TEACHER ASSIGNMENTS AND TRANSFERS. A. Teachers shall not be required to teach outside of the limits of their area of certification and/or licensing except in emergencies or unusual circumstances approved by the Principal or Superintendent-Director. B. Teachers who desire a change of their assignments may request a transfer to a different assignment and/or subject area of their preference. All such requests shall be made through the immediate supervisor to the appropriate manager and will be acknowledged in writing. If the request is denied, the teacher will be given a reason for the denial.

TEACHER ASSIGNMENTS AND TRANSFERS. (a) The assignment and transfer of teachers is the responsibility of the Superintendent, who will make reasonable effort to satisfy the reasonable requests and desires of teachers concerned. (b) Teachers already in the system shall receive notification of their programs and assignments for the ensuing school year prior to the close of the current school year. In the event of a change in pertinent circumstances or conditions, teaching assignments may be changed only as required thereby with prompt notice in writing to the teacher. No change in assignments may be made within twenty (20) days prior to the commencement of an academic year, except for reasonable cause. (c) Where possible, changes in grade assignments in elementary schools, changes in subject assignment in secondary schools, and transfers between schools will be voluntary. (d) If teachers are to be transferred involuntarily due to elimination of positions in a school building, the Board will give priority to the instructional requirements of the school system and thereafter to system-wide seniority (in the building or department, as appropriate) and qualifications of the teachers involved in the transfers for the positions. Seniority shall mean "least senior" only; that is, a teacher may displace the least senior teacher in a building or department only, after all of the above noted conditions are satisfied. If teachers are to be transferred for reasons other than elimination of positions in a school building, the Board shall first consult with the Federation, and any such transfer shall be only for reasonable cause. Involuntary transfers will be made only after a meeting between the teacher concerned and the Superintendent or designee, at which time the teacher will be notified of the reasons for the transfer. (e) Each certified teaching position will be posted internally, on the Meriden Board of Education’s online application system, for a period of five (5) workdays and may be posted externally at the same time. A photocopy of the internal job posting will also be posted in each school. (f) Only internal candidates are eligible to apply to internal job postings for teaching positions. TEACHER ASSIGNMENTS AND TRANSFERS. A. In recognition of the fact that students are entitled to be taught by qualified teachers working within their areas of competence, teachers shall not be assigned outside the scope of their respective teaching certificates or their major or minor fields of study, except in accordance with the regulations of the Michigan Department of Education and for good cause. It is understood and agreed that the words “qualified” and “qualification(s)” wherever used in this Master Agreement in reference to a teacher assignment, shall mean highly qualified per the No Child Left Behind (NCLB) Act unless said Act is repealed. B. Teachers shall be notified, in writing, of their tentative assignments for the coming school year, including the school to which they will be assigned, the grade and/or courses that they will teach, and any unusual or special classes to which they will be assigned. The notice will be given at least three (3) workdays prior to the first posting in the spring and will be in accord with Article 10, A, Step 4. When a change in the tentative program of a teacher occurs the teacher shall be notified as soon as possible. The Board reserves the right to revise specific teaching assignments, respecting contract provisions, as may be necessary as enrollment, finances or program needs may change. When tentative assignments are developed at the secondary level, preferences of teachers will be considered by building administration and if preferences of two or more teachers are in conflict, the preference of the most senior teacher(s) will take precedent over the lesser senior teacher(s). C. It is recognized that changes in grade and subject assignment may often become necessary and that the changes may prove to be beneficial to the teacher, the students, and the school system. In determining the assignments and transfers, the convenience and wishes of the individual teachers will be honored to the extent that these considerations do not conflict with the instructional requirements and best interests of the school system and pupils. An involuntary transfer or assignment shall be made only after a meeting with the teacher, a representative of the Executive Board of the Association, and the Superintendent or his designee, at which time the teacher will be notified of the reason for the assignment or transfer. The Superintendent-Director will inform and, if requested, meet with the Association Executive Board to discuss the need to have teachers assigned outside of their licensed certification. 2. After the meeting with Association Executive Board, the Superintendent-Director or designee will first post the necessary assignment to the entire Association for a minimum of five days to solicit qualified volunteers for the position who do not have a full workload as determined by the Superintendent-Director or designee. The Superintendent-Director will inform the Association Executive Board regarding the results of the solicitation for volunteers and, if requested, will meet with the Association Executive Board to discuss the results of the solicitation for volunteers. 3. If the Superintendent-Director or designee determines there is no volunteer qualified for the assignment, the District reserves the right to fill the assignment with the most qualified bargaining unit member, based on factors including but not limited to: current workload, experience, licensure and seniority. The provisions of this Article VII, Section A is subject to the grievance and arbitration procedures set forth in Article XIV of this Agreement. Furthermore, in the event that the parties arbitrate a violation of this Section A and an arbitrator determines that the Committee has violated this provision, the parties agree that an arbitrator does not have the authority to award the contested assignment to another candidate. 4. To the extent that any teacher is required, pursuant to the provisions of this Section A to teach classes outside his or her certification, no such teacher will receive a negative evaluation based on his or her performance related to the content or subject matter in the class(es) for which he or she is not certified to teach. TEACHER ASSIGNMENTS AND TRANSFERS. A. As soon as practicable, but by the end of the school year, teachers will be notified in writing of their salary and program for the coming year, including the school to which they are assigned, the grades and/or subjects that they will teach, and, when feasible, other pertinent information such as leave accumulations. Any special assignments such as extra-curricular activities that they will sponsor will be announced as soon as possible. To the extent practicable, all teachers shall receive their salary letters by their first paycheck of the school year. B. In order to assure that students are taught by teachers working within their areas of competence, teachers will not be assigned except temporarily and for good cause, outside the scope of their teaching certificates and/or their major or minor fields of study. C. In making changes in grade, subject or school assignment, the preference of the individual teacher will be honored to the extent that these do not conflict with the best interest of the school system and the pupils. The final decision shall be made by the Administration. D. Teachers who desire a change in grade or subject assignment may file a written statement of such desire to their school principal not later than April 1. In the event that a transfer is granted during the school year, notification shall be made to the teacher no later than one week prior to the end of the school year. E. When involuntary transfer or assignment is necessary, a conference between the teacher and the Superintendent of Schools or the teacher's designee will be arranged for the purpose of discussion of the reasons for the transfer. Consideration of the teacher's record will determine which teachers are to be transferred. The Association will be consulted in such decisions. Every effort shall be made to limit an involuntary transfer to one year.
TEACHER ASSIGNMENTS AND TRANSFERS. Continuation of Employment of Probationary Teachers - Probationary teachers shall be notified by May 1st of each year if their employment will not be continued into the following school year as a result of their professional evaluations. In the final year of their probationary term, they shall be notified by April 15 if they will not be recommended for tenure when their probationary term began at the beginning of a school year. In the final year of the probationary term, when the probationary term began during the course of the school year, they shall be notified 75 calendar days before the end of their probationary term. (This provision does not apply to physical and occupational therapists.)

