Identification and Evaluation. A. The Recipient shall establish the Area of Potential Effect (APE) for all program undertakings defined in the XXX xxxxx agreement for the State. B. The Recipient shall complete the identification and evaluation of historic properties utilizing existing information including the National Register, state surveys, and county and local surveys. In addition, the Recipient and SHPO may use or develop protocols that are consistent with 36 CFR Section 800.4 for the review of consensus determinations of eligibility. C. The Recipient shall consult with Indian tribes or NHOs to determine if there are historic properties of religious or cultural significance that were not previously identified or considered in surveys or related Section 106 reviews, as appropriate. D. Archaeology surveys are required only for new ground disturbing project undertakings and shall be limited in scope subject to the concurrence of Indian tribes or NHOs that may attach religious or cultural significance to historic properties in the project area. Project undertakings requiring more than minimal ground disturbance shall be forwarded to the SHPO and THPOs or Indian tribes or NHOs concurrently for review. E. In order to avoid potential delays, prior to initiating undertakings the SHPO may review the Recipient’s scopes of work for above ground surveys and archaeology surveys that are deemed necessary to administer the Recipient’s Programs and to implement the terms of this PA. F. The Recipient shall refer disputes regarding determinations of eligibility to DOE for review and referral to the Keeper of the National Register in accordance with 800.4(c)(2).

This may include the review of newly developed or previously produced documentation in coordination with the SHPO of jurisdiction, appropriate Federally-recognized Tribe(s), and any additional Consulting Parties. a. Level of Effort: USACE shall make a reasonable and good faith effort to identify historic properties in accordance with 36 CFR § 800.4(b)(1). USACE shall consult with the SHPO of jurisdiction and appropriate Federally-recognized Tribe(s) to determine the level of effort, methodology necessary to identify and evaluate a variety of historic property types, and any reporting requirements. For properties of religious and cultural significance to affected Federally-recognized Tribe(s), USACE shall consult with the affected Tribe(s) to determine if the APE contains such properties and determine the necessary level of effort to identify and evaluate or avoid any such historic properties. All Identification and Evaluation studies will comply with the Standards (Stipulation VI).
Identification and Evaluation. Certified Staff will review all existing information on any property within an undertaking’s APE, as required by 36 CFR Part 800.4, to determine if such properties may be historic properties and assess the potential for effects to historic properties. A. Certified Staff will consult County files, the SHPO’s Cultural Resources Geographic Information System (CRGIS), as well as building and block files, survey forms, maps and database maintained by the County. For properties that may be affected by an undertaking and have not previously been evaluated for National Register eligibility, Certified Staff will use the National Register Criteria to determine if the property is eligible either individually or as part of a historic district. If district potential has not been previously investigated, the Certified Staff will consider the potential for a district. The Certified Staff will also consider whether the property is clearly eligible under National Register Criterion Consideration G, and is therefore a property achieving significance within the past 50 years because it is of exceptional importance. The County is not required to submit such determinations individually to the SHPO for review but shall submit a list of such properties annually as part of the documentation required pursuant to Stipulation XII (Monitoring). B. Certified Staff will forward initial findings, within 30 days, to the responsible County Program Staff to advise County Program Staff as to the potential effect of undertakings on historic resources. If County Program Staff objects to initial findings, the Certified Staff shall consult with the SHPO and, as appropriate, the Keeper of the National Register in accordance with Stipulation V (Identification and Evaluation) of this Agreement. C. If the Certified Staff determines that no historic properties are affected by a Program activity, it will document the basis for that determination and the HUD- assisted activity may proceed as planned. These determinations shall be on file with the County. D. If the Certified Staff determines that a Program activity will have no effect on any historic properties, it shall document the basis for that determination and the activity may proceed as planned. For properties of religious and cultural significance to affected Tribe(s), FEMA shall consult with the affected Tribe(s) to determine geographical areas containing them that may be affected by an Undertaking and determine the necessary level of effort to identify and evaluate or avoid any such historic properties.

