Transfer Outside Bargaining Unit. An employee who is transferred to a position outside of the bargaining unit for up to one year shall retain but not accumulate seniority while in that position. Any extension to such transfer will be negotiated by the parties. An employee will only be covered for a subsequent transfer out of the bargaining unit if in the interim they had returned to and worked in a bargaining unit position for at least the same duration as their previous assignment outside the bargaining unit.

Transfer Outside Bargaining Unit. No employee shall be transferred to a position outside the Bargaining Unit without the employee's consent.
Transfer Outside Bargaining Unit. An employee who accepts a permanent position excluded from the bargaining unit shall continue to maintain employee’s departmental bargaining unit seniority for a period of one hundred twenty (120) working days. Such employee may return to the bargaining unit within the specified one hundred twenty (120) working day period to such classification for which employee is qualified and employee’s seniority entitles them to. After the one hundred twenty (120) working day period expires, such person accepting a non-bargaining unit position shall forfeit employee’s bargaining unit seniority. An individual who bids and is the recipient of the position vacated by the employee promoted to management will be informed of the possibility of return within the specified one hundred twenty (120) working day period.

Transfer Outside Bargaining Unit. A bargaining unit member who accepts a job in the District outside of the bargaining unit (without a break in service) shall maintain his/her previous job classification and bargaining unit seniority. If he/she resumes his/her employment at some future date in the bargaining unit [without a break in service] he/she shall resume his/her job classification seniority (if he/she goes to the same classification) and his/her bargaining unit seniority. The period of time spent in a District position outside of the bargaining unit shall only count toward District seniority.

Transfer Outside Bargaining Unit. 12.01 If an employee who has acquired seniority status is or has been transferred to an occupation not covered by this agreement, or to a supervisory position, he/she shall not accumulate seniority during the period of such transfer. In case such person is subsequently transferred to an occupation covered by this agreement, he/she shall be credited with his/her seniority while in the Bargaining Unit, providing he/she has been out of the Bargaining Unit for a period of three (3) months or less.
Transfer Outside Bargaining Unit. The City retains the exclusive right to select those persons to fill positions outside the bargaining unit of this Agreement. Where any bargaining unit employee transfers to a position outside of this bargaining unit (including transferring to another bargaining unit) except on a temporary basis, the employee's seniority shall terminate after the date of transfer. The City cannot force employees to transfer outside the bargaining unit.
Transfer Outside Bargaining Unit. (a) When an employee is permanently transferred or promoted to a position outside the bargaining unit, he will retain his bargaining unit seniority and continue to accumulate seniority under this Agreement for a period of twelve (12) months from the date of such transfer or promotion. After such twelve (12) month period, the employee shall have no accumulated seniority under this Agreement. (b) Should the employee return to the bargaining unit within such twelve (12) month period however, and there is then no vacancy which, by reason of his seniority, skills, ability, knowledge, competence and qualifications, he is able to fill, he may displace the most junior employee in the bargaining unit for whose job he immediately possesses the skills, ability, knowledge, competence and qualifications necessary to perform the work in question, provided that such employee has less bargaining unit seniority. In the event of such displacement, the junior employee will be considered as laid off and the senior employee will be re-classified into the classification of the junior employee and will be paid the rate for such job. If the returning employee elects not to displace the junior employee described herein, he/she shall be deemed to be laid off. (c) Where an employee accepts an assignment to a position outside his/her bargaining unit on a temporary basis, he/she shall be returned to his/her former job and shift on completion of such assignment.
