MEAL BREAKS AND TEA BREAKS. (a) An employee will take one unpaid meal break as near as reasonably practicable to the middle of each rostered shift. Meal breaks will be not less than 30 minutes and not more than 90 minutes in duration. Travelling time taken to reach the staff facility at which the meal break is taken will not exceed 10 minutes including “wash-up” time between the time of xxxxxxx tools and commencing the meal break. Travelling time taken to return to the job and commence work after the completion of the meal break will not exceed 5 minutes.
(b) An employee may take one paid refreshment break prior to the unpaid meal break and one paid refreshment after the unpaid meal break. Refreshment breaks will be taken on the job or at the staff facility closest to the location the employee is working and, in any event, will not exceed 10 minutes including “wash-up” time between the time of xxxxxxx tools and resuming work.
(c) An employee may determine the commencement time of refreshment breaks and the time and duration of the meal break provided that the timing and/or duration of the breaks do not interrupt the near completion of work, interfere with the completion of urgent work, interfere with the rectification of a breakdown of plant, or interfere with routine maintenance of plant which can only be done while such plant is idle.
(d) Notwithstanding subclause (c) the employer may from time to time roster meal and refreshment breaks if it is necessary for work to continue uninterrupted. Where the employer so rosters the meal and refreshment breaks and an employee works in excess of 6 hours without a meal break the employee will be paid at overtime rates for the time worked in excess of 6 hours, until released from duty to commence the meal break.
MEAL BREAKS AND TEA BREAKS. 22.1 Unpaid meal breaks
22.1.1 An Employee who works in excess of 5 hours will be entitled to an unpaid meal break of 30 to 60 minutes.
22.1.2 The time of taking the meal break may be varied by agreement between the Employer and Employee.
22.1.3 An Employee who works not more than 6 hours may elect to forgo the meal break, with the consent of the Employer.
MEAL BREAKS AND TEA BREAKS. 20.1. For each four (4) hours worked the employee will be entitled to a paid ten minute tea break.
20.2. In addition, where an employee works greater than five (5) hours, one unpaid meal break of a minimum of 30 minutes (and up to 60 minutes) will be provided, to be taken at a time agreed to by Warrigal. Such time will not count as time worked, subject to clause 20.3 and 20.4 below.
20.3. Residential Care Staff - where an employee is required to remain available to attend to duty or is on duty during their meal break, the employee will be paid at overtime rates for all time worked from the commencement of that meal break until such time that a meal break free from duty is taken by the employee or the employee’s shift ends (whichever occurs first). Whilst payment will be calculated at overtime rates, the time worked until the meal break is taken will be regarded and count as an employee’s ordinary time.
20.4. Home Services/Group Social- where an employee is required by Warrigal to have a meal with a client(s) as part of the normal work routine or client program, they will be paid for the duration of the meal period at the ordinary rate of pay, and Clause 27 Overtime does not apply. This paid meal period is to be counted as time worked.
MEAL BREAKS AND TEA BREAKS. Meal breaks
(a) An employee who works in excess of five hours will be entitled to an unpaid meal break of not less than 30 minutes and not more than 60 minutes.
(b) The time of taking the meal break may be varied by agreement between the employer and employee.
(c) Every employee will be entitled to a paid 10 minute tea break in each four hours worked at a time to be agreed between the employer and employee.
(d) Subject to agreement between the employer and employee, such breaks may alternatively be taken as one 20 minute tea break.
(e) Tea breaks will count as time worked.
MEAL BREAKS AND TEA BREAKS. 2.19.1 Except as provided by this clause, no employee shall be required to work for more than five (5) hours without a break for a meal.
2.19.2 All employees working more than 3.5 hours on any day shall be entitled to a 10 minute paid tea break.
2.19.3 All employees working more than 5 hours on any day shall be entitled to an unpaid meal break of 30 minutes plus a 10 minute paid tea break.
2.19.4 All employees working 8 hours or more on any day shall be entitled to a meal break of 30 minutes plus two ten minute paid tea breaks.
2.19.5 All employees working more than 10 hours on any day shall be entitled to two meal breaks of 30 minutes duration plus two 10 minute paid tea breaks.
2.19.6 Provided that an employee and the Company may agree that the meal break may be extended to up to 60 minutes duration and may be delayed beyond 5 hours.