In accordance with the requirements of Section 110 of the NHPA and the Regulations, the Navy has conducted an intensive survey, which identified and evaluated the NRHP-eligibility of properties located within the boundaries of NWIRP Dallas. This survey, in its preliminary form, was submitted to the Texas SHPO for review and comment, and has been made available to interested parties of the general public, the local governments, the Dallas Landmark Commission, and the City of Dallas, and their comments solicited. All comments received were taken into account, and proposed changes considered valid were incorporated into the final document. A copy of the final document was provided the SHPO, the City of Dallas, the concerned Navy commands, the Dallas Public Library, and the general public was notified of its availability for review. No general public comments were received. 2. During the conduct of the investigation detailed in the intensive survey document, only the historic properties previously identified were found to be eligible for inclusion in the NRHP, and that eligibility was based on the buildings meeting the criterion set forth in Criterion “A”. No archeological properties were discovered which met the criteria for inclusion in the NRHP, and as a result it was the determination of the Navy that no archeological historic properties exist within the boundaries of NWIRP Dallas. The Texas SHPO has concurred in that determination. 3. The Navy will ensure the identification of significant records and objects related to the historic past of NWIRP Dallas, and these records and/or objects will be archived at a repository in accordance with the National Records Act or as specified by the Secretary of the Navy, in accordance with the requirements of the NHPA, should NWIRP Dallas ever be conveyed to a non-Federal entity. 4. The Navy will provide guidance to those lessee personnel assigned to NWIRP Dallas to ensure that historic properties are not inadvertently damaged, destroyed, or allowed to deteriorate during their operations.

Identification and Evaluation. The Corps shall complete the identification and evaluation of historic properties as early as practical, following Project/Project component authorization and receipt of funding, to assist in the avoidance and minimization of adverse effects to historic properties well in advance of Project construction. Upon Project/Project component authorization and appropriation of funds, the Corps shall assign a Corps staff member to serve as the Project cultural resources specialist. The Project cultural resources specialist shall meet the SOI Historic Preservation Professional Qualifications Standards, as specified in 36 C.F.R. Part 61 for archaeology, history, architectural history, architecture, or historic architecture. The Project cultural resources specialist will begin consultation with the Consulting Parties regarding PED timeframes, cultural resources surveys, proposed construction schedules, how each Project phase or feature will be identified, delineated, and effects assessed, and development of a detailed consultation and document delivery schedule to be appended to this Agreement in Attachment C within six (6) months of receiving funding at the Charleston District level. If the Project is funded by Project feature or in phases, the Corps will inform the Consulting Parties and consult on the manner in which the Corps proposes to order the identification and evaluation of historic properties and make subsequent determination of effects for each Project phase or feature.
Identification and Evaluation. 1. All identification and evaluation activities shall conform to the Secretary of Interior’s Standards and Guidelines for Archaeology and Historic Preservation, Standards for Identification (48 FR §44716 at §44720-44723). The scope of identification efforts will depend on: existing knowledge about historic properties, including previous surveys, if any; and current management needs. Critical steps in the identification process are: a literature review; consultation with SHPO and NHO; field survey, as necessary; documentation of results; record keeping; and determinations of NRHP eligibility. 2. Prior to initiation of identification efforts at PTA, the Marine Corps will hold a meeting on the island of Hawaii to discuss the scope of the identification efforts, including the APE, and will arrange a site visit to the survey areas. If NHOs on the island of Oahu request it, a meeting will be held on Oahu prior to initiation of identification efforts at Army training areas on Oahu. Due to the remoteness of many of the LZs on Oahu; however, the Oahu meeting would not include site visits. 3. Signatories, Invited Signatories, Concurring Parties, and NHO may request site visits to survey areas, review preliminary survey results, and participate in the identification process. a. Site visits shall be conducted in order for NHO to visit various LZs and provide input on the survey and identification of additional sites, traditional cultural properties, and identification of the APE. b. In coordination with the Army, the Marine Corps shall notify NHO to arrange for site visits at least 15 calendar days prior to the site visit date. c. Site visits shall be conducted according to Army procedures regarding base access and safety. Visitors may be required to wear appropriate safety gear in accordance with these procedures. 4. After surveys are complete, the Marine Corps shall hold a meeting to share survey results and gather input from NHO regarding the identification and evaluation of additional properties, if any. The meeting will also be used to discuss measures to avoid, minimize or mitigate adverse effects to any historic properties identified in the APE. 5. Where the Marine Corps proposes to carry out additional survey within the APE, the Marine Corps (or appropriate landowner) reporting shall follow Stipulation VII and shall include identification and evaluation efforts. 6. Identification and Evaluation. Should the HPMP not be finalized at the time that a phase of the Project may be ready to proceed to construction, WSAFCA shall notify the Corps and the Corps shall consult with the Signatory Parties before construction begins on any phase of the Project. Should the Signatory Parties agree that the work may proceed, WSAFCA and the Corps shall comply with Stipulation V A., B., and C. (Identification and Evaluation) and, as necessary, Stipulation VI (Determination of Effects). WSAFCA shall complete any identification and evaluation, and as necessary, any evaluation of effects to Historic Properties prior to proceeding with construction.
