10 1. A meal period of one-half (1/2) hour on the nurse’s own time; and
12 2. One fifteen (15) minute rest period without loss of pay during each four (4) 13 consecutive hours of work which, insofar as is practicable, shall be near the middle of 14 such work duration.
16 3. The parties acknowledge the legal requirements and the importance of 17 rest and meal periods for nurses. The parties further acknowledge that the scheduling of 18 regular rest periods may not be possible due to the nature and circumstances of work in 19 an acute care facility (including emergent patient care needs, the safety and health of 20 patients, availability of other nurses to provide relief, and intermittent and unpredictable 21 patient census and needs). The parties therefore agree as follows: 23 (a) The preferred approach is to relieve nurses for two 15-minute rest 24 periods and one 30-minute meal period within an 8-hour shift (but other options 25 for combining meals and breaks, when practicable and consistent with applicable 26 law, may be explored). Each unit will develop a plan to best allow nurses to 27 receive these rest periods and breaks. Any such unit-specific plan will be in 28 writing and must be approved by the unit manager. Any nurse who has a concern 29 that nurses on their unit are not receiving rest periods and breaks may raise that 30 issue at Task Force. 32 (b) If a nurse is not able to take a 30-minute uninterrupted meal period, 33 the nurse will be paid for such 30 minutes. 1. A lunch period of one-half (1/2) hour on the nurse’s own time in addition to the length of the shift; and
2. One fifteen (15) minute rest period without loss of pay during each four (4) consecutive hours of work which, insofar as is practicable, shall be near the middle of such work duration.
3. The parties acknowledge the legal requirements and the importance of rest and meal periods for nurses. The parties further acknowledge that the scheduling of regular rest periods may not be possible due to the nature and circumstances of work in an acute care facility (including emergent patient care needs, the safety and health of patients, availability of other nurses to provide relief, and intermittent and unpredictable patient census and needs). The parties therefore agree as follows:
(a) Scheduling of breaks is best resolved by unit-based decisions, where the affected nurses are involved in creative and flexible approaches to the scheduling of rest periods.
(b) Each unit has the flexibility to develop a process for scheduling nurses for the total amount of rest and meal periods set forth in subsections B.1 and B.2 above, subject to the following:
i. The process must be approved by the unit manager;
ii. The preferred approach is to relieve nurses for two 15-minute rest periods and one 30-minute meal period within an 8-hour shift, but other options, consistent with applicable law, may be explored; and
iii. If a nurse is not able to take a 30-minute uninterrupted meal period, the nurse will be paid for such 30 minutes. If a nurse follows department protocol for preventing interruption and the meal period is still interrupted, the nurse shall be entitled to additional meal period time equivalent to the amount of time spent interrupte...
HOURS OF WORK, OVERTIME AND BREAKS. 5.1 Weekly Ordinary Hours
5.1.1 Full-time: Ordinary working hours for full-time Employees are 38 hours per week averaged out over 52 weeks.
5.1.2 Part-time:
(a) Part-time Employees shall be engaged for a minimum of 12 hours and a maximum of 36 hours per week.
(b) All conditions applicable for permanent full-time Employees shall apply to part-time Employees, however pro rata entitlements for annual leave, personal leave and long service leave apply. The ordinary hours worked will be used to determine the rate at which pro rata entitlements are calculated.

Fifteen (15) minute rest periods shall be provided, without loss of pay 13 and consistent with Oregon wage and hour law, during each shift. 14 Upon mutual agreement of the nurse and the nurse’s 15 supervisor/designee, such rest periods may be combined with meal 16 periods and shall, to the greatest extent possible, be near the middle 17 of such work duration.
19 3. When the nurse believes that they will be unable to take a meal or rest 20 period, the nurse will notify the Charge Nurse who will make 21 reasonable effort to have the nurse relieved.
23 C. Overtime compensation shall be paid at one and one-half (1½) times the 24 nurse’s regular straight time hourly rate of pay for all hours worked in excess 25 of:
26 1. The hours of the scheduled shift of eight (8) hours or greater, or
28 2. Forty (40) hours in each basic workweek, or thirty-six (36) hours in 29 each basic workweek shall be paid at the overtime rate for (a) a nurse 30 whose schedule consists exclusively of three (3) days each week, with 31 each workday consisting of a twelve (12) hour shift, or (b) a night shift 32 nurse whose schedule consists of exclusively four (4) days each 33 week, with each workday consisting of a nine (9) hour shift, provided 1 in either situation that during the workweek the nurse works such 2 number of days on the applicable shift, or
4 3. In lieu of section C.2. above and consistent with the requirements of 5 the Fair Labor Standards act, eight (80) hours in a two (2) week pay 6 period when a work schedule of eighty (80) hours in fourteen (14) 7 consecutive days has been properly established.
