Legal Leaves. Necessary leave time, not to exceed three (3) contract days per school year, will be granted for any legal proceeding connected with the member's employment with the school system or any other court proceeding in which the member is not the defendant, and is by law required to attend. This leave shall be without loss of regular pay less any fee received. Paid legal leave shall not be granted where the member is a litigant against the District, or is appearing as a witness against the District in any proceeding. In extenuating circumstances and with approval of the Association, the member may apply to the Board for an extension of the above leaves.

Legal Leaves. An employee covered under this Agreement shall be excused from work if he/she is subpoenaed as a witness by anybody empowered by law to compel attendance by subpoena. Any member of the bargaining unit scheduled for jury duty shall be excused from work and shall be paid the difference between his/her regular salary and his/her compensation for jury duty for the period of such jury duty.

Legal Leaves. 1. An employee called for jury duty shall be granted leave with pay. An employee who is a victim of a crime and whose testimony is needed at a related criminal trial, or an employee who is a nonparty to a civil proceeding and is subpoenaed by a court or administrative agency with competent jurisdiction to testify as a witness at that proceeding will receive full compensation at the employee's regular rate of pay. 2. An employee who finds it necessary to attend a civil proceeding to which he/she is a party, shall receive unpaid leave. 3. While an employee is on legal leave, if the proceedings recess or terminate prior to the end of the duty day and a meaningful portion of the employee's duty day remains, the employee shall return to his/her place of duty. 4. When an employee is subpoenaed by a court or administrative agency outside the contract year to testify as a witness as a result of employment duties and responsibilities, the employee will receive full compensation at his/her contracted hourly rate. An employee will be paid a minimum of three and a half (3½) hours for time served that is less than one-half (½) day.

Any employee who is required by the CAIU to appear in a legal proceeding shall be given a leave of absence without loss of pay or other benefits, for the period of time that he or she is required to be at said legal proceeding. 2. Any employee who shall be required by law to appear as a witness in the Court of Common Pleas, in the U.S. District Court, or subpoenaed by which said employee is required to appear unless he/she is a party to the lawsuit, shall be granted a leave of absence, without loss of pay. 3. Any employee who is summoned as a juror shall be granted a leave of absence, without loss of pay and/or benefits, for the time he or she is required to be in attendance as a member of the jury panel. However, any payment received for serving on jury duty shall be deducted from the employee’s salary.
Legal Leaves. Court leave with pay shall be granted to Certificated Employees for the time necessary to make an appearance or appearances in any court proceeding when requested to so appear or receives a subpoena by the School Corporation or another school corporation, State of Indiana, or any agency acting on the behalf of CASA. A Certified Employee called for jury duty shall, during the period of absence from assigned duty by the School Employer, be paid his full Contract salary required provided that such Certificated Employee agrees to return to the Board immediately upon receipt all pay, except mileage reimbursement, received for serving on jury duty.
Legal Leaves. 19.01 The company will grant a leave of absence with pay to an employee who is absent from work as a result of being - Summoned to serve on a jury, - Selected to serve on a jury, or - Served with a summons to attend at the hearing of an action, application or proceeding as a witness in a matter where one of the members of his family or himself is not personally involved. The employee shall receive for each work day served the difference between the regular daily hours times his regular rate of pay and the amounts received for such Jury or Witness Duty.

  • General Leave Notwithstanding any provision for leave in this Agreement, the Employer may grant a leave of absence without pay to an employee requesting leave for an emergency or other unusual circumstances. A leave of absence may also be granted for any other reason in which case approval shall not be unreasonably withheld. All requests and approvals for leave shall be in writing. Upon request, the Employer will give reasons orally for withholding approval.

  • Sabbatical Leaves A. A sabbatical leave, without pay, for one year may be granted to a teacher, and/or 10 and/or 12 month support employee by the Board for full time credit graduate study/degree program in their appropriate field subject to Board approval and the following conditions: 1. Not more than four employees in the system may be granted sabbatical leaves at any one time. 2. Request for sabbatical leave must be received by the superintendent, in writing, no later than January 31st of the school year preceding the school year for which the leave is being requested. 3. The employee has completed at least seven (7) full school years of service in the Xxxxxxxx Township school district. No year shall be credited in which the employee has worked or been on paid leave less than ninety-three (93) days. If more than four requests (two for pay and two without pay) for such leave are submitted, the board will determine those eligible for such leave by the program the employee plans to take. If all candidates are in an approved program, then seniority shall determine the eligibility. The decision of the board shall not be arbitrable. 4. Two of the four sabbatical leaves sited in A.1 above may be with 1/2 pay if the employee is taking a full time Board approved graduate program/degree program in their appropriate field during the day or if they are fulfilling an on-campus requirement of an advanced program. Documentation of this requirement must be furnished with the request stated in A.2 above. B. All sabbatical leaves must be approved by the Board and the Board shall take action on same no later than March 31st of the school year preceding the school year for which the sabbatical leave is requested. The employee shall continue to receive paid health benefits during the sabbatical leave. C. Upon return from a sabbatical leave, which was granted for full time graduate/degree program, the employee shall be placed on the proper step of the salary guide at the level which he/she would have achieved had he/she remained actively employed in the school system during the period of his/her absence, and, in addition, shall receive proper credit for any advanced degree earned.

  • Medical Leave Pursuant to applicable provisions of the Civil Service Rules, County Code, and other law, medical leaves of absence will be granted by the employee’s Department Head upon request only upon submission of a doctor’s certificate or other satisfactory medical evidence of the employee’s need for such leave.

  • Casual Leave Employees may be granted casual leave with pay to a maximum of two (2) hours for the following purposes:

  • Special Leaves An employee who is on an approved FMLA leave or on a Voluntary Reduction in Hours as provided elsewhere in this Agreement maintains eligibility for an Employer Contribution.

  • Cultural Leave Where such leave is approved by the employer, teachers participating in recognised cultural activities within New Zealand or outside New Zealand are entitled to leave with pay on the same conditions as for sports leave.

  • Carer’s Leave An employee may use up to 10 days accrued sick days as carers leave to tend to the care for members of the employee’s immediate household. The leave will be subject to the employee providing reasonable proof of the need for the use of xxxxx’s leave. In circumstances where the employee has exhausted all of the paid leave, a further 2 days unpaid leave may be taken.
