Joint Safety Committee. (a) The Union and the Company shall cooperate in selecting one or more Safety Committees, which will meet at least once a month to consider all safety and occupational health problems.

Joint Safety Committee. Designated employee representatives covered by this agreement may participate on the College’s Safety and Health Committee. The committee will consider workplace safety and health issues affecting employees. Employee participation in safety committee meetings held during the employee’s work time will be considered time worked. Employees may request work schedule adjustments to participate. Any employee has the right to bring a workplace health and safety concerns to the safety committee. Recommendations will be forwarded to the appropriate appointing authority for review and action, as necessary.

Joint Safety Committee. The Joint Safety Committee shall be composed of an equal number of representatives of the Department and the Union. This Committee may meet every three months on a regular basis as determined by said Committee. It shall also meet on urgent situations at the request of either the Department or the Union. The present safe working rules and practices shall be considered a part of this MOU and changes in the Safety Rules shall be subject to negotiations between the parties and in conformance with applicable City, State or Federal regulations. The Joint Safety Committee shall utilize consultants from the City, State or Federal agencies in the event an interpretation of the City, State or Federal regulations is involved. It shall be the responsibility of the Department to administer the Safety Program and to make every reasonable effort that Safety Rules are carried out by all employees. It shall be the responsibility of the employees to make every reasonable effort to ensure that they act in a safe manner. Should a dispute arise over the application or interpretation of a Safety Rule, such dispute shall be resolved by use of the Grievance Procedure.

(a) The SFMTA and the Transport Workers Union Local 250-A shall establish a joint safety committee hereinafter termed "JSC" composed of an equal number of Transport Workers Union Local 250-A and SFMTA representatives. These representatives shall select an independent, neutral committee member who shall be knowledgeable in the field of health and safety who shall serve as chairperson. For accident determination decisions, the independent chairperson shall be selected as set forth in subsection (c), below. Expenses of the independent chairperson shall be shared equally by the Transport Workers Union Local 250-A and SFMTA. The JSC shall meet within five days of the call of either party. If one party refuses or fails to meet when a meeting is called, the other party may proceed with the selection of an independent, neutral committee member, who shall serve as chairperson, and the JSC shall commence its activities. The JSC shall consider and propose action on any aspect of SFMTA’s operations affecting the health and safety of Operators. If any action proposed by a majority of the members of the JSC is not implemented, the matter shall be referred to the Executive Director/CEO or designee and the President of the Transport Workers Union Local 250-A for handling, and if the matter is still not resolved, subject to the budgetary and fiscal provisions of the charter, the committee is authorized to take reasonable steps to publish at SFMTA’s expense its findings and proposed action.

Joint Safety Committee. The Employer shall maintain a high standard of safety in its operations in order to eliminate accidents as far as possible. Both parties agree to abide by the provisions of the Occupational Health and Safety Act. Employee complaints made to their Supervisor shall receive full consideration by the Supervisor and the Employer’s Management and every effort shall be made to remedy all unsafe practices. The parties agree to co-operate to eliminate accidents as far as possible, and to provide a safe and healthy working environment for all employees. The Employer agrees to implement identified legislated safety requirements in an expeditious manner. The Employer and the Union agree to establish a joint Safety Committee on which each party will have equal representation. The Union representatives will be determined solely by the Union, but such appointments shall be for a minimum of twelve (12) months and shall not exceed three (3) members. The Safety Committee shall be involved in determining the Terms of Reference pertaining to the function of the Safety Committee.

Department of Labour Inspection The President of the Union or one Safety Committee member of the Union and one member of the Company will accompany the Department of Labour Inspector when such inspection of the plant is to take place.