2.19.7 Provided that where a work process cannot be interrupted by the absence of employees for meal breaks, the majority of employees working on that process and the employer shall determine the timing of meal and tea breaks.
2.19.8 An employee required to work overtime for more than two (2) hours after their rostered finishing time shall be allowed a meal interval of not less 30 minutes after the end of ordinary hours and before 2 hours overtime has been worked.
2.19.9 If overtime continues, an additional 30 minute meal break will be allowed for each 5 hours of overtime worked.
2.19.10 Other than in the case of emergency, the time for meal intervals shall not be altered except with twenty four (24) hours notice to the employee concerned.
2.19.11 Meal intervals where allowed shall not, except as otherwise prescribed, be counted as part of the weekly or daily hours worked.
2.19.12 An employee required to work overtime for more than two (2) hours after their rostered finishing time shall be paid the sum of $9.93 meal money unless they have been notified the day before of the requirement to work overtime. This amount shall be increased to $10.33 effective from 15th December 2008 and then increased to $10.74 effective from 14th December 2009.
2.19.13 All employees shall be entitled to one (1) paid ten (10) minute rest period when more than three and a half (3 ½) hours is worked, and an additional paid ten (10) minute rest break when an employee works in excess of eight (8) hours (exclusive of meal breaks). MEAL BREAKS AND TEA BREAKS. (i) Where an employee is entitled to a meal break, however requests the ability to leave a particular shift early, or commence a particular shift late, that employee may seek special permission from their Executive Manager to forego their meal break.
(ii) The employer shall not be obligated to pay any form of overtime or other payment where an employee chooses to forego their meal break in accordance with subclause (i).
(iii) Where an employee foregoes their meal break as required by the Employer, however is not allowed to leave that shift early, the Employer shall pay the employee at the Basic Periodic Rate of Pay the duration of the meal break not taken.
(iv) The intention and purpose of subclause (i) is to provide both the Employee and Healthcube a means of accommodating special and unforeseen circumstances. As such, no on-going and consistent arrangement may be entered into whereby the Employer agrees to the employee foregoing meal breaks on a regular and systematic basis.
(v) Two paid, separate ten-minute intervals (in addition to meal breaks) shall be allowed to each employee during each shift that is more than 8 hours in duration. Subject to agreement between the employer and the employee, such intervals may alternatively be taken as one twenty-minute interval.
MEAL BREAKS AND TEA BREAKS a. No employee shall be required or permitted to work more than five hours without a meal break.
b. The meal break will be at least 30 minutes and up to 60 minutes in length. The meal break may be extended up to a maximum of two hours subject to agreement being reached between the employee and their leader.
c. The RAC will endeavour to provide employees notice the day prior if overtime or additional hours are to be worked. When notice cannot be given and employees are working during what is considered a meal period, the RAC will provide an appropriate meal to employees or make some other mutually agreed arrangement.
d. RAC will determine the time at which employees will take breaks.
MEAL BREAKS AND TEA BREAKS. The parties reaffirm previous Agreements to operate equipment on a continuous basis without the need to stop the equipment for meal breaks. Where possible this is to be done with crews on the machine rather than to use employees from other sections or for meal breaks to be included as part of make ready periods. Meal breaks are to be taken in such a fashion that allows machine efficiencies to be maximised.
MEAL BREAKS AND TEA BREAKS. (a) No employee shall work for more than five hours continuously without an unpaid meal break. An employee may choose to work up to six hours continuously without a meal break.
(b) Any meal break shall be 30 minutes. An employee may elect to take a meal break of between 45 and 60 minutes. An employee intending to elect to take a meal break longer than 30 minutes must advise the Manager on duty of their intent to do so at the commencement of their shift (or as close to as is reasonably possible).
(c) Employees who work for four hours or more shall be entitled to a paid tea break of ten minutes and employees who work seven hours or more will be entitled to a second paid tea break of ten minutes.
(d) The taking of a tea break shall be at a mutually agreed time. If the work period includes a meal break and a tea break the tea break is to be granted in that portion of the work period which is greater. Unless requested by the employee no tea break or meal break shall be given or taken within one hour of the employee’s commencing or ceasing time or within one hour before or after any meal.
(e) By agreement, an employee may forego a second tea break for an earlier cessation of work.

As such, no on-going and consistent arrangement may be entered into whereby the employer agrees to the employee foregoing meal breaks on a regular and systematic basis.
