Weapons Qualification. All employees in the bargaining unit who are required to carry sidearms shall qualify with their sidearm annually. The Sheriff shall give thirty (30) days written notice to the aforesaid employees to enable said personnel to attend practice sessions prior to the test. If an officer fails to qualify, he will be provided with practice ammunition as is necessary in order to practice for qualification. Employees who fail to qualify will be allowed to attempt to qualify three (3) times within one (1) month of failure on three (3) different days. If the employee still fails to qualify after three (3) attempts, the employee may be suspended without pay on a day-to-day basis until such time as qualification is achieved. Qualification shall not be between the months of November and March, inclusive, though shooting may be required throughout the year.

Weapons Qualification. Employees shall be required to qualify with their assigned duty weapon semi-annually. Each firearms qualification “session” shall consist of no more than two attempts to qualify. If unsuccessful on the first qualification attempt, a second attempt must occur immediately thereafter. If an employee does not achieve a qualifying score after the first session, they will be placed on administrative leave w/o pay and must attempt a second qualification session. If an employee does not achieve a qualifying score after the second session, they will remain on administrative leave w/o pay and must attempt a third qualification session. Employees will have no more than 30 days to complete both the second and third qualification sessions. Employees failing to qualify shall be required to undergo four hours of remedial firearms training, conducted by the Employer, before attempting subsequent qualification sessions. Employees who fail to achieve a qualifying score after three sessions will be immediately separated from employment. The Employer agrees to pay employees at their normal rate of pay, for time spent during firearms qualification and training for the first three sessions mentioned above and time spent travelling to the location if it occurs during a scheduled shift.
Weapons Qualification. 32.1 Armed employees are required to maintain, at all times, the ability to demonstrate proficiency with the Company and DOE issued weapons and duty ammunition by successfully qualifying in accordance with current DOE Directives. In the event this should happen within the 10 CFR 1046 semi-annual qualification timeline and meets the requirement for day and reduced light qualification, this assessment will count as the employee’s semi-annual weapons qualification attempt. When a SPO is required to complete a weapons requalification, they will be paid weapons proficiency pay in accordance with Article 32, for first attempts only. 32.5 Range Officer instructions and Range Safety Procedures shall be complied with at all times while on any live fire range. Any change concerning range procedures that would result in a material change in working conditions, will be negotiated with the Union as outlined in Article 35. 32.6 The Company shall promptly give written notice to the Union when any employee fails to qualify under the provisions of this Article. A Union official may be present strictly as an observer in a "no pay" status when any employee who has failed to qualify without notice, attempts subsequent qualification. 32.7 Armed employees shall demonstrate their proficiency by qualifying, normally on a semi- (a) The two qualification attempts will be conducted as follows: (1) The first attempt will be conducted on the scheduled day of semi-annual weapons qualification. Employees qualifying on their first attempt will not be required to fire further attempts. Weapons Qualification. All employees that carry weapons, due to the nature of their employment, including all deputies, detectives, corrections officers, and sergeants, shall qualify with their weapons semi-annually by a certified range officer. The Sheriff shall provide arranged and necessary ammunition for such qualification. Qualification standards shall be those established by the MLEOTC. Employees who do not qualify shall be retested within thirty (30) days. If the employee again fails to qualify, he/she shall be terminated from County employment, or may bump to a position within the Department not requiring the employee to carry a weapon, if he/she meets the conditions set forth in Section 10.7. If an employee elects to bump down, the employee may attempt to re-qualify at the next semi-annual test, and, if the employee then passes, he/she shall be returned to his/her former position. Corrections officers shall not be compelled to qualify, and failure to do so shall not result in disciplinary action.

Exception can be made for officers on assignment who could be issued other departmental authorized weapons, or officers could carry their personal authorized weapons. The City shall purchase all ammunition for qualification and duty use.
