Accrued Days Off. 11.3.1 For the purposes of calculating all entitlements and leave accruals, the ordinary full time hours of work will be 37.5 hours per week. 11.3.2 Notwithstanding subclause 11.3.1 and subject to subclause 11.3.3, at his or her discretion an employee may elect to actually work 39 hours per week and accrue an entitlement to ten additional paid Accrued Days Off (ADOs) per calendar year. 11.3.3 Notwithstanding subclause 11.3.1 and subclause 11.3.2, if there is an alternative standard hours arrangement in operation at the college then that will be the arrangement that the employee may elect to work to accrue an entitlement to ten additional paid ADOs per calendar year and the provisions of subclause 11.3.2 will not apply. 11.3.4 The actual hours of duty prescribed in subclause 11.3.2 and 11.3.3 will be worked between the hours of 7.00 am to 6.00 pm Monday to Friday and can be varied by agreement with the college so that the employee accrues ten additional ADOs and works an average of 37.5 hours per week across the year, provided that: a) The maximum hours worked do not exceed 10 hours per day or 50 hours per week; and b) The averaging of hours of duty actually worked will occur over a maximum period of three (3) calendar months, which will coincide with the four quarters of the year, beginning with 1 January; and c) At the discretion of the Managing Director, an alternative system of averaging to that prescribed in subclause 11.3.4 (b) may be implemented. 11.3.5 The 10 paid ADOs will accrue per calendar year, calculated on a weekly basis inclusive of public holidays. The method by which these days may be taken, eg hourly, daily weekly will be agreed between the parties at College level. 11.3.6 If the employee is off duty on accrued day(s) off, he/she will not be able to claim payment for sick leave in substitution for accrued days off. 11.3.7 The employee will not accrue accrued days off while on any period of leave without pay beyond two weeks, or annual leave beyond four (4) weeks, long service leave beyond four (4) weeks, sick leave beyond 4 weeks, or worker’s compensation beyond four (4) weeks. 11.3.8 For periods where ADOs do not accrue under clause 11.3.7, employees will be credited with working hours of 37.5 per week and ADOs for the calendar year will accrue on a pro-rata basis. 11.3.9 Accrued days off must be taken in the calendar year in which they accrue and cannot be carried forward from year to year.

Accrued Days Off. 48.1 Meaning ofaccrued day off’ (a) is rostered to work more than 38 hours per week; (b) is paid 38 ordinary hours; (c) the difference between the hours worked and hours paid accrues towards a paid day off; and (d) an Employee’s ordinary wage for ordinary hours is deemed to be the weekly rate prescribed in clause 28 (Wages and Wage Increases) and set out in Appendix 2, and will be paid each week even though more or less than 38 ordinary hours are worked in that week.
Accrued Days Off. 61.1 Where the system of working provides for accrued days off, Employees will work an additional 0.4 hours per day, or 2 hours per week, to facilitate one accrued day off (ADO) after every 4 weeks of service. 61.2 The maximum ADOs will be 13 in any calendar year, provided that one (1) ADO will be taken in conjunction with a period of annual leave, for which no additional payment is to be made. 61.3 Employees other than Dental Assistants employed by DHSV or Ballarat Health Service (a) accrued days off are to be taken as single days on a rostered basis (i.e. 1 ADO in each 28-day cycle), as agreed between the Employer and Employee; (b) provided that the Employer and Employee may mutually agree to defer a rostered ADO for a maximum of one month, but only in exceptional circumstances.
Accrued Days Off. (a) Full-time Employees may accrue two banked hours towards ADOs each week. Every eight hours banked will amount to one ADO. A full-time Employee accordingly accrues one ADO every four weeks. (b) Part-time and casual Employees do not accrue banked hours towards ADOs. (c) ADOs are intended to provide flexibility for both an Employer and its Employees in relation to organising work schedules. VSA Roads recognises there may be times when it is convenient for an Employee to take a day off without using another form of paid or unpaid leave. Equally, there are times when an Employer may require Employees to take an ADO, such as when work is cancelled due to inclement weather. (d) The following conditions apply to ADOs: (i) Only two ordinary hours each week may be banked towards ADOs. (ii) The maximum quantity of ADOs that may be accrued by an eligible Employee is 12 days. (iii) An Employee may take, or an Employer may direct an Employee to take, up to four ADOs in advance of those ADOs being accrued. (iv) Unless payment for an ADO has been made in advance, the Employer will pay an Employee an amount equivalent to 8 ordinary hours of work when each ADO is taken. (v) An Employee may take an ADO at any time they wish, subject to an Employer’s operational requirements. If an Employee wishes to take an ADO, it is preferable that they complete a leave form and submit that to the Employer for authorisation by the Employer two weeks before the ADO is taken. An Employer may direct an Employee to take an ADO at a time which is convenient to the Employer. While the Employer will endeavour to provide Employees with as much notice of an ADO as possible, there will be times when longer periods of notice cannot be provided. An Employer must not direct an Employee to take more than 6 ADOs in any one year. (vi) Employers will keep records of ADOs accrued, taken voluntarily and taken involuntarily. (vii) Where an Employee has 12 accrued ADOs, the Employee must use ADOs before taking any accrued annual leave. (viii) ADO hours accrued but not used by the end of each September will be paid out in the first week of October. (ix) ADOs not taken are paid out on termination of employment or when the employee requests.
