WITNESS DUTY LEAVE. 1. Teachers served with a valid subpoena issued by a federal, state, county, or municipal court, or a federal or state legislative body, may be absent from duty, without loss of pay or other benefits, provided the teacher has:
a) advised the immediate supervisor on the first school day following the receipt of the subpoena; and
b) submitted a copy of the subpoena at the time the request for absence is made on the proper District form; and
c) endorsed the witness duty payment, if the teacher has been paid for serving as a witness, excluding reimbursement for travel, meals, and lodging, over to the District within sixty (60) calendar days from the last day on which the witness duty was served.
2. Failure to deliver the endorsed fee payment to the District within this time period shall result in the loss of wages for the period of absence.
WITNESS DUTY LEAVE. Employees required to serve as a witness for longer than five (5) days may request an unpaid leave of absence, up to a maximum period of 30 days. A copy of the subpoena must be provided to the department manager at the time the employee requests the time off for witness duty. Employees will be allowed to utilize their vacation/PTO benefits for partial or full day of absences to witness duty, unless state or federal law require otherwise.
WITNESS DUTY LEAVE. 20:01 A Full Time Fire Fighter who is called upon to attend as a witness by subpoena or summons or by providing proof, satisfactory to the Employer of being required to attend as a witness in any proceeding held in or under the authority of any court in Canada, or before any legislative committee authorized by law to compel the attendance of witnesses before it, shall be allowed leave of absence with full pay, provided that the full amount of compensation received, excluding mileage and traveling expense and an official receipt thereof is deposited with the General Manager of Financial Services and City Treasurer.

WITNESS DUTY LEAVE. Employees may take time off to comply with a subpoena or other court order to appear in court as a witness in a judicial proceeding. Employees must provide their supervisor with a copy of the subpoena or court order reasonably in advance of their court appearance as a witness. Subject to state and federal laws, witness duty leave is unpaid except that an employee may use accrued and available vacation and/or sick pay.
WITNESS DUTY LEAVE. Time off with pay shall be permitted to any Member for any time required as a witness in any proceeding where the Member is called to testify as a result of the Member’s duties and/or position with the Township Fire Department. If required to so appear on a non-scheduled day, the Member shall be paid the overtime provisions for time consumed in such appearance, in accordance with Article 9. Upon receipt of payment for any witness fees, the Member shall submit the witness fees to the Fire Chief who will then deposit such funds with the Township Fiscal Officer.

Employees who are required to appear in court or in a state or federal administrative proceeding to testify under subpoena or court order must notify their manager or supervisor as soon as possible so that coverage can be arranged. Transition Projects will pay the difference between any compensation for witness or jury duty and the employee’s regular rate of pay for up to three days. A statement of earnings from the Court must be submitted to payroll in order to receive payment. Should the obligation extend beyond three days, employees may use accrued leave or request unpaid time off for the period exceeding three days. Employees appearing in court on behalf of Transition Projects will be on a paid time/duty status.

Leave without pay up to five days may be approved by the employee’s immediate supervisor. Leaves without pay in excess of five days are considered Leaves of Absence (see below). Employees in any of the above leave statuses continue to accrue seniority. Regular employees may request unpaid personal leave of absence for up to a cumulative total of 90 calendar days in any 18-month period. The Executive Director must approve all requests for personal leaves of absence. Among the factors that determine whether the request will be approved are: The reason for the request; Employee’s length of service; Performance, attendance, safety, and disciplinary history and/or records; Any previous leaves of absence (and the length/purpose of such leaves); Customer service obligations of requesting employee’s department, location, and/or job; Employee’s commitment to return to work immediately following the leave A personal leave which has been granted for fewer than 90 calendar days may be extended to 90 days, provided that the extension is requested prior to the expiration of the original leave and the reason for the request meets the above standards. Employees must use all earned vacation pay prior to going on unpaid status. Employees on personal leave of absence do not accrue seniority during the period of absence.
