Holidays and Annual Vacation. 12.1 Holiday and Holiday Pay - The following shall be paid holidays:
Holidays and Annual Vacation shall apply except that part-time, freelance and temporary employees shall be entitled to pay for a general holiday on which they do not work calculated on the basis of one-twentieth (1/20) of the wages earned during the thirty (30) calendar days immediately preceding the general holiday. General holidays shall be granted in accordance with the prevailing legislation.
Holidays and Annual Vacation. 12.1 Holidays and Holiday Pay - The following shall be paid holidays:
(a) Employees may be eligible for up to two (2) Personal Floater Days per calendar year. Eligibility to Personal Floater Days is determined as follows: -the employee is eligible to two (2) Personal Floater Days if actively at work for at least nine (9) months in the calendar year; -the employee is eligible to one (1) Personal Floater Day if actively at work for at least three (3) months but less than nine (9) months in the calendar year; -the employee is not eligible to Personal Floater Days if actively at work for less than three (3) months in the calendar year. Personal Floater Days not taken during the calendar year are forfeited and cannot be carried over from one calendar year to another. Notwithstanding the foregoing any employee on staff as of June 5, 2012 shall be entitled to three (3) Personal Floater Days which shall be grandfathered under this Agreement.
(b) When one of the nine (9) holidays listed above falls on a Saturday or Sunday and the day following is proclaimed a holiday by the Federal or Provincial Authorities, the corresponding weekday(s) proclaimed shall be deemed to be the holiday(s) for the purposes of this Agreement.
(c) When December 25th falls on a Saturday or Sunday and where December 26th and 27th are proclaimed as public holidays, the entitlement to holidays for the purposes of this Agreement shall be only December 25th and 26th.
(d) When January 1st falls on a Saturday or Sunday and where the preceding Friday or following Monday is proclaimed as a public holiday, then the entitlement to the holiday for the purposes of this Agreement shall be only January 1st.
12.1.1 Employees shall be compensated for the above holidays in the following manner:
(a) If the holiday falls on a regular working day and the employee is not required to work, he shall be paid for eight (8) hours at his basic rate of pay.
(b) If a holiday falls on an employee's scheduled day off or within his vacation, he shall receive one (1) additional day off either added to the vacation or granted at another time agreeable to both Parties.
(c) If the holiday falls on a scheduled work day and the employee is required to work, he shall receive two and 46 CTV one half (2½) times his basic rate (which amount shall include his normal basic pay) for all hours worked with a minimum credit of eight (8) hours and three (3) times his basic rate for all hours worked in excess of eight (8) hours.

7.2 Under any of the following circumstances, Party B is not entitled to Annual Vacation for the corresponding year: 乙方有下列情况之一的,不享受当年的年休假:

7.3 The Annual Vacation may be taken upon approval of the line manager or supervisor of Party B after Party B gives written notice to the line manager or supervisor at least one (1) month prior to the intended Annual Vacation and only when the taking of the Annual Vacation is not in contradiction with the necessity of the business or production of Party A. 休年假必须得到乙方任职部门的部门主管或负责人的事先批准。乙方应至少提前一个月书面通知其主管或负责人,且在与甲方的经营无任何冲突的情况下休年假。
7.4 It is a general policy that the Annual Vacation may not be carried forward to any future calendar year and must be taken throughout the year from January 1st to December 31st. 7.6 Should Party B fail to take the Annual Vacation due to workload or arrangement of Party A, Party B is entitled to the compensation in lieu of each Annual Vacation not taken, in accordance with applicable PRC laws and regulations and the Employee Handbook. 9:02 Employees who have established seniority in accordance with Article 10:00, who have worked the scheduled working day previous to and the scheduled working day following the General or Proclaimed Holiday, unless prevented from working by circumstances beyond their control, shall receive their regular wage for the Holiday and shall have the day off.
9:03 If absenteeism for Medical reasons occurs on the scheduled working day previous to or following a General or Proclaimed Holiday or days off, a Doctor's Statement may be requested.
Holidays and Annual Vacation. 13.1 Holidays and Holiday Pay - The Authority recognizes the following paid holidays:
13.1.1 Employees shall be compensated for the above holidays in the following manner:
(a) If the holiday falls on a scheduled work day and the employee is not required to work, he or she shall receive the normal basic pay for such day.
(b) If the holiday falls during the employee’s vacation period, the vacation shall be extended by one (1) day, or in lieu thereof the employee shall be given one (1) day off at a mutually agreeable time and the employee shall confirm the arrangements in writing prior to commencing vacation.
(c) If the holiday falls on a regularly scheduled day off, and the Authority has not designated an alternative day as a common holiday, the employee may add one day to his or her annual leave or be given one day off with pay at a mutually agreeable time. The employee shall confirm the arrangement in writing.
(d) If the holiday falls on a regularly scheduled work day and the employee is required to work, the employee shall receive two and one-half (2 1/2) times the normal daily basic pay plus any premium pay for hours worked beyond the regular tour of duty.
(e) If the holiday falls on the employee’s scheduled day off and the employee is required to work, he or she shall receive three (3) times the normal basic pay plus any premium pay for hours worked beyond the regular tour of duty.
(f) When a floating holiday is taken, an employee shall be credited with the normally scheduled hours of a tour of duty in that work week.
13.1.2 The Authority further recognizes that employees shall only work one-half (1/2) day on Christmas Eve and New Year’s Eve. Employees who do not work on the day shall receive a half (1/2) day credit. Employees who work a half (1/2) day shall receive one day’s pay. Employees who work in excess of one-half (1/2) day shall be paid in accordance with Article 13.1.1 (d).
13.1.3 Employees who are required to work after 1600 hours on Christmas Eve and/or New Year’s Eve as part of their regularly scheduled tour of duty shall receive an additional payment of one (1) time basic pay, over any other payments provided for in this Agreement for all scheduled hours worked in their tour after 1600 hours on such days.
