B. Each employee wishing to use his/her accrued vacation leave in blocks of at least five (5) continuous work days is required to submit such request in writing to his/her supervisor no later than May 1 of the year (June thru May) during which he/she is requesting vacation leave. As used herein, “continuous” means the actual number of days used can be interrupted by a non-work day such as a holiday and/or a weekend. Therefore, five (5) continuous days could be a work day on Tuesday, Wednesday, Thursday, Friday and the following Monday; or it could be a work day on a Thursday, Friday, a holiday (on Monday), Tuesday, Wednesday and Thursday.
C. If the administration determines an insufficient number of employees will be actively working to complete the work load at his/her facility because too many employees have requested to use vacation leave at the same time, the administrator will use the employee’s seniority among those who have requested vacation leave for the same dates to determine whose request(s) will be granted. The employee(s) with the greatest seniority as defined elsewhere in the Agreement will have his/her vacation leave approved. Those whose requests were not approved, may re-apply for other periods of time. All employees making such requests will be notified as soon as possible if their request were approved or not approved.
X. Xxxxxxxxxx, those employees who vacation leave request for at least five (5) continuous work days was granted go to the bottom of that facility’s seniority list for the purpose of determining which employee’s vacation leave request will be approved in the future.
E. Request of the use of vacation leave for less than five (5) continuous workdays also must be submitted in writing to his/her supervisor no later than ten (10) working days in advance of the first day of vacation leave he/she is requesting. Such requests are also subject to the approval of the administrator/designee. Approval of the use of vacation leave for fewer than five (5) continuous workdays will not move the employee to the bottom of the seniority list at that facility. However, any approved request for less than five (5) continuous workdays will require that employee not to request any additional vacation leave for a minimum of at least twenty (20) work days after returning from any approved vacation leave. Use of Vacation Leave. A. Vacation Accruals earned at the end of the month are available for use the 1st of the following month.
B. The Department Head shall determine the period when accrued vacation time may be taken by each employee consistent with the requirements of the department.
C. Denial of an employee's request for use of vacation leave must be based on business necessity.

Use of Vacation Leave. 1) A minimum of five (5) vacation days must be taken each year. Vacations will be scheduled to avoid multiple employees taking vacation atthe same time and to insure a reasonable staffing level. Scheduled vacation leave which is cancelled due to operational reasons shall be rescheduledprior to the end of the year.
2) Vacation leave may be taken only to the extent that it is actually earned.
3) Vacation leave must be approved by the Deputy Chief of Police. Requests for vacation leave is preferred to be submitted at least five (5) or more working days (Monday through Friday) prior to the start of the leave, except in an emergency when such approval shall be requested as soon as possible thereafter, but if staffing permits, requests made less than five (5) days in advance may be granted. Leave requests submitted within these time-frames shall be approved in a reasonable and timely manner.
4) Vacation leave may be taken in no less than one (1) hour increments, effective January 3, 2022.
5) Vacation leave must be recorded on the employee’s payroll report.
6) Contingent upon the successful completion of the probationary period, a probationary employee will accrue vacation leave during the probationary period of their employment. Vacation leave will not be paid if the probationary period is not completed, nor can it be used during the first six months of the probationary period.
7) Vacation leave will not accumulate while an employee is on an unpaid leave of absence, short-term disability or long-term disability.
8) In the event of a sick leave day occurring immediately prior to or immediately after a vacation absence, a physician’s certification may be required to validate the illness/injury to determine vacation pay eligibility. Failure to provide a physician certification will result in loss of pay for the working day(s).
9) Total earned vacation leave which is allowed to be carried over from one (1) year to the next, is one year's vacation allowance, plus five (5) days. Any excess vacation leave will be forfeited on July 1 of each year.
Use of Vacation Leave. Vacation leave is a right; however, the use of same shall be scheduled by the City, taking into account the desires and seniority of employees and the workload requirements of the department. Employees shall take vacation leave regularly each year and shall be encouraged to take vacation at least a full week at a time. In order to give effect to this policy and to realize the greatest benefit from vacation leave for both employees and the City, limitations shall be placed upon the amount of unused vacation leave an employee is allowed to accumulate.
Use of Vacation Leave.
A. Each District facility having an administrator or designee supervising 12-month bargaining unit employees assigned to that facility will be the administrator (or his/her designee) in charge of administering this Section of the Contract as it relates to the scheduling of requested vacation leave.

An employee may carry over vacation time to the next fiscal year provided he/she has received prior written approval from the District Superintendent. Vacation leave not used or approved for carryover will be lost, unless such leave was not taken because the employer disapproved of the employee’s request to use such leave, in which case such leave shall either be paid to the employee at the end of the fiscal year or shall be carried forward to the next year at the employee’s discretion. Vacation may be taken in hourly increments or fraction of an hour absence.
