested by Line Management as part of the administration of the sick leave plan. Employees will be required to submit all forms required by management through their personal physician. Sick Leave benefits are conditional upon receipt of these forms and it is the responsibility of the employee to ensure that the employer receives these forms within a reasonable period of time. Any discipline related to sick leave that is imposed and grieved by the union will be referred directly to Xxxxxx Xxxxxxxxx for resolution.

  • Vacations and Sick Leave The Executive shall be entitled to paid annual vacation leave in accordance with the policies as established from time to time by the Board of Directors, which shall in no event be less than four weeks per annum. The Executive shall also be entitled to an annual sick leave benefit as established by the Board for senior management employees of the Bank. The Executive shall not be entitled to receive any additional compensation from the Bank for failure to take a vacation or sick leave, nor shall he be able to accumulate unused vacation or sick leave from one year to the next; provided, however, such Executive may carry forward from year to year a maximum of ten days of unused vacation leave.

  • Vacation, Holidays and Sick Leave During the Term, the Executive shall be entitled to paid vacation, paid holidays and sick leave in accordance with the Company's standard policies for its senior executive officers.

  • Paid Sick Leave For those jurisdictions that have passed or will pass legislation requiring Paid Sick Leave, Paid Sick Time will be billed back to Client at the straight-time bill rate for all hours taken by any Consultant assigned to Client. This section is not applicable until the effective date of such legislation has been reached.