TEACHER ASSIGNMENTS AND TRANSFERS. A. The Board reserves the right to revise specific teaching assignments. B. In arranging schedules for teachers who are assigned to more than one school, an effort will be made to limit the amount of interschool travel. Teachers who are assigned to more than one school in any school day shall receive the IRS approved reimbursement per mile for all inter- school travel. Travel shall be authorized and limited by the Administration in accordance with past practices. Employees may request reimbursement on a monthly or bi-annual basis following each trimester. The final such request during any school year must be submitted to the Human Resources Office no later than three (3) working days following the teachers’ last workday of the schoolyear; reimbursement requests submitted after that date shall be denied.

  • Assignments and Transfers 18.1 Any assignment by either Party to any entity of any right, obligation or duty, or of any other interest hereunder, in whole or in part, without the prior written consent of the other Party shall be void. The assignee must provide evidence of a Commission approved certification to provide Telecommunications Service in each state that OneTone is entitled to provide Telecommunications Service. After BellSouth’s consent, the Parties shall amend this Agreement to reflect such assignments and shall work cooperatively to implement any changes required due to such assignment. All obligations and duties of any Party under this Agreement shall be binding on all successors in interest and assigns of such Party. No assignment or delegation hereof shall relieve the assignor of its obligations under this Agreement in the event that the assignee fails to perform such obligations. Notwithstanding anything to the contrary in this Section, OneTone shall not be permitted to assign this Agreement in whole or in part to any entity unless either (1) OneTone pays all bills, past due and current, under this Agreement, or (2) OneTone’s assignee expressly assumes liability for payment of such bills. 18.2 In the event that OneTone desires to transfer any services hereunder to another provider of Telecommunications Service, or OneTone desires to assume hereunder any services provisioned by BellSouth to another provider of Telecommunications Service, such transfer of services shall be subject to separately negotiated rates, terms and conditions.

Any assignment in addition to or in lieu of the normal teaching schedule, during the regular school year, shall not be obligatory but shall be with the consent of the teacher. Such assignments will be given to teachers regularly employed in the school system on a rotating basis.

  • Other Assignments Except as otherwise expressly provided in this Agreement, the provisions of this Agreement shall inure to the benefit of and be binding upon, the successors and permitted assigns of the parties. Neither party shall assign or transfer its rights or obligations under this Agreement without the prior written consent of the other party, which shall not be unreasonably withheld.
