Leaves of Absence With Pay. Leaves of absence with pay may be granted to permanent employees under the provisions of this article when approved in advance by the Employer prior to the commencement of the leave.
Leaves of Absence With Pay. An employee shall be granted a leave of absence without loss of pay or other benefits for the following:
Leaves of Absence With Pay. 1. Each tenure teacher shall have the right to request and obtain three days of personal leave in each contract year. Each non-tenure teacher shall have the right to request and obtain two days of personal leave in each contract year. Requests for such leave shall state the reason for such leave and shall be in an authorized form except in the case of an emergency and shall be for bona fide pressing purposes such as business or personal obligations which cannot be resolved outside regular working hours, including college graduation of member of the immediate family, wedding of a member of the immediate family, hardship cases or home exigencies (provided that such leave shall be available for accompanying a member of the immediate family to the hospital or for illness or accident to a member of immediate family only if the days available for such purposes under Section (A)(1) above have been used). For personal reasons, teachers may decline to state the reason for one such day annually. Except in an emergency, leave shall not be granted immediately before or after a vacation period or long weekend. Leave shall not be granted to extend a vacation period. Leave shall not be granted when in the opinion of the Superintendent or his/her designee the operation of the teacher's school will be adversely affected due to the number of teachers requesting leave for a particular day. Nothing contained in this subsection shall be construed to entitle every teacher to any such personal days in every contract year unless the conditions set forth in this subsection are met. As used above, “immediate family” is defined as spouse, son, daughter, sister, brother, parent or step parent, or other relatives who are permanent members of the household.
2. All teachers shall also be entitled to leaves for personal reasons as follows:
a. Three (3) days per year as required by an individual's religion.
b. Court appearance when subpoenaed as a witness in any case, provided that the teacher shall notify the Chief Human Resources Officer of the subpoena and the Chief Human Resources Officer shall request for the teacher reimbursement for the teacher's salary from the person issuing the subpoena. The teacher shall be paid his/her salary less any reimbursement, with deduction to be made subsequent to receipt of reimbursement.

Leaves of Absence With Pay. 13.1 All leaves of absence must be supported with an absence report form upon return from the leave. Leaves of absence with pay shall be granted by the District for absence during a faculty member's individual contract period as follows:
Leaves of Absence With Pay. It is recognized that leaves of absence with pay are appropriate for illness, personal emergencies, and the performance of certain civic functions. A leave of absence with pay is a leave during which a member of the bargaining unit is not required to perform regular University duties, but is retained on the payroll of the University at their normal compensation rate for periods during which they are normally on the payroll. Nothing in Section C shall be interpreted or applied so as to violate, or minimize the protections available to employees under the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), or any other state or federal laws.
Leaves of Absence With Pay. A. Each teacher will be entitled to, in addition to Sick Leave provided for in Article IX of this AGREEMENT, the following temporary leaves of absence with pay each school year:
1. Three days leave of absence for the observation of religious holidays which require his/her absence from work. The teacher will be required to give one week's notice to the building principal.
2. Two days for the purpose of visiting other schools or attending meetings or conferences of an educational nature, which will be beneficial to the teacher and the school system. The teacher will be required to seek approval from the principal at least one week prior to the leave. Upon mutual agreement with the principal or director, the teacher may submit a written report with respect to each such leave taken. Additional days may be given at the discretion of the building principal. The teacher shall also be entitled to use any unused personal days as provided in C. 1. of this Article.
3. Time necessary for appearances in any legal proceeding connected with the teacher's employment or with the school system, or by subpoena of the court.
4. Up to five (5) days will be granted for each absence because of the death of 1) a teacher’s spouse, child, son-in-law, daughter-in-law, sibling, parent or of 2) another member of the immediate household or of 3) an individual who has a relationship to the teacher substantially like that of those mentioned above. Teachers may be granted additional days at the discretion of the Superintendent.
5. Up to five (5) sick days may be used for each illness requiring bedside, medical, parental or household attention by the teacher of 1) a teacher's spouse, child, son-in-law, daughter-in-law, sibling or parent or of 2) another member of the immediate household or of 3) an individual who has a relationship to the teacher substantially like that of those mentioned above. Teachers may be granted additional days not deducted from sick leave at the discretion of the Superintendent.
6. Time necessary to attend a teacher's Selective Service examination, physical examination, or any other tests required of the teacher by the United States Government.
Leaves of Absence With Pay. A. Personal Days
1. All members of the bargaining unit shall receive two (2) personal business days. These days may be taken in half (1/2) day increments or full day increments only. The unused portion of personal days shall accumulate as sick leave.
2. A personal day cannot be used the day before or after a holiday or vacation period for the purpose of extending vacation or for the first or last day of the school term, except with justification in writing to the superintendent or his/her designee. The superintendent's decision on the justification will be final.
Leaves of Absence With Pay. A. Employees who have not volunteered for jury duty and are called for jury duty or are not a party in a civil or criminal court proceeding but are subpoenaed as a witness to attend such a court proceeding, shall be granted leave with pay while attending court. Evidence of such duty in the form of a subpoena or other written notification shall be presented to the employee's immediate supervisor as far in advance as practicable.
B. The Employer shall grant up to 40 hours leave with pay during each year of this Agreement to all Shop Stewards in order that they may attend Local Stewards' meetings and/or the annual Shop Stewards' conference in the event the Union participates in such meetings and/or conference. The Union agrees to avoid requests for such leave on Friday, Saturday or an inventory day whenever possible. Requests for such leave must be submitted at least one week in advance.
C. All requests for leave under this Article must be submitted in writing to the employee's immediate supervisor and shall be answered in writing promptly. Requests for emergency type leaves shall be answered before the end of the shift on which the request is made. Except for such emergency type leaves, the time when leave is taken is within the discretion of the Employer. Requests for any type of leave to which an employee is entitled under this Agreement and which is not to exceed one month shall be answered by the Employer within five days. If the requested leave is in excess of one month, the request shall be answered within 10 days.
D. For the purpose of this Article, the calendar year shall be defined as beginning with the employee's first full pay period commencing on or after January 1 and continuing through the end of the employee's pay period that includes December 31.
